Per your request received March 4, 2016, 1 am able to grant a "minor dimensional variance"
pursuant to Section 24-48(h) at your property, 1662 Maritime Oak Drive, based on the following
information.
You have requested to build a new single family home on an irregular shaped lot where a small
triangular portion of the front open porch is 14.25 feet from the curved portion of the front
property line and where a small triangular portion of the rear of the house is 9.66 feet from the
angled rear property line. The irregular shape of the lot features a curved front property line and
an angled rear property line. The front yard setback for an open porch is 15 feet and the rear yard
setback is 10 feet within the Atlantic Beach Country Club SPA. A variance is needed to
construct the new single family home as proposed in violation of the required front porch setback
and rear yard setback. This minor dimensional variance qualifies under Section 24-64(d)(5),
"irregular shape of the property warranting special consideration." This variance is transferable
and runs with the title to the property.
