1710 Beach Avenue Lot Split
The City of Atlantic Beach cannot approve the division of the property currently addressed as
1710 Beach Avenue and comprised of part of Lot 7, the south 10 feet of Lot 10 and Lots 11 and
12, Block 8 of Ocean Grove Unit 1 as presented in your letter dated February 16, 2015.
Additional information is required and certain conditions must be met prior to City approval of
the proposed lot division.
There is concern about the status and ownership of the part of Lot 7 described in the legal
description obtained from the Duval County Property Appraiser's Office. Lot 7 of the plat is not
adjacent to the other lots listed and parcel maps maintained by the City of Jacksonville do not
visually show ownership of a part of Lot 7. Staff was not able to find a copy of the most recent
deed for the property on the Duval Clerk of Courts website to verify the legal description.
Additionally, a copy of a survey in our files does not reference Lot 7. A copy of the deed may
clarify this information.
If the issue of Lot 7 is resolved, then City can verify that the property can be split into two
buildable lots with one condition.
The recognized division would be as follows;
Eastern Lot: Lot 11 and the south 10 feet of Lot 10, Block 8 of Ocean Grove Unit 1.
Western Lot: Lots 12, Block 8 of Ocean Grove Unit 1.
The one condition would be that the division of property cannot create a nonconforming
structure. The existing structure would have to be demoed or altered so as to meet current codes.
A survey proving compliance with current setbacks would be required prior to approval.
Upon meeting this condition, this division would be consistent with all current provisions of the
Land Development Regulations of the City of Atlantic Beach.
The zoning of the current property and the resultant properties is and would be Residential
General. This zoning classification does allow two-family structures. However, the current
property configuration and the proposed divided lots do not meet the minimum lot size of 14,500
square feet required for two-family structures. No more than one single family home can be built
on this property today or on each of the resulting individual properties after division.
