Commissioner Harding gave the Invocation, followed by the Pledge of Allegiance to the Flag.

Mayor Reeves called the meeting to order at 6:30p.m. Acting City Clerk Bailey called the roll and Mayor
Reeves noted that a quorum was present.
1. A. Approve the minutes of the Commission Meeting of April25, 2016.
Mayor Reeves asked if there were any corrections to the above minutes. There were no corrections, so
Mayor Reeves stated the minutes will stand as submitted.
2. Courtesy of the Floor to Visitors
Mayor Reeves opened the Courtesy of the Floor to Visitors. Mayor Reeves explained the process for public
comments. He announced that tonight would be Nancy Bailey's last meeting as she is retiring. He stated she
will be missed.
Bishop Percy Golden, 1700 Francis Ave., welcomed all the new Commissioners and new Mayor and
thanked the City of Atlantic Beach for being supportive over the years for Gospel in the Park. He stated this
is the 121h year of the festival. He invited the Commission to the festival which will be held on May 14, 2016
at Jordan Park.
Elizabeth Neville, 1060 Seminole Road, expressed thanks to the Commission for their service. She
expressed concerns about the sidewalks being kept clear by the homeowners for the children riding their
bikes to school. She also asked for a clearer overhead projector and larger print for the meetings.
Chris Jorgensen, 92 W. 3rd St., expressed concerns about the incident on the beach to all concerned;
thanked Chris Huffman with Public Works for his help resolving the problem at Tideviews Park and thanked
Commissioner Stinson for bringing up the gates at the park as an agenda item. Reported on the Beaches
Watch meeting. He reported on the CRA meeting, stating he thought the presentation was very well done but
he does not see any need for the CRA.
Bob Hines, 880 Beach Avenue, stated the Cloister's south gate is still being used and expressed his
opposition to the gate being used and his concern that no violations are being issued.

Butch Toney, 885 Beach Avenue, addressed the Cloister's south gate issue and his opposition to it.
No one else from the audience spoke so the Mayor closed the Courtesy of the Floor to visitors.
Mayor Reeves stated the Commission takes the comments on the Cloister gate seriously. He stated you
cannot write a ticket for "do not enter". He stated they are moving forward and this will go before the Code
Enforcement Board. Commissioner Stinson stated the Commission has not done anything with this since
before this Commission took office. He stated they inherited it and it is still out there and the citizens don't
see any progress being made toward a resolution. He stated he would feel the same way if he was sitting out
there watching this and feeling like nothing was happening. Commissioner Hill stated there is a process
under way and it will be seen by another segment of our government and if nothing happens in that process,
he believes they will take other action. He stated it is not being ignored, it is just a long and arduous process.
Commissioner Waters stated she agrees it is a long process but she believes there is hope that in the process
someone will back down and this won't end up in court. Mayor Reeves stated some action will be taken at
the next Code Enforcement Meeting in June.
3. Unfinished Business from Previous Meetings
A. Amendment to Declaration of Restrictive Covenants Request from Fleet Landing.
City Attorney Durden explained in detail the Amendment to Declaration of Restrictive Covenants and the
Right ofFirst Refusal.
Motion: Approve the Amendment of Declaration of Restrictive Covenants and the Right of First
Refusal Agreement and authorize the Mayor to sign the documents.

Commissioner Stinson stated his agenda packet did not have the Restrictive Covenants on his iPad and asked
for a copy. Ms. Durden provided him with a copy.
Commissioner Hill expressed concern about the 20th Street gate and asked that they address the use of the
gate. Discussion ensued.
Joshua Ashby, One Fleet Landing Blvd., Chief Executive Officer of Fleet Landing, addressed the 20th
Street gate issue, stating they have no incentive to allow any through traffic through the campus, but they
have many employees who live in Atlantic Beach and they would not want to limit their ability to access the
20th Street gate. He stated they are willing to write in their construction contracts that the 20th Street gate is
not permissible for access for construction vehicles. He answered questions from the Commission.
Further discussion ensued.

City Manager Van Liere explained the Ordinance is to increase the budget for the additional funds needed to
fund the construction project approved at the last meeting.

City Manager explained the ordinance was previously before the Commission when it included only the
amendment for Chapter 20; after that first reading was passed, it was pulled back on second reading at the
Clerk's request to add the same changes for registration of solicitors.

Commissioner Hill asked if this Ordinance erodes the City Clerk's position in any way from what is
considered normal in Florida for cities of our size. City Attorney Durden stated, in her opinion, no it does not
erode the authority at all. Discussion ensued.

8. Miscellaneous Business (Discussion only)
A. Automating the gates to Tideviews and Dutton Island Preserves.
Commissioner Stinson explained he wanted to discuss this because of phone calls from residents being
locked in at Tideviews in the evenings. He stated they could use an automated gate, if it is necessary to lock
the gate, and asked that the staff give an estimate of what it will cost to do that.
City Manager Van Liere asked Chief Deal to explain what their plan was for addressing this problem. Chief
Deal stated they met with Public Works and they will be closing the gate one hour after sunset and the park
ranger will check to make sure there is nobody still there. He stated if there is a car still there he will not
close the exit gate, but will notify the police department and when they are available they will then go again
to check the park to see if anyone is in there and, if so, will find them so they can secure the park. He further
stated Public Works did some research on automated gates and the figure they came up with was $15,000 to
$20,000.

Commissioner Waters asked the City Manager about the City's liability if they don't have a gate. Mr. Van
Liere stated they have a general liability policy for all of the parks for whatever happens. Further discussion
ensued.
It was the consensus of the Commission to have the City Manager do further research for solutions and bring
this item back to the 2nd meeting in June (June 27) for action.
9. City Manager
A. City Manager's Report.
• 90-Day Calendar (May 2016 through July 2016).
Mr. Van Liere reported on upcoming items on the calendar: Gate Appeal Hearing is on May 12; Code
Enforcement Board meeting that will address the Cloister Gate is June 1; Town Hall Meeting is on July 16.
City Manager VanLiere introduced the new Public Works Director, Don Jacobovitz.
It was the consensus of the Commission to accept the 90-day calendar as submitted.
10. Reports and/or requests from City Commissioners and City Attorney
Commissioner Harding
• Apologized and explained why he was not at the Town Hall meeting on Saturday.
• Reported he received an email from Mr. Hoffmann regarding installing an awning at the pier at
Tideviews. Interim Public Works Director Kayle Moore discussed the issues involved with putting a
permanent structure such as that on the pier, stating there are some permitting requirements as the area
is a conservation area. He stated they could possible identify other opportunities to use the awning
but have not had time to do so since receiving the email. Discussion ensued.
Commissioner Waters
• Apologized for missing the last Commission Meeting, stating due to the weather their flight was
delayed.
• Addressed the Town Hall meeting stating she believes the consensus is that everyone wants a safe
route to school for children and there was some consensus that they even want more than one safe
route to school for children. She stated there was a request to workshop the specific details of the path
and suggested they find a date to do that.
Commissioner Hill
• Stated all in attendance at the Town Hall meeting appeared to be in favor of the concept of safe routes
to school, in general, but there were concerns brought up about specifics of the plan on the table. He
stated he also believes they need to schedule a workshop to engage the citizens.
Commissioner Stinson
• Wished Ms. Bailey well and thanked her for the sounding board, advice, guidance and welcoming him
to the Commission. He wished her all the best.
• Welcomed Don Jacobovitz stating he believes he will be an exemplary addition.

• Addressed the families who received phone calls on Saturday about the beach accident and also
expressed concern for the employee who was involved. He stated his thoughts and prayers are with
them all and the City stands ready to help them in any way they can.
Acting City Clerk Baney
• Stated it has been a pleasure working with all of them and wished them and the City the best; she will
miss them.
Mayor Reeves
• Reported on the Florida League of Mayors Conference, which was why he was unable to attend the
Town Hall meeting.
• Remllided the Commission and staff that the FLC dinner/meeting will be held at the Atlantic Beach
Country Club on the May 26.
• Stated the meeting on Thursday will be a tough meeting with a tough decision. He encouraged the
Commission to be there early and suggested they bring treats, since this will be a long marathon.
• Expressed concern about the families of those involved in the accident on Saturday. He stated he has,
personally, reached out to all three parties. He asked the City Manager to make sure wr; have a set
policy that every employee in the City is briefed yearly on pedestrian safety. He stated there was a
resident who assisted in getting the girls from under the truck and he wants to recognize him.
• Welcomed Mr. Jacobovitz on board and thanked him for riding with him today and wished him
nothing but the best.
• Thanked the police officers for their help in everything that has taken place recently.

AGENDA ITEM: Safe Routes to Schools Memorandum of Agreement with JTA

BACKGROUND: JTA, as Administrator of Atlantic Beach's Safe Routes to School
Project for FOOT, has requested the City execute the attached Memorandum of
Agreement (MOA).
In late 2012, the City Commission asked Staff to investigate whether the FOOT
Safe Routes to Schools (SRTS) Grant Program would be a viable means to get
funding for improving bicycle access to Atlantic Beach Elementary School (ABE)
by connecting and upgrading the current multi-purpose (bicycle & pedestrian)
path I sidewalk network on Seminole Road and Sherry Drive.
The proposed project, which consisted of constructing an eight foot multi-purpose
path on Sherry Drive from ABE connecting to the existing multi-purpose path on
Seminole Road at Garden Lane, was presented at an advertised public meeting
at ABE in March, 2013 and received support from attendees, including the
Friends of Atlantic Beach Elementary (FABE).
Staff, with grant writing assistance from Fleet & Associates, and support from the
Duval County School Board, successfully applied for the SRTS grant. Under this
grant, FOOT was responsible for engineering design and construction of the
(bicycle & pedestrian) path, with no requirement for matching funds from the City.
This project was approved by the North Florida Transportation Planning
Organization (TPO) and added to the FOOT 5 Year Funding Plan in 2013, with
construction to begin in FY 2016. Because of funding limitations, the project will
construct the path on Sherry Drive from ABE to Plaza Drive, but only the section
from Plaza Drive to 1?'h Street on Seminole Road.
After being assigned to an engineering firm for preliminary design in 2014, the
project funding source was changed from SRTS to the Transportation
Alternatives program and the project start date was eventually pushed out to
2019 or later. Earlier this fiscal year, the FOOT project funding was changed
back and the schedule returned to near the original timeline, with construction
beginning as early as July 2017. FOOT has assigned JTA as the Local Agency
Project (LAP) Administrator.
This MOA with JTA documents the City's agreement to maintain the
improvements constructed and also to be responsible for additional public
information meetings. The City has requested a more in-depth public involvement
phase for this project, than standard FOOT projects which would include only a

Public Information meeting at the 30% Design stage (to be held at ABE). AB Staff
has requested the designer also make a formal presentation to the City
Commission following this 30% meeting, and then a pre-construction meeting for
the neighborhood and residents after the project has been awarded to a
contractor. Staff has negotiated a fee of $6,136.57 with the Design Engineer
(Element Engineering) to support these additional meetings.
Addenda since first presented to the Commission: Attachment 4 clarifies that
approval of this MOA with JTA will not lock the City into the existing planned
route for the multi-purpose path, but that any alternative chosen must still meet
the requirements of providing a safe route to schools.
BUDGET: The negotiated public involvement support fee will be paid from the PW
Professional Services account (001-5002-541-3100) with no additional funding
required.
FOOT has budgeted $687,000 for design, construction and construction support
efforts.
RECOMMENDATIONS: Approve the Memorandum of Agreement with JTA and
authorize the Mayor to sign the MOA.

FOR THE SHERRY DRIVE SAFETY WALKS SIDEWALK PROJECT

The Memorandum of Agreement (this "Agreement"} is made as of 2016, by and
between the JACKSONVILLE TRANSPORTATION AUTHORITY, a body politic and corporate and an agency
of the State of Florida created pursuant to Part II, Chapter 349, Florida Statutes, whose primary business
address is 121 West Forsyth Street, Suite 200, Jacksonville, FL 32202 (the "JTA"} and the CITY OF
ATLANTIC BEACH, a Florida municipal corporation whose primary business address is
_________________ (the "City"}. The JTA and the City may hereinafter be
referred to singularly as a "Party" or collectively as "Parties."
WITNESSETH
WHEREAS, it is in the interest of the City and JTA to work together to address mobility in the City and to
combine efforts to more cost effectively provide mobility options for the citizens of the City and of
Northeast Florida; and
WHEREAS, JTA is engaged in the business of addressing mobility in Northeast Florida and has delivered
numerous transportation projects in Duval County and presently desires to construct a sidewalk along
Sherry Drive and Seminole Road, from Ahern Street to 17 1h Street, as well as minor drainage and
miscellaneous improvements which may impact landscaping, mailboxes and utilities along Sherry Drive
and Seminole Road within City right-of-way (the Project"}; and
WHEREAS, The City desires to have JTA construct the Project; and
NOW, THEREFORE, in consideration of good and valuable consideration, the receipt and sufficiency of
which are hereby acknowledged, the Parties hereby agree as follows:
1. Recitals. The recitals above are true and correct and incorporated herein by this
reference.
2. Obligations of the Citv. The City agrees to:
a. Lead and direct all public involvement efforts for the Project, including meeting
with the City Commission, and conducting a public meeting to present Project
objectives and address public questions and concerns.
b. Accept ownership and maintenance responsibilities for the Project.
3. Obligation of the JTA. The JTA agrees to:
a. Administer the Project.
b. Keep the City advised of the progress of the Project design and coordinate with
the City all known public concerns with the Project.
4. Miscellaneous.
a. Entire Agreement. This Agreement fully and completely expresses the
agreement of the Parties with respect to the matters contained herein and shall
not be modified or further amended except by written agreement executed by

each of the Parties hereto. Any and all riders and exhibits attached to this
Agreement are made part of this Agreement for all purposes.
b. No Waiver. No provision of this Agreement shall be deemed to have been
waived by JTA or City unless such waiver be in writing signed by the waiving
Party and addressed to the other Party, nor shall any custom or practice which
may grow up between the Parties in the administration of the provisions hereof
be construed to waive or lessen the right of JTA or City to insist upon the
performance by the other Party in strict accordance with the terms hereof.
c. Successors and Assigns. The terms, provisions, covenants, and conditions
contained in this Agreement shall apply to, inure to the benefit of, and be
binding upon the Parties hereto, and upon their respective successors in
interest and legal representatives, except as otherwise herein expressly
provided.

Thank you so such foe your active engagement in this project. This email se rve s as a follow up to our phone
conversation . With regards to changing the path of the project, a change is possible . However, we must be mindful that
this project was put forth by the community and re quired the community's input prior to FOOT accepti ng the
application. With that being said, it needs to be understood that a significant deviation from the community's(the
sc hool included) vision would require the submission of a new project application.
The challenge that Atlantic Beach is experiencing is com mon . Elected officials change, project sponsors change, it's ve ry
common. The City is to be commended for wanting to reengage the community and obtaining their input on the
project. We fully recommend and require th is type of engagement. Idea lly we would like for it to happen prior to the
project being programmed(th at why there is no risk of losing any funding), but certainly before construction starts.
One of the things that concerned me in list ening to the video was the communication about the purpose of the JTA
MOA. I want to clarify that the purpose of the MOA is not to lock in a particular project path, but rather to document
that JTA is del ivering this project on beha l f of the Ci ty/FOOT and that JTA is not responsible for any additional costs
outside of those provided in the grant. The JTA is fronting the full cost of construction and will be reimbursed by FOOT.
That is a huge offer from JTA and a great show of JTA 's commitment to mobility and sup port of the communities In ou r
region. Please note that this is the intent of the MOA. If that is not clear from the current text then we can revise to
make that intent clear.
Wit h regard s to t he possible path that the Commissioner spoke of in the meeting, I think It is great that another path
that se rves t he purpose of the initial application and represents the community's vision is available . If that path proves
to be more fea sib le and fits within the bud get, there is no reason why we should not pursue it. Just bear in mind th at
the purpose of the grant is to provide safe routes to school. The ideal of reviving a pa r k and cleaning up a drug area is
great, but, it does not fit Into the intent of the grant funds. Additionally, please note that grant funds cannot be used t o
repair an ex ist i ng path, but ca n be used to make upgrades. For example, we can use the fund s to make an existing path
ADA comp l iant or widen the path. We cannot use the fund s to reconstruct a path . If we can provide a safe route to
school that also does the aforementioned things that is great.
Thank you so much for spearheading this effort. It is great to see a group of Commissioners committed to public
involvement and ensuring the views of the community are captured . Pl ease let me know how I can help .

At the last City Commission meeting, the City Commission approved
submission of a grant application to the State Division of Cultural Affairs
for renovations to Adele Grage Cultural Center. We were informed by
DCA's Grant Coordinator that the grant application requires submission
of a resolution approved by the City Commission.
In review, the renovations will include upgrading the sound system,
replacing the seating and window treatments, improving the stage,
creating a small storage facility, signage and adding safety lighting in the
park. The total project cost is approximately $150,000. The grant
request is for $75,000 and the City would match with $75,000 in-kind
service, donations and cash.
The Cultural Facilities Program coordinates and guides the State of
Florida's support and funding of renovation, new construction, or
acquisition of cultural facilities. A cultural facility is a building which
shall be used for the programming, production, presentation exhibition
of any of the arts and cultural disciplines. Including music, dance,
theatre, creative writing, literature, architecture, painting, sculpture,
folk arts, photography, crafts, media arts, visual arts, and programs of
museums.
At least 25% ($35,000 and up to $75,000) of the required match must
be cash-an-hand, dedicated to the project and made available within 90
days of state grant funding notification. ABET has agreed to assist with
fund raising.

Ordinance 45-16-22 had initial and second readings at the March 14th and March 28th meetings,
respectively. At the request of the City Manger, this agenda item was deferred in order to be revised
to include Chapter 18 Solicitations.
In an effort to streamline operations of the City to continually do more with fewer resources, I am
proposing a shift in responsibilities of the daily duties of managing Solicitations and Business Tax
Receipts from the City Clerk to the City Manager, more specifically to the Finance Department. In
my opinion, the job duties are better suited for the Finance Department than for the Clerk's Office
due to the nature of the duties. Reasons for this change are highlighted below:
1. One of the most significant reasons to implement a change is that although the code indicates
that the Clerk's Office is responsible, a significant portion of the work is not supervised by the
Clerk. The zoning approvals, inspections and the collection of the fees are all performed by other
departments. When problems arise, the Clerk has no authority over the persons outside her
department performing the tasks. There should be one person responsible for the total process to

insure that the treatment of customers is uniform and consistent, the fees are applied correctly and
the inspections are performed timely.
2. According to the Clerk, the Clerk's Office has been experiencing great difficulty performing
this function at a front counter, taking up much needed time that should be devoted to records
management. The Clerk has repeatedly brought it to my attention that her Records Clerk has
difficulty working on records with the interruptions of the front counter. Moving the Solicitation
and Business Tax Receipt functions across the hall should alleviate some of this pressure. The
Record's Clerk would be better utilized assisting the City Clerk with public records requests and
processing records that need to be scanned and indexed for future reference.
3. The Finance Department already processes tax receipt payments, the Building and Planning
Department performs a zoning review and the Building Official coordinates any inspections that
need to be done. The Finance Department has front counter support and is capable of performing the
remaining required procedures of taking the applications and verifying once trained.
4. The software that the Clerk's Office has been using has proven to be troublesome and time
consuming. The software will be upgraded in the near future and will require many hours of
training. By transferring these duties now, the Finance Department will have time to train and
migrate to the new software and unburden the Clerk's Office with this responsibility. Finance
personnel have more resources to go through the conversion and get the programs running smoothly.
They will have the support of the Finance Director and two Accountants and a Billing Specialist.
Having people trained and cross trained should make the process work more efficiently. This will
also limit the need for the Clerk's Office to spend resources on the City's integrated software except
for requisition input.
5. When there is a critical function in a small department and only the person assigned the task
knows how to perform the task or has time to perform the tasks and that person leaves employment,
it puts the City in a difficult position to recover, especially when the process is complicated and
involves specific software. These types of duties would be better off with a pool of employees that
are familiar with the program.
6. This code revision also removes language that requires the City Clerk to cut off water
services to those businesses that do not pay by January 31st. The City Clerk has never enforced this
section of the code. The business may be closed for non-payment, but utilities may need to remain
on if paid for.
7. This revision of the code also clarifies the dates for half-year tax receipts and removes the
provision that asks for hardship consideration before a partial year tax receipt would be given. This
is not a necessary provision when partial year receipts are allowed. Declaring a hardship is very
subjective and difficult to apply.
For these reasons, the transfer of the responsibility of managing Solicitations and Business Tax
Receipts from the City Clerk to the City Manager or his designee by amending Section 18 of
Chapter 18 and Section 20 of Chapter 20, Article III, of The Atlantic Beach Code of Ordinances
would be in the best interest of the City.

The City of Atlantic Beach has two treated wastewater effluent force mains I outfalls (12" and
24") that discharge to the St Johns River at Sherman's Point. The 12" diameter outfall is owned
and maintained by COAB and the 24" outfall is owned jointly with City of Neptune Beach and
City of Jacksonville Beach (Joint Beach Combined Outfall).
An inspection and study completed in December 2013 determined that the outfall pipe and pipe
restraints as well as some of the wooden cross bracing and blocking would need to be replaced
due to corrosion from the salt water environment. In order to reduce ongoing maintenance costs
and extend the service life of the new outfall, the Cities chose to move forward on design and
construction of a new buried outfall, with COAB to provide bid services and construction
administrative services (with limited assistance from a consultant).
Two bids for the Combined Beaches Outfall Repairs were received on March 30, 2016 as
follows:

Both bids received exceed funds available for the project. This is a cost-shared project with the
three beach communities: Atlantic Beach (45.0%), Neptune Beach (13.7%) and Jacksonville
Beach (41.3%). Discussions were held with Neptune Beach and Jacksonville Beach staff to
determine whether additional proportionate funding is available, in order to proceed with
awarding the project this fiscal year. We have received a favorable response from both cities.
BUDGET:
Total original budgeted amount for the project in account 410-5506-535-6300 PU1504 is
$320,000.00. Additional funds required of the three beach cities based on the low bid of
$532,763.52 is revised as follows:

The 90-day calendar is included on the agenda for the purpose of setting
meeting dates, determining the location, time and whether or not to
videotape special meetings and workshops if the Commission desires.
The rolling 90-day calendar will be revised after receiving input from City
staff and the Commission and will be included in each agenda for
consideration.
Special notes:
o The next quarterly Town Hall Meeting is tentatively scheduled for
Saturday, July 161h at 10 am in the Commission Chamber.
