§ 24-151 ATLANTIC BEACH CODE
j. Skateboard, skating, bicycle or similar ramps, for use on private property only,
placed or constructed in fixed locations and made of wood, block, concrete or
similar materials,provided that these are not located within required front yards
or the street side yards on a corner lot. Due to excessive noise,which may result
from the use of such ramps,time of use shall be limited to the hours between 9:00
a.m.and 10:00 p.m.Such ramps shall be maintained in a safe and good condition,
and shall be disassembled and removed from the property if allowed to deterio-
rate to an unsafe or unsightly appearance.
k. Storage and tool sheds, not to exceed one hundred fifty (150) square feet and
twelve (12) feet in height. Only one (1) detached storage or tool shed shall be
allowed on any single residential lot, and such structures shall be a minimum
distance of five(5)feet from the rear and side lot lines.
1. Screened enclosures and pool cages with screened roofs or similar nonstructural
roofs such as awnings and the like, located a minimum of five (5)feet from any
side or rear lot line.Such screened enclosures shall not be allowed in front yards.

m. Personal pets,limited to those animals customarily considered as pets,and kept
only on the same premises of the occupant(s)of the principal residential building.
n. Outdoor shower enclosures and open exterior stairs within rear or side yards,
located a minimum of three (3) feet from side lot lines.
(2) In any zoning district, except as to private swimming pools.
a. All accessory uses and structures shall comply with the use limitations applicable
to the zoning district in which they are located. Space within an accessory
structure shall not be leased or used for any use, activity or purpose other than
those typically incidental to the use of the principal building.
b. No accessory structure shall be used as a residence,temporarily or permanently,
except in accordance with section 24-89,and no accessory structure shall be used
for any commercial or business purpose unless approved as a home occupation in
accordance with the provisions of section 24-159 of this chapter.
C. Unless otherwise specified within this section, all accessory structures shall
comply with the land development regulations, including the minimum yard
requirements applicable to the zoning district in which they are located.
d. Unless otherwise specified within this section, accessory uses and structures
shall not be located within required front yards and shall not be closer than five
(5)feet from any lot line.
e. Accessory structures shall not be more than fifteen(15)feet in height,except in
accordance with section 24-89 or preceding subsection (b)(1)e.
f. No accessory building or structure shall be located closer than five(5)feet to any
other building or structure on the same lot.Any accessory building or structure

governing authority in the discharge of his duties, shall not thereby render
himself personally liable,and is hereby relieved from all personal liability,for any
damage that may accrue to persons or property as a result of any act required or
permitted in the discharge of his duties.Any suit brought against any officer or
employee or member because of such act performed by him in the enforcement of
any provision of this code shall be defended by the department of law until the
final termination of the proceedings.
(6) Reports. The building official shall submit annually a report covering the work of .
the building department during the preceding year. He may incorporate in said
report a summary of the decisions of the board of adjustments and appeals during
said year.
(b) Powers and duties of the building official.
(1) General. The building official is hereby authorized and directed to enforce the
provisions of this code. The building official is further authorized to render
interpretations of this code, which are consistent with its spirit and purpose.
(2) Right of entry. Whenever necessary to make an inspection to enforce any of the
provisions of this code, or whenever the building official has reasonable cause to
believe that there exists in any building or upon any premises any condition or
code violation which makes such building, structure, premises, electrical, gas,
mechanical or plumbing systems unsafe, dangerous or hazardous, the building
official may enter such building, structure or premises at all reasonable times to
inspect the same or to perform any duty imposed upon the building official by this
code. If such building or premises are occupied, he shall first present proper
credentials and request entry. If such building, structure or premises are
unoccupied, he shall first make a reasonable effort to locate the owner or other
persons having charge or control of such and request entry.If entry is refused,the
building official shall have recourse to every remedy provided by law to secure
entry.
When the building official shall have first obtained a proper inspection warrant
or other remedy provided by law to secure entry, no owner or occupant or any
other persons having charge, care or control of any building, structure, or
premises shall fail or neglect,after proper request is made as herein provided,to
promptly permit entry therein by the building official for the purpose of
inspection and examination pursuant to this (Code.
(3) Stop work orders. Upon notice from the building official, work on any building,
structure, electrical, gas, mechanical or plumbing system that is being done
contrary to the provisions of this code or in a dangerous or unsafe manner, shall
immediately cease.Such notice shall be in writing and shall be given to the owner
of the property, or to his agent, or to the person doing the work, and shall state

Dear Property Owner:
Please be advised, Atlantic Beach Code Enforcement has found your property referenced above
to be in violation of the City of Atlantic Beach, Code of Ordinances, to wit:
VIOLATION
Violation Description
FBC Section 105 Permit 105.1 Required. Any owner or
authorized agent who intends to construct, enlarge, alter,
repair, remove, demolish, or change the occupancy of a
building or structure, or to erect, install, enlarge,
alter, repair, remov::°, convert or replace any
required impact resistant coverings, electrical, gas,
mechanical or plumbing system, the installation of which is
regulated by this code, or to cause any such work to be
done, shall first make application to the Building Official
and obtain the required permit.
Violation Description
Sec. 24-154. Outdoor display, sale and storage of
furniture, household items, merchandise and business
activities outside of enclosed buildings.
(g) Within all residential zoning districts, and also
including any property containing a residential use,
household items, furniture and those items customarily
intended for indoor use shall not be displayed, maintained
or permanently stored outdoors, or in any location on the
lot where such items shall be stored or properly disposed
of to avoid mold,rodent and insect infestations which may
result in health risks and which also create unsightly
appearance that negatively affect neighborhoods. Such
violations shall be corrected immediatly upon written order
from the city.
This letter requests that the noted violations be corrected by removing 2 plastic sheds,
repairing soffit screen, and removing all outside storage of old door and bicycle within
thirty (30) days of the receipt of this notice.
To avoid having this case be referred to the Code Enforcement Board, all listed violations on this
notice must be in compliance on or before the date established by Atlantic Beach Code
Enforcement. The Board may impose fines up to two hundred fifty($250.00) per day for
continuing violations. Upon completing the corrective action required, it is your responsibility to
contact Atlantic Beach Code Enforcement and arrange for an inspection to verify compliance.

Florida Statutes and exists for the purpose of facilitating the enforcement of the Code of
Ordinances. It is comprised of seven citizens of Atlantic Beach who meet regularly to hear

and $500.00 per day for a repeat violation. If the violation is corrected and then recurs or if the
violation is not corrected by the time specified for correction by the Code Enforcement Officer,
the case could be presented to the Code Enforcement Board even if the violation has been
corrected prior to the Board hearing. Upon completing the corrective action required, it is your
responsibility to contact Atlantic Beach Code Enforcement and arrange for an inspection to
verify compliance at(904) 247-5855.

THIS CAUSE came for public hearing before the Code Enforcement Board on November
17, 2014, and the Board having heard testimony under oath, received evidence, and heard
arguments respective to all appropriate matters, and thereupon issues the Findings of Fact,
Conclusions of Law and Order as follows:
FINDINGS OF FACT
1) That the Respondent owns the property located at 724 CAVALLA RD, Atlantic
Beach, Florida.
2) That notice was sent by certified mail and that Respondent was present at the
hearing.
3) That notification of the violations of the City of Atlantic Beach, were made and
served on the Respondent as evidenced in this hearing.
SWO Florida Bldg Code FBC Sec. 105 Permits - Required
The aforementioned property shall be corrected by obtaining permit and approved final
inspection or remove the shed.
CONCLUSIONS OF LAW
THAT the Respondent BOBBI D WHEATON is not in compliance and has failed to correct such
violation as of this hearing date.
ORDER
Based upon the foregoing Findings of Fact and Conclusions of Law and pursuant to the authority
granted in Chapter 162, Florida Statutes, and the Code of Ordinances of the City of Atlantic
Beach, Florida it is Ordered:
THAT the Respondent is found in violation for non-compliance and must obtain
compliance on or before January 5, 2015. Failure to comply will result in fines of$100.00 for
the first day and $100.00 for every day thereafter while the violation continues to exist. In
addition, any fine shall also include the administrative costs to the City incurred in prosecuting
this case.
THAT the Respondent is responsible for contacting the City of Atlantic Beach Code
Enforcement Officer and obtaining an inspection of compliance.
THAT failure to pay all accumulated fines will result in a lien being placed against the
property at 724 CAVALLA RD for the total assessment plus costs incurred for the filing of the
lien. All lien amounts are to be made payable at an interest rate of ten (10) percent per annum
from date of certification until paid.
DONE AND ORDERED THIS November 17, 2014.

I'm sending this to request an extension for the violations of the sheds. I was hoping to have this resolved already, yet I
have brothers coming from out of town for the holidays and they want to go through our parents things in the sheds
prior to getting rid of the remainder of their things I have yet to bring myself to go through since their passing. I hope
the city finds compassion in their hearts to grant me this request. With the knowledge everything will be addressed after
