CONCLUSIONS OF LAW: After considering the merits of the proposal and any written objections from affected persons, the Department finds that, upon compliance with the permit conditions, the activities indicated in the project description of this after-the-fact permit are of such a nature that they will result in no significant adverse impacts to the beach/dune areas or to adjacent properties; that the work is not expected to adversely impact nesting sea turtles, their hatchlings, or their habitat; that the work is expendable in nature and/or is appropriately designed in accordance with Rule 6213-33.005, Florida Administrative Code; and that it is an activity or type of construction which the designee of the Chief of the Bureau of Beaches and Coastal Systems has authority to approve or deny pursuant to Delegation of Authority, DEP Directive 137, effective May 14, 2001. Construction of a retaining wall seaward of the. coastal construction control line without benefit of a permit from the Department constituted a violation of Chapter 161, Florida Statutes. This violation will be addressed by the Department through a separate agency action. Based on the foregoingconsiderations, the designee approves the application, authorizes after-the-fact activities at the location indicated below in strict accordance with the project description,the approved plans (if any), and the General Permit Conditions which are attached and are by this reference incorporated herein, and any additional conditions shown below, pursuant to Subsection 161.053(5), Florida Statutes. Exterior dimensions: A maximum of 4 feet above grade by approximately 45 feet long, including 5 feet in the shore-normal direction at the north end and 40 feet in the shore-parallel direction. 3. Type of foundation: Frangible 8-inch wide reinforced CMU/concrete wall in 5.3-foot segments, with landward tiebacks and concrete deadmen. Other Structures/Activities 1. Seaward, irregularly shaped, open, frangible concrete slab patio with the finish, of approximate dimensions 27 feet in the shore-normal direction by 45 feet in the shore-parallel direction, and with a top of slab elevation of+21.33 feet (NAVD), is to be located a maximum of 33.1 feet seaward of the control line. 2. After-the-fact demolition and removal of existing wood retaining wall and concrete patio. See Special Permit Condition 2. 3. Minimal excavation for the wall (approximately 4.2 cubic yards) is to be placed on site as fill beneath the patio. See Special Permit Condition 3. 4. Fence/handrail along entire length of wall. 5. Native vegetation plantings seaward of waU. See Special Permit Condition 4. SPECIAL PERMIT CONDITIONS: I. This after-the-fact permit is conditional upon the resolution of any related violations .to the satisfaction of the Department no later than sixty (60) days from the date of this permit. Failure to comply will result in automatic revocation of this permit and will require removal of all the structures authorized by this permit within thirty(30)days. 2. All rubble and debris resulting from this demolition and construction,including concrete rubble placed landward of the retaining wall, shall be removed to a location landward of the coastal construction control line. 3. To mitigate adverse project impacts to native dune vegetation, and prior to completion of construction activity authorized by this permit, the permittee shall plant all disturbed areas, and restore the subject property seaward of the dwelling according to the following conditions: 4.1. As determined to be feasible by the staff representative and prior to commencement of construction activities, native vegetation within the construction limits, including existing scrub vegetation and other native trees and shrubs, shall be protected on site or transplanted to disturbed areas seaward of the control line. The permittee shall maintain, irrigate and/or fertilize transplanted or preserved vegetation to ensure a 75 percent survival rate for a minimum of one growing season. 4.2. Any dune area disturbed.during construction shall be re-vegetated with native dune vegetation indigenous to the beach dune plant communities in the area. A mix of a minimum of three native salt-tolerant species shall be planted within any disturbed dune areas. Sod composed of non-native grasses is not authorized seaward of a major structure or decks. Plantings shall not include invasive nuisance plant species included in the Florida Exotic Pest Plant Council' s List of Category I and 11 Invasive Species. (A copy of this list is available on the Internet at www,flepyc.ora.) 4.3. Within 180 days, a minimum 80 percent overall survival rate of the planting units will be established and 80 percent of the planted area covered with the selected species.The permittee shall replant all deficient areas and maintain the plantings until the above success criteria are met and the project is complete. Irrigation systems and other structures placed during plant installation shall be removed only after approval of planting success by the Department and within thirty days from the submittal for final project certification. 5. No other structures,activities,or permanent exterior structural or landscape lighting are authorized. Approved plans are incorporated into this permit by reference.
