I had to get approval from my director whom is the only one that can make such determinations. It is his decision that because the trees were planted by the city in violation of the city's own planting standards (separation requirements)that the 9 inch Live Oak can be removed with no mitigation required. Mitigation is still required for the removal of the 18 inch palm tree.As such,9 inches of new trees must be planted on property or paid into the Tree Fund.The planted tree can be just about any species and be located anywhere on property. If you elect to pay into the Tree Fund,the rate is$113.00 per inch. Please let me know how you would like to proceed. Derek W. Reeves Zoning Technician City of Atlantic Beach 800 Seminole Road Atlantic Beach, FL 32233 (904) 270-1605 dreeves(a�coab.us From: Bill &Theresa Todd [mailto:todd7873C @ bellsouth.net] Sent: Thursday, June 18, 2015 8:49 AM To: Reeves, Derek Subject: RE: 2nd tree denial Good morning Derek, This is regarding our recent tree removal permit that was denied.Since there is no place on the permit application for providing background information, we respectfully request that our application be reconsidered based on the following: Ten to 15 years ago, at our request,the COAB planted four oak trees our yard (right of way).We could have chosen to put in no oak trees(like most of our neighbors did), one tree,two trees,three trees or four trees.The oaks were very small with trunk diameters of about 2+/-inches.We faithfully watered, mulched, and cared for these trees exactly as instructed and they grew better,faster and stronger that almost all of the other oaks planted around the area at that time. Based on our Tree Removal Permit that was denied, we will still have three more oak trees(two 11 inch and one 13 inch diameter) in our yard than there were when we purchased the house.We believe we should get credit for that, instead of being penalized over$1000 because we planted too many too many oak trees in our yard. The Standards for review in the Code on the COAB website states"The administrator shall consider the following in making a determination of compliance with the provisions of this chapter." "c. Necessity to remove trees in order to construct approved and permitted improvements to allow reasonable economic enjoyment of the property." Since we bought this house 20 plus years ago, Seminole Road has become much busier, and more like a speedway between the 5-way stop at Plaza and the stop sign at 18th street. Cars and trucks regularly do 40 to 45 mph in front of our house and it has become very difficult to safely back out of out of our driveway. For safety and aesthetic improvement, we obtained a permit to install a circular paver driveway.We were originally going to try to go between oak#s 3 and 4, but that would damage the roots of both trees. We then considered removing oak tree#4 to install the driveway, until we had arborist come out and educate us about the oak trees. We consulted with two separate arborist prior to submitting our permit applications.They both came out to view our trees,and both told us that oak#s 2,3 and 4 were planted too close together.They are about 20 feet apart. Because of their large canopy and even larger root systems as they mature,the minimum spacing between live oak trees should be at least 40 feet and they should be 20 feet from any structure. Planting them too close together can cause dieback due to lack of nutrition/moisture, susceptibility to topple due to poorly anchored roots, and stunted growth due to reduced photosynthesis.The arborist also said that oak#3 was planted too low in the ground.This and its proximity to oaks#5 2 and 4 is likely why it is not at large (only 9 inch diameter) and healthy as the other three. Removing oak#3 would put the spacing of oak#s 1, 3 and 4 at right about 40 feet and give them the best opportunity of remaining healthy throughout their 200 year life. "d. Existence of any adverse site conditions which may affect the implementation of the provisions of this chapter." Our lot simply cannot accommodate any additional large canopy trees. Overhead electric lines run the full length of our front yard about 30 feet from our house.We also maintain 19 very mature 75+/-year old palm trees in our back yard and have allowed at least four other significant palms to grow since we purchased the property(we should also get credit for those).We have so many trees on our modestly sized lot,that there is no good place to move oak#3, or to plant any additional large canopy tree(s).We have asked our neighbors if we could move it to their yard and they declined. We would consider having it moved to Johansen Park if that was allowed, but there is no way to guarantee that it will survive/thrive for 3 years. We totally agree with protecting the tree canopy, beauty, and "feel" of Atlantic Beach, as proven by us requesting the four oaks to be planted in our yard and maintaining many other large mature trees.We truly hope that the ordinance will prevent major tree removal by developers like the Atlantic Beach Country Club and groups developing properties like the one at Seminole and 11th Street. It is a tragedy that the two very large oaks were allowed to be removed from that overly developed lot. No amount of tree fund money can ever replace how beautiful that property looked before they purchased it. I apologize for this being much longer than intended.
