Dear Sir,
There is currently a Stop Work Order on the siding portion of your project, issued today,August 28,
2015.
Some background:
- The siding you are installing on your half of your two-unit townhouse building does not match
the other half of the building. This does not conform with City of Atlantic Beach, Section 24-
88(b).
- Variance 15-ZVAR-1035 was granted, relieving you of the requirements of that provision at a
public hearing on July 21,2015. The Variance was officially granted on August 5,2015.
- Section 24-49 allows for an appeal within thirty days of the granting of the variance. An
appeal was presented to the City on August 21,2015.
- A stay of work is required with any appeal and is currently posted.
- The stay of work can be temporarily lifted if the stay would cause imminent peril to life or
property.
At this time,a tropical storm(possible hurricane)is predicted to pass through our area and I consider
that predicted storm to put the uncompleted building in peril. Therefore I am temporarily lifting the
Stop Work Order until the storm passes. I will visit the job site after the storm has passed and re-state
the Stop Work Order.
Please be advised that any siding work done on this project is at the Owner's and Contractor's own
risk.
If the appeal to the Variance is successful, the siding may have to be removed.

Confirming our phone conversation;the side-yard setbacks on this property are 7.6 ft. (north and south sides) This
setback allows the outside edge of the porch canopy to be greater than 3 ft.from the property line and meets local
zoning and the 2010 Florida Building Code-Residential. (This project was permitted under the 2010 FBC-R)
