Dear Jim:
You will recall that the above property is one that the City Commission authorized me to proceed
with foreclosing a CEB lien. The assessed value of the property was about $160,000.00 and there
were over$250,000.00 in mortgages and other liens which had priority over the City's lien.
A short sale was in the process when a representative of the property owner appeared before the
CEB in approximately March, 2012, and asked that the City's lien of approximately $25,000.00 be
reduced to $15,000.00. The CEB reduced the lien to $15,000.00 provided that certain information
and documents would be provided to me in connection with the sale of the property. The
documents were recently provided to me and I forwarded them to Mike Griffin for his review.
Mike agrees with me that all conditions set forth by the CEB for reducing the lien to $15,000.00
were met, and therefore the title company and closing agent were notified that the City would accept
$15,000.00 to release its CEB lien.
Donna Bartle informed me last Friday that she received the check from the title company, she
reviewed with me the Release of Lien that she was going to have you sign, which I understand you
did sign, and this matter is now concluded. I will be closing my file and indicating on the next City
Attorney Report that the$15,000.00 was received and the matter is concluded.
