AN ORDINANCE OF THE CITY OF ATLANTIC BEACH,
FLORIDA, AMENDING CHAPTER 2 OF THE CODE OF
ORDINANCES, ADMINISTRATION, ARTICLE II, CITY
COMMISSION, AMENDING THE BOUNDARY OF SEAT 2,
DISTRICT 1308 AND SEAT 3, DISTRICT 1307 OF THE
ClTY COMMISSION, AND ADDING A MAP SHOWING
NEW BOUNDARIES, AND PROVIDING FOR
SEVERABILITY, AND PROVIDING DIRECTION TO
STAFF, AND PROVIDING FOR AN EFFECTIVE DATE

WHEREAS, The C ity of Atlantic Beach has annexed an area call ed the Atlanti c Beach Co untry
C lub from J acksonv ille into its C ity lim its, and now mus t assig n those new residents of voting
age to the Atlanti c Beach vot ing di stricts as establi shed in 20 12, and
WHEREAS, the newly annexed a re a of the Atlantic Beach Coun try C lub is expected to add
a pprox imately 340 n ew r esidents of votin g age when full y developed, a nd
WHEREAS, the di strict with the lowest number of residents of vot ing age according to the las t
cen s us in 20 I 0 was District 1308 and by addi ng 340 residents of voting age to District 1308,
entirely, the District wi ll still comply with the pennissibl e popul ati o n difference when compared
to the o ther tlu·ee districts, a nd
WHEREAS, the boundary of Dis tri c ts 1307 and 13 08 a rc adjacent, making it necessary to
change the descripti on of the bound ary of Di s tri c t 1307 where affected by the new boundary of
Di s trict 130 8, and
WHEREAS, the descriptions of all votjng dis tri c ts should be am e nded to remove th e refer e nces
to the names of th e o ld districts and t o properly lab el and insert the a ttached m aps previously not
included in the code, to s how th e adjusted boundaries, and
NOW THEREFORE, BE IT ENACTED BY THE CITY COMMISSION ON BEHALF OF
THE PEOPLE OF THE C ITY OF ATLANTIC BE ACH, FLORIDA:
SECTION I: Section 2-22 of the Code of Ordinances of t he City of Atlantic Beach, Flo rida, is
hereby a m end e d b y changing the bound aries of vo t ing Di stricts 1308 a nd 1307 and t he
descriptions of each of th e voting districts and inserting the map attach ed hereto as Ex hibit I into
Section 2-22, so that section 2-22 shall read as follows:

Beginning at a point in the City of Atlantic Beach's eastern city limits, being a point of
intersection ofthe Atlantic Ocean and the eastern extension ofthe 16th Street right-of-
way; then running westerly along the 16th Street right-of-way and extension thereof, to
a point of intersection with the Beach Avenue right-of-way; then running northerly
along the Beach Avenue right-of-way to a point of intersection with the 1 i 11 Street
right-of-way; then running westerly along the 1 i 11 Street right-of-way to a point of
intersection with the Seminole Road right-of-way; then running northerly along the
Seminole Road right-of-way, to a point of intersection with the Saturiba Drive right-of-
way; then running westerly along the Saturiba Drive right-of-way to its western

then running southwesterly along the north side of the Selva Marina Unit 5 plat,
to a point of intersection with the southernmost corner of the Sevilla Gardens
condominium property, being also the northern boundary of the Atlantic Beach
Country Club SPA; then running northwesterly along the northern boundary of
the Atlantic Beach Country Club SPA to a point of intersection with the
northeastern corner of the Fairway Villas PUD; then running south along the
western boundary of the Atlantic Beach Country Club SPA to a point of
intersection with the eastern extension of the Dutton Island Road right-of-way;
then running westerly along the Dutton Island Road right-of-way and eastern extension
thereof, to a point of intersection with the Main Street right-of-way; then running
southerly along the Main Street right-of-way to a point of intersection with the Levy
Road right-of-way; then running easterly along the Levy Road right-of-way to point of
intersection with the Mayport Road right-of-way; then running southerly along the

Section 2. SeverabilitJ:. If any section, sentence, clause or phrase of thi s ordinance is
held to be invalid or unconstitutional by any court of competent jurisdiction, then said holding
shall in no way affect the va lidity of the remaining portions of this ordinance.
Section 3. Direction to Staff. Following approval by the City Corrunission of the C ity of
Atlantic Beach, Florida, staff is directed to forward a certified copy of the ordinance to the Duval
County Supervisor of Elections.
Section 4. Effective D at e and Recording. This Ordinance shall take effect immediately
upon its final passage and adoption and shall be recorded in a book kept and maintained by the
