AN ACT (A) to Amend Section 14 of Chapter 1390?, Laws
of Florida, Special Acts of 1929, Entitled:' "AN ACT to Fix '
the Territorial Limits of the Town of Atlantic Beach, to
' ' Provide for Its Government and Prescribe Its Jurisdiction
and Powers". By Enlarging the Powers ofF.the Town Council of 4
Said Town with Regard to Water Supply Systems , Advertising,
Expenditures for Public Health Projects, Building Codes, '
Garbage Collection and Fees, and Control Over Privately Owned
Public Utilities; (B) to Amend Section 2? of Said Chapter 13907,
by Removing the Therein Imposed Restriction upon the Total Tax
Levyable upon any Property in any One Year; (C) to Amend Section
35 of said Chapter 13907 by Conferring upon the said TownCouncil
Traffic Supervisory Powers Over Certain State and County Roads;

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF FLORIDA:
SECTION 1. Section 14 of Chapter 13907, Laws of Florida,

• � Section 14. The Town Council shall have the power, by
ordinance, to levy and collect taxes on all property and privileges

taxable by law for State purposes; to appropriate money and pro- 3
vide for the payment of all debts and expenses of the town; to
make regulations to prevent the introduction of contagious

diseases in. the town; to establish hospitals, jails, houses of

detention and correction, and to make regulations for the
government thereof; to make regulations to secure the general
health of the inhabitants, and to prevent and remove nuisances;
to provide for the cleaning and keeping in good sanitary con-
dition all premises within the limits of the town; to regulate
the construction and arrangement of earth closets and privies,
and to make all reasonable rules and regulations in regard
thereto; to provide the town with water by waterworks, within
or beyond the boundaries, by contract or otherwise -- and, in
such instances, to (a) issue, if need there .be, waterworks
revenue certificates, and (b) impose upon and collect from,
each owner, lessee, or agent in charge of every tract of im-
proved or unimproved real estate in or adjacent to said town,
and served by any municipally owned or operated waterworks
system extending the benefit of fire protection through the
medium of fire hydrants, a reasonable fire hydrant rental;
to provide for the prevention and extinguishment of fires,
and to organize and establish fire departments; to provide
for lighting ,the town; to make appropriations to open, alter,
abolish, widen, extend, establish, improve, clean and keep in
repair streets, alleys and sidewalks; to erect, establish and
keep in repair privies, culverts, sewers and gutters; to grant
rights and franchises to and upon the streets, alleys, public
roads, ways and avenues of said city for public utility; to
make appropriations for lighting streets and public buildings,
and for the erection of all buildings necessary for the use of
the town; to license, tax and regulate hackney carriages, carts,
wagons, drays, buses, automobiles and taxi cabs, and to fix the
rate to be charged for the carriage of persons and of property
within the town; to license, tax and regulate all privileges
taxable by the State; to prohibit and suppress all gambling
houses, bawdy and disorderly houses, and obscene pictures and
literature; to regulate and restrain or prevent the carrying
on of manufactories dangerous in causing or producing fires;
to regulate the license and sale of firearms and suppress the
carrying of concealed weapons; to regulate the storage of com-
bustibles, explosive and inflammable materials; to provide for
and regulate the inspection of beef, pork, flour• meal and other
provisions; to establish standard weights and measures and pro-
vide for the enforcement of the same; to regulate the inspection
of milk, butter, lard and other provisions; to regulate the
vending of meat, poultry, fish, fruits and vegetables; to
establish and regulate markets; to impose penalties upon owners,
occupants or agents of any house, walk, or sidewalk, or other
structure, which may be considered dangerous or detrimental
kto the citizens, unless, after due notice to be fixed by
ordinance, the same be removed or repaired; to regulate, tax,
license or suppress the keeping and going at large of all
animals within the town; to impound the same, and in default
of redemption in pursuance of ordinance, to sell , kill , or
otherwise dispose of the same; to establish pound limits
within the town; to provide for inolusing4 improving and
regulating public grounds belonging to the town in or out of
the corporate limits; to regulate bathing and fishing in
waters within the jurisdiction of the town; to yearly ap-
propriate and spend from the said Town's general fund, and
for municipal advertising purposes, any amount equal to but
not in excess of the sum of One Hundred ($100.00) Dollars;
to annually contribute and spend from said general fund such
reasonable amounts as in the opinion of the said Town Council
are necessary in appropriate furtherance of any worthy public
health, welfare, or hospitalization project or services in or

near the said Town of Atlantic Beach; to enact, maintain, and
enforce a comprehensive building code; to regulate the disposal
and collection of garbage within and adjacent to the Town
limits, and impose upon and collect from every corner, lessee,
or agent in charge of any property serviced by the Town's
garbage collection force, a reasonable fee for such collection;
to fix the rates to be charged by any privately owned public
utility operating within the corporate limits of the Town, and
to require the acceptance by such utility of an operating
franchise from the Town -- which franchise shall, as all other
property, be subject to taxation; to require, in the reasonable
exercise of its discretion, and after careful study of all
factors prevailing in any given situation, (a) any needed im-
provement in the quality of the service rendered by the afore-
said public utility , and (b) any essential extension to or
restriction in the geographical area served by said, utility;
to pass all ordinances necessary for the health, morals, con-
venience and safety of the citizens; to secure peace and good
order in the Town, and to carry out the full intent and meaning
of this Act, and to accomplish the object of this incorporation;
to provide for the arrest of persons violating any ordinance,
and for their punishment, upon conviction, by fines, forfeitures,
penalties and imprisonment with or without labor; but no penalty
kl/ shall exceed Five Hundred Dollars, and no term of imprisonment
shall be for a longer term than three months for the same offense.
SECTION 2. Section 27 of said Chapter 13907 is hereby
amended to read as follows:

property for taxation; and the Town may also make such speed : :?,„.
assessments of property for improvement as are specified by
C4/1 law. All assessment of property for taxation shall be as
nearly as practicable in the manner now provided by the law
of the State for the assessment of taxes. It shall not be

necessary to describe personal property assessed for taxation,
4 and the term "personal property" shall be a sufficient des-
cription to sustain any listing and assessment of the personal
property of any person, firm or corporation.
-ECTION 3. Section 35 of said Chapter 13907 is hereby
amended to read as follows:
Section 35. The Town Council shall have full and complete
jurisdiction, charge and control over all public or dedicated
roads, ways, avenues, streets and alleys in the limits of said
town, and shall have the power to cause obstructions to be re-
moved therefrom and to restrain and regulate the use and occupation
of same by any person or corporation whatsoever to the end that
the safety, contort and welfare of the public may be secured and.
• preserved. The ocean beach from low water mark to the bulkhead
line and between the north and south limits of said Town is here'.
by declared to be a public highway and the Town is hereby given
jurisdiction and control over the same. And the said Town Council
shall, only for the purposes of police and road patrol and arrest,
and the enactment and enforcement of appropriate traffic regu-
lations and measures, have full and complete jurisdiction, charge
and control over all state and county roads, highway , or thorough
fares, in or adjacent to , or adjoining the corporate limits of
the said Town.
SECTION 4. Section 39 of said Chapter 13907 is hereby
amended to read as follows:
Section 39. The Mayor and Town Council in their corporate
capacity are hereby authorized to issue from time to time, the
bonds of said Town, of such denominations, bearing such rate of
interest becoming due in such time and upon such conditions as
may, by ordinance, be determined; which bonds shall be used for

such municipal purposes as may be provided by ordinance and for
the payment of which bonds and the interest thereon, the entire
taxable property in said Town shall be thereby pledged, provided,

that before the issuance of said bonds shall be made, the is-
suance of the bonds then proposed to be issued shall be provided
for by ordinance, expressing in general terms the purposes for
which such bonds are to be used, and subsequently approved by
three-fifths of the votes cast by the qualified electors of said
Town who were qualified to vote at the Town general election
held next preceding such election, who are freeholders in said
Town (or if said question of issuing bonds be submitted to be
voted upon at any general town election, then by three-fifths
of the votes cast by the qualified electors who are freeholders,
and are entitled to vote at said town election) at an election
held for that purpose at that time and in the manner to be
prescribed by ordinance, or at a general town election.
The question of the issuance of said bonds or any part thereof
may be submitted from time to time. The Mayor and Town Council
shall levy annually such special tax on the taxable property
within the corporate limits of said Town as may be necessary
to pay the interest on said bonds and provide a sinking fund
for the payment of said bonds.
SECTION 5. This Act shall not become effective unless
ratified by a majority vote of the qualified electors of Atlantic
Beach, Florida, voting in an election to be held for the ratifi-
cation or rejection hereof, which election shall be called and
held in accordance with the provisions of its Charter, for the
purpose of permitting the qualified electors of said City to
express their approval or disapproval of this Act. In the event
of the ratification of this Act, the same shall become effective
immediately upon the official determination of said ratification.
SECTION 6. Subject to the limitations and conditions
as to the effectiveness and effective date of this Act as con-

tained in Section 5 hereof this Act shall become a law immediately
upon its passage and approval by the Governor, or upon its be-
coming a law without such approval.
