The fine shall be assessed by the filing officer and the moneys collected shall be deposited: 1. In the General Revenue Fund, in the case of a candidate for state office or a political committee that registers with the Division of Elections; or 2. In the general revenue fund of the political subdivision, in the case of a candidate for an office of a political subdivision or a political committee that registers with an officer of a political subdivision.” ELECTION CALENDAR DETAILS 2015 Page 7 of 7 WAIVER OF REPORT – In any reporting period when there has been no activity in the account (no funds expended or received) the filing of the required report is waived. However, the filing officer must be notified in writing on the prescribed reporting date that no report is being filed. (See Section 106.07(7), F.S.) Form DS-DE 87 Waiver of Report is to be used. PENALTY FOR LATE FILING - Any candidate, political committee, political party or an electioneering communication organization failing to file a report on the designated due date shall be subject to fine of $50 per day for the first three days late and, thereafter $500 per day for each late day; not to exceed 25% of the total receipts or expenditures, whichever is greater, for the period covered by the late report. However, for the reports immediately preceding each primary and general election, the fine shall be $500 per day for each late day, not to exceed 25% of the total receipts or expenditures, whichever is greater, for the period covered by the late report. (See Section 106.07(8)(b), F.S.) 2 F.S. 97.055 Registration books; when closed for an election (1)(a) The registration books must be closed on the 29th day before each election and must remain closed until after that election. If an election is called and there are fewer than 29 days before that election, the registration books must be closed immediately.
