Jones, Jr. 781 Begonia Street Atlantic Beach, Florida 32233 RE: Notice of Violation—City of Atlantic Beach Code of Ordinances and International Property Maintenance Code 781 Begonia Street, Lot Pt 4 and Pt 5, Block 145, Sec H Atlantic Beach RE#170927-1700 CASE NO. 82411 Dear Mr. Jones: Please be advised, Atlantic Beach Code Enforcement has found the property referenced above to be in violation of City of Atlantic Beach, Code of Ordinances, International Property Maintenance Code Section 302.8 —Motor Vehicles to wit: VIOLATIONS INTERNATIONAL PROPERTY MAINTENANCE CODE Section 302.8—Motor Vehicles "No inoperative or unlicensed motor vehicle shall be parked or kept or stored on any premises, and no vehicle shall at any time be in a state of disrepair, major disassembly or in the process of being stripped or dismantled". (Green Ford Truck, inoperable and expired tags) CITY OF ATLANTIC BEACH CODE OF ORDINANCES Section 24-163 (a-1) Storage and parking of commercial vehicles and recreational vehicles and equipment and repair of vehicles in residential zoning districts. (a) The storage and parking of commercial vehicles greater than twelve thousand five hundred (12,500) pounds gross vehicle weight and dual rear wheel vehicles shall be prohibited in all residential zoning districts. Commercial vehicles of less than twelve thousand five hundred (12,500) pounds gross vehicle weight, recreational vehicles, and trailers of all types, including travel, boat, camping and hauling, shall not be Page 2 781 Begonia Street December 7, 2011 (b) parked or stored on all lot occupied by a dwelling or on any lot in any residential zoning district, except in accordance with the following requirements: (1) No more than one (1) commercial vehicle of less than twelve thousand five hundred (12,500) pounds shall be permitted any residential lot, and such commercial vehicles shall be parked of a minimum of twenty (20) feet from the front line. Such commercial vehicle shall be used in association with the occupation of the resident. (Only one boat, recreational vehicles, or trailer may be stored in yard) This letter requests that the noted violations be corrected by removal of the unlicensed Green Ford Truck, removal of all trailers, open trailers, box trailers, camper trailers, etc. except one and limit storage to one on site within ten (10) days from receipt of this notice and maintain storage of no more than one trailer on the premises. A re-inspection will be done on or before December 20, 2011. To avoid having this case be referred to the Code Enforcement Board, all listed violations on this notice must be in compliance on or before the date established by Atlantic Beach Code Enforcement. The Board may impose fines up to two hundred fifty ($250.00)per day for continuing violations. (3) Commercial construction equipment or trailers containing construction equipment shall not be parked or stored on any residential lot except in conjunction with properly permitted, ongoing construction occurring on that lot. (b) Recreational vehicles stored or parked on any residential lot shall be subject to the following provisions: (1) Not more than one(1) recreational vehicle, boat or boat trailer, or other type of trailer shall be stored or parked on any residential lot which is five thousand (5,000) square feet in lot area or less. Minimum lot area of ten thousand (10,000)square feet is required for storage or parking of any second recreational vehicle, boat or boat trailer, or other type of trailer. (2) Recreational vehicles, boats or boat trailers, or other type of trailer shall not be parked or stored closer than fifteen (15)feet from the front lot line and shall be parked in a manner that is generally perpendicular to the front property line such that length is not aligned in a manner that extends across the front of the lot, it being the intent that recreational vehicles, boats and trailers that are parked forward of the residence should not excessively dominate the front of the lot. (3) Recreational vehicles,travel trailers or motor homes shall not be inhabited or occupied, either temporarily or permanently,while parked or stored in any area except in a trailer park designated for such use as authorized within this chapter. (4) Recreational vehicles parked or stored on any residential Lot for a period exceeding twenty-four(24) hours shall be owned by the occupant of said lot. (c) A junked or abandoned vehicle, or one that is inoperable, as defined within this Code,shall not be parked or stored in any zoning district. Further, mechanical or other automotive repair work on any motor vehicle shall not be performed out-of-doors within any residential zoning district, except for minor maintenance or emergency repair lasting less than eight(8) hours and performed on a vehicle owned by the occupant of the residential property.
