co nverted t o Mobil. T he rebra nding r equ ires co nverting th e exis tin g BP si gn to a Mobil si g n. T he exi sting
sig n i s considered a l egal no n-conforming sig n. It i s non-conforming becau se it is taller and ha s a l arger
sig n face area than all owed by c urrent code. Sec ti on 17-5 1 (3) (cl) s tates th at non-conform i ng sig ns shall
be m ade conforming w hen "Any c hange, w hich alters the matc l'i alusc d for the d isp l ay area or face area
by 111 o re th an t wen ty-five (25) percent". The propose d convers i o n to the Mobi l sign wo uld const i tute a
greater than 25% change to the displ ay area and require the si gn to m ee t ctll'rent code. The c urrent: sign
code has a m axi mu m he ight or eig ht feet and maximum si g n display area of96 square fee t.
The applica n t is seek in g a wa iver fro m th e req uirem ent to red uce l he si gn t o eig ht f ee l in hei g ht. T hey are
proposing to reduce the existing s ign fi·om 23 feet to 18 feet and th e si gn display area fr o m 126 square
feet to 9 1 square feeL T hi s will bring the d isplay ar ea into comp liance w i th the new co de. H owever, th e
sign w ill still be ten fee t taller than al lowed by code. Accord i ng to Sect io n 17-52, r eq u es t s to wa ive
provisions o f the A tlan tic Beach Si gn Code ca n be made upon app li cation to th e C ity Commission . "The
applicant r eques ting such waiver shall have the burden o f demons tratin g the n eed for th e r equ ested
waiver, and th at th e wa iver is n ot in co nfl ict with th e intent of this Chapter". The applica nt intend s to
