Approval of the minutes of the Board Member Review Committee meeting of October 14, 2015. 2. Interview the new candidates (listed below) for consideration to the Board/Committee(s) indicated. Discuss the current Community Development Board (CDB) members whose terms expire on 12/31/15 and are interested in reappointment and the new applicants previously interviewed (listed below). Jennifer Lada (new applicant) Adjournment MINUTES Board Member Review Committee Meeting October 14, 2015 5:00 p.m. Call to order The meeting was called to order at 5:01 p.m. by Commissioner Jimmy Hill. In attendance were Commissioner Jimmy Hill (Chairman), Members Jerry Johnson, Solomon Brotman, Code Enforcement Board Member Louis Keith and Recording Secretary Dayna Williams. 1. Approval of the minutes of the BMRC meeting of March 18, 2015. Motion: Approve minutes of the Board Member Review Committee meeting of March 18, 2015. Moved by Brotman, seconded by Johnson Motion carried unanimously 2. Interview the new candidates (listed below) for consideration as a new regular member or alternate member of the Code Enforcement Board. New candidates: A. Kirk Hansen B. Barbara Childers C. Lindsay Norman D. Kathryn Humphries E. Don Sasser The Committee interviewed each candidate listed above separately. An overview of the duties and responsibilities of the Code Enforcement Board were explained to each of the applicants. Each candidate explained their personal accomplishments, experience, goals and interests in the community. The Committee offered the opportunity to ask questions and the Committee responded to those questions. 3. Discuss and make recommendation regarding current alternate, Richard Lombardi, who is interested in being appointed as a regular member to a term ending 9/30/18. The Committee discussed the current board members and questioned how unexpired terms impact the process for appointing members and their term limits. It was decided that Commissioner Hill would get with the City Attorney at a later date to discuss that topic. Discussion ensued regarding appointing Richard Lombardi as a regular member. Motion: Recommend appointing Richard Lombardi as a regular member of the Code Enforcement Board (for the unexpired term ending 9/30/2016). Motion by Hill, Seconded by Brotman Motion carried unanimously 4. Discuss and make recommendation regarding Benjamin de Luna, whose term expired on 9/30/2015 and is interested in reappointment to a regular term ending 9/30/18. Motion: Recommend reappointing Benjamin de Luna to serve an additional term as a regular member on the Code Enforcement Board for the term ending 9/30/2018. Moved by Brotman, seconded by Hill Motion carried unanimously 5. Discuss the new candidates (listed above) and make recommendations on filling the remaining vacancies. Page 2 of 2 The Committee discussed the candidates and made the following recommendations: Motion: Recommend appointing Kirk Hansen to serve as a regular member on the Code Enforcement Board for the unexpired term ending 9/30/2017. Moved by Hill, seconded by Brotman Motion carried unanimously Motion: Recommend appointing Lindsay Norman to serve as a regular member on the Code Enforcement Board for the unexpired term ending 9/30/2017 and Don Sasser as a regular member for the term ending 9/30/2018. Moved by Brotman, seconded by Hill Motion carried unanimously Dr. Brotman indicated that Richard Lombardi would be filling the unexpired term ending 9/30/16. He stated he believed that since you can only serve three 3-year terms, this would be an advantage with it not being a full term and would let him serve up to 11 years total. Motion: Barbara Childers and Kathryn Humphries should be asked whether they would consider any other boards and they would both remain in the applicant pool but should attend at least one board meeting in order to determine whether they are positive about serving the board before considering them for appointment. Moved by Hill, seconded by Brotman Motion carried unanimously Motion: The position of alternate for the Code Enforcement Board be held vacant and be reconsidered in the future. Moved by Brotman, seconded by Hill Motion carried unanimously The Committee discussed how they were handling the deferral of the two candidates. Commissioner Hill recommended that the City Clerk send Barbara Childers and Kathryn Humphries a letter explaining that 1) the Committee had concerns, 2) the (regular) positions were filled and 3) they have not been excluded from future positions. Commissioner Hill reiterated his concerns were based on experience and that they have not attended any meetings. He explained he would like for them to go to one of the meetings, see the process and make that commitment. He stated, although it is not a requirement, he believes it can be recommended to them. There was consensus from the Committee to approve the recommendation. 6. Other Business None. I started as a secretary in 1973 and worked my way up the careerladder as a business financial manager in various capacities to the Chief Financial Officer for the Program Executive Office for Ships. I have extensive financial, budgeting, and contracting experience. have aBS degree and a Masters in Public Administration. I servedonmy neighborhood Homeowners Association for several years as both a member and as the Treasurer in the 1990's. I designed both my home in Rockville, MD and our homehere at 1024 OceanBlvd and worked closely withthe Architect, the Contractor,the Engineer,the tradespeople and the COAB permit/approval people. 2 My husbandand I moved to Atlantic Beach in September 2013. Weheard about the area from a friend and were in love with the neighborhood as soon as we saw it—mainly because of the trees and the mix of home stylesand family atmosphere. We purchased our home and had it renovated and added to prior to moving in. We kept the older portion of the home, removed a garage space that had been enclosed, and added space well within the boundaries of ourlot size. I am concerned with the extensive destruction of the older homesbeing razedand replaced with huge homes which is, in my and many of my neighbors'opinions going to ruin the small town feel that drew us to Atlantic Beach. While the new homeowners are well within their rights to build within current codes/zoning regulations, it seems that much of the increased development is being driven business-people versus homeowners. This expericne has given me greater insight into working on a committee for the greater good of the neighborhood. I am currently a home owner in Atlantic Beach. I am interested in perserving the character and beauty of the city. This board is an intergal part of acheiving that goal. Additionally, I am interested in serving the greater good of the city. 2 Code Enforcement Board (Also acts as the Nuisance Control Board) Meets in Commission Chambers, 800 Seminole Road, at 6:00 pm the second Tuesday of January, March, May, July, September and November. The board consists of seven members and one alternate who are appointed by the City Commission and who serve three-year terms. The Code Enforcement Board has the jurisdiction and authority to hear and act on alleged violations of the following: • City of Atlantic Beach Code of Ordinances, • Building codes, as adopted by the City, • Standard Housing Code, as adopted by the City, • State of Florida Health Code, • Florida State Statutes, and • State, county, and local laws and ordinances whose intent is to promote the health, welfare, and safety of the citizens of the City. The Code Enforcement Board has the authority to assign penalties as provided by Fla. Stat., Chapter 162. Community Development Board Meets in Commission Chambers, 800 Seminole Road, at 6:00 pm the third Tuesday of each month. The board consists of seven members who are appointed by the City Commission and who serve two-year terms. Applications for Variances, Uses-by- Exception, and rezonings are considered by the Community Development Board. The board makes final decisions on Variances and forwards recommendations to the City Commission on Uses-by-Exception, rezonings and several other types of applications. The City Commission makes a final decision on these requests. Pension Board of Trustees Meets in City Hall, 800 Seminole Road, quarterly or as scheduled. The City has two pension boards, one for police employees and one for general employees. The boards are responsible for the general administration, management, and oversight of the operation of the retirement system. Each board consists of five members. Cultural Arts and Recreation Advisory Committee Meets in Adele Grage Cultural Center, 716 Ocean Boulevard at 6:00 pm on the fourth Tuesday of each month. This committee consists of nine members who are appointed by the City Commission and who serve 2-year terms. The duties and responsibilities of the committee include: • Develop plans, promote and support programs and projects to bring the benefits of recreation to the citizens of Atlantic Beach, • Recommend a calendar of special events, • Evaluate and advise the City on the effectiveness of programs, • Evaluate and make recommendations on assignments or requests made by the City Commission or City Manager, and • Evaluate and make recommendations to the City commission on requests for City funding for special events, art projects, and recreation programs. Board Member Review Committee Meets in City Hall, 800 Seminole Road, at 5:00 pm usually on a Thursday (when needed). This committee consists of six (6) members. The committee reviews applications and makes recommendations for the appointment and reappointment of members to the city’s Boards and Committees. “CONFLICT OF INTEREST” NOTICE: “Part III of Chapter 112, Fla.Stat., is the Code of Ethics for Public Officers and Employees. This Code defines “conflict” or “conflict of interest” to mean a situation in which regard for a private interest tends to lead to disregard of a public duty or interest. Fla.Stat. §112.312(8). WHEREAS, the City Commission of the City of Atlantic Beach, Florida, desires to amend Chapter 14, Article II, Sections 14-17 and 14-23 of the Atlantic BeachCode of Ordinances in order to allow increased citizen participation on the City's Community Development Board; and WHEREAS, the City Commission of the City of Atlantic Beach, Florida, finds that the adoption of this ordinance is in the best interest of Atlantic Beach, Florida and its citizens. NOW THEREFORE, BE IT ENACTED BY THE CITY COMMISSION ON BEHALF OF THE PEOPLE OF THE CITY OF ATLANTIC BEACH, FLORIDA: SECTION 1. Adoption and Incorporation of Recitals. The City Commission of the City of Atlantic Beach, Florida adopts the recitals outlined above and incorporatesthem herein as a part of this ordinance. SECTION 2. Code Amended. The City Commission of the City of Atlantic Beach, Florida hereby amends the Code of Ordinances of the City of Atlantic Beach, Florida as follows: Sec. 14-17. - Composition; qualifications of members; officers. The community development board shall consist of seven (7) members and two (2) alternatemembers appointedby the city commission, none of whom shall hold any other public office or position in the city, all of whom shall be bonafide residents of the city, and where practical, each shall possess some special skill or knowledge which would assist them in the discharge of their responsibilities under this article. Alternate members shall be allowed to vote and participate in CDB business subject to the requirements of this section and whencalled upon by the Chair to participate in order to ensure a quorum. The community development board shall elect its chairman and vice chairman from among the appointed members. The community development director shall act as secretary to the board underthe direction of the city manager. SECTION 3. Conflict. If any portion of this ordinance is inconflict with any portion of any other ordinance, then the provisions of thisordinance shall govern. SECTION 4. Severability. If any section, sentence, clause or phrase of this ordinance is held to be invalid or unconstitutionalby any court of competent jurisdiction, then said holding shall in no way affect the validity of the remaining portions of this ordinance. SECTION 5. Effective Date. This Ordinanceshall take effectimmediately upon its final passage and adoption. PASSED by the City Commission on first reading this 27 day of April, 2015.
