Where such fencing is otherwise placed on a parcel,but remains visible from the commercial corridor,landscaping shall be installed which substantially conceals such fencing. Where such fencing,as described above is lawfully pre-existing,a period of four(4)years from the effective date of these regulations shall be extended during which all fencing shall be made consistent with the above provisions." This letter requests the noted violation be corrected by replacing or removing the chain link fence located on the property within ten days from receipt of this letter. The City of Atlantic Beach adopted new regulations for the commercial corridor in January of 2003. If you choose to replace the fence,you will be required to obtain a permit approval from the City prior to installation. An alternative fence choice for visibility and security purposes may be an open aluminum fence. If the violation is corrected and then recurs or if the violation is not corrected by the time specified in this notice this case may be presented to the Atlantic Beach Code Enforcement Board even if the violation has been corrected prior to the board meeting.The Code Enforcement Board may impose fines up to$250 a day for each day the violation is not corrected. A re-inspection will be done on/or after July 12,2010. To avoid having this Code Enforcement case set for hearing, all listed violation(s)on this notice must be in compliance on or before the date established by Atlantic Beach Code Enforcement.Upon completing the corrective action(s)required,it is your responsibility to contact Atlantic Beach Code Enforcement and arrange for an inspection to verify compliance. This provision now states that chain link fences are prohibited in any required Front Yard, which is the front twenty(20)feet of the parcel. (The regulations formerly prohibited chain link fences within the corridor along the Mayport Road frontage.) We do not have records of the issuance of a fence permit for your property. If a fence permit was not obtained, this needs to be done. And if a permit was issued, I apologize. It is unusual that this would be lost in both the paper file and the digital file. Our GIS mapping analysis indicates that the existing fence is within a few inches of meeting the required front yard setback as measured from the Mayport Road side property line and within the limits of the minor administrative waiver I have authority to grant. As such your existing fence is in compliance with the current regulations provided that it is maintained in good condition and that the landscaping adjacent to the fence is maintained.
