Since early 2015, the home has been undergoing a renovation under Building Permit 15-RAAR-173. The contractor holding the permit is THG General Contractors, Inc. The qualifying agent for THG is Terry H. Gause. The project is not complete, but very little work is needed for completion and Final Inspection. As the owners of 800 Sherry Drive,we have terminated the contract with THG General Contractors, Inc. and request that Building Permit 15-RAAR-173 be terminated as well. We will hold the City of Atlantic Beach harmless for any consequences of terminating the permit,obtaining a new permit to complete the work, or completing the work. Since •ly 22 Te :rown AUG 2 8 2015 August 18, 2015 OFFICE COPY Terry Gause THG General Contractors, Inc. 634 Second Avenue, North Jacksonville Beach, FL 32250 Dear Terry, As a result of non-performance according to the Contractor Agreement dated November 10, 2014,between THG General Contractors and Terry and Debbie Brown, I am terminating your services as our general contractor effective August 14th. In Article 2 -Time of Completion of the agreement, it states that the work shall be substantially completed on or before May 28, 2015. Since it is now August 18 and the work is still not completed,we will no longer require your services on the project. As you know,there have been numerous issues with the project- an incorrect and damaged front door, scheduling problems with floor tile, cabinets and counter tops, and incorrect installation of the in-line blower, among many others. There have also been several instances where you have misled us about the status of the project- the front door and the tree removal permit are two examples. In addition to these issues,there have been many missed deadlines throughout the summer. Most recently on August 2nd, I sent you an email with an attached punch list with twenty-five items on the list. I asked to meet with you at the job site at 12:00 on Friday,August 7th. Not only did you not show up for the meeting, but less than half of the items on the list were completed and there was no one working at the project. On August 9th, I sent you another email with an attached punch list of twenty items. I stated in the email that I wanted the keys to the house from you and the punch list completed by 5:00 pm on Thursday,August 13th. By Thursday evening,the punch list was not complete and I did not here from you until Tuesday, August 18th. As I mentioned to you last Wednesday,August 12th, I have funds ready to disburse to you for work that has been completed. Once I have outstanding invoices from subcontractors and lien waivers from the subcontractors that have been paid completely, I will release the funds to you. I also intend to be fair in the final payments to THG General Contractors. My plan is to pay you for all work that you completed in a timely manner. As you know,the bank will withhold the final 10% of the funding until the project is complete,all paperwork is submitted and proof that all subcontractors have been paid has been provided. I would also like for you to provide the subcontractors with permission to deal with me directly.
