THIS CAUSE came for public hearing before the Code Enforcement Board on November
9, 2016, and the Board having heard testimony under oath, received evidence, and heard
arguments respective to all appropriate matters, and thereupon issues the Findings of Fact,
Conclusions of Law and Order as follows:
FINDINGS OF FACT
1) That the Respondent owns the property located at 1350 TULIP ST, Atlantic Beach,
Florida.
2) That notice was sent by certified mail and that Respondent was present at the
hearing.
3) That notification of the violations of the City of Atlantic Beach, were made and
served on the Respondent as evidenced in this hearing.

The aforementioned property shall be corrected by removing all discarded lumber, trash,debris,
building materials from the yard.
CONCLUSIONS OF LAW
THAT the Respondent EVOENY CHERNAYAK is not in compliance and has failed to correct
such violation as of this hearing date.
ORDER
Based upon the foregoing Findings of Fact and Conclusions of Law and pursuant to the authority
granted in Chapter 162, Florida Statutes, and the Code of Ordinances of the City of Atlantic
Beach,Florida it is Ordered:
THAT the Respondent is found in violation for non-compliance and must obtain
compliance on or before November 21, 2016. Failure to comply will result in fines of$100.00
for the first day and $100.00 for every day thereafter while the violation continues to exist. In
addition, any fine shall also include the administrative costs to the City incurred in prosecuting
this case.
THAT the Respondent is responsible for contacting the City of Atlantic Beach Code
Enforcement Officer and obtaining an inspection of compliance.
THAT failure to pay all accumulated fines will result in a lien being placed against the
property at 1350 TULIP ST for the total assessment plus costs incurred for the filing of the lien.
All Gen amounts are to be made payable at an interest rate of ten (10) percent per annum from
date of certification until paid.

The Code Enforcement Board of the City of Atlantic Beach was created pursuant to
Florida Statutes and exists for the purpose of facilitating the enforcement of the Code of
Ordinances. It is comprised of seven citizens of Atlantic Beach who meet regularly to hear
allegations of code violations.
You are hereby notified and ordered to appear at the next public hearing of the Code
Enforcement Board on Wednesday,November 9,2016, at 6:00 pm at Atlantic Beach City Hall,
Commission Chamber, 800 Seminole Road, to answer and be heard to the following alleged
violations on the property known as Sec H Atlantic Beach S 124FT of Blks 217, 218,
RE#171034-0000.
International Property Maintenance Code/City Code of Ordinances
SEC. 12-1 (b) It shall hereby declared a nuisance,the enumerations of which are merely
indications of the nature and type of acts,occurrences and conditions, and shall not be deemed to
be exclusive: (3) For any person to allow, suffer or permit any lot,premises or place of any kind
whatsoever to become neglected so as to become a detriment to public health by the depositing
filth or rubbish of any kind.
Sec. 24-173. Neighborhood preservation and property maintenance standards. (b) Appropriate
maintenance and upkeep. All areas of a lot and structures that are visible from the street or a
neighboring property shall be maintained in an acceptable manner,which shall be defined by the
following characteristics: 1. Lots are maintained free from litter,trash,debris,discarded
belongings,automotive parts, old tires,construction materials, and broken and abandoned items.
The Code Enforcement Board may levy fines up to $250.00 per day for the first violation
and $500.00 per day for a repeat violation. If the violation is corrected and then recurs or if the
violation is not corrected by the time specified for correction by the Code Enforcement Officer,
the case could be presented to the Code Enforcement Board even if the violation has been
corrected prior to the Board hearing. Upon completing the corrective action required, it is your
responsibility to contact Atlantic Beach Code Enforcement and arrange for an inspection to
verify compliance at(904)247-5855.
You have the right to obtain an attorney at your own expense and to present witnesses in
your behalf. If you desire to have witnesses subpoenaed or if you have questions regarding the
procedure,please contact Dayna Williams, Secretary of the Code Enforcement Board within five
days of the receipt of this notice at (904) 247-5810. Please note the presence of a court reporter

Please be advised, Atlantic Beach Code Enforcement has found your property referenced above
to be in violation of the City of Atlantic Beach, Code of Ordinances, to wit:
VIOLATIONS
IPMC Sec. 302.7 Accessory structures. All accessory structures, including detached garages,
fences and walls, shall be maintained structurally sound and in good repair. (shed door is open
and unsecured)
Section 109.2 Temporary Safeguards. Notwithstanding other provisions of this code, whenever,
in the opinion of the code official, there is imminent danger due to an unsafe condition, including
the boarding up of openings, to render such structure temporarily safe whether of not the legal
procedures herein described has been instituted; and shall cause such other action to he taken as
the code official deems necessary to meet such emergency. (addition to north side of property
is not structurally sound)
Section 108.1.5 5. 'Phe building or structure or part of the building or structure, because of
dilapidation, deterioration,decay, faulty construction,the removal or movement of some portion
of the ground necessary for the support, or for any other reason, is likely to partially or
completely collapse, or some portion of the foundation or underpinning of the building or
structure is likely to fail or give way.(unsafe addition inadequate support,no permit)
IPMC Section(A) 108.2.1 Authority to disconnect service utilities. The code official shall have
the authority to authorize disconnection of utility service to the building, structure or system
regulated by this code and the referenced codes and standards set forth in Section 102.7 in case
of emergency where necessary to eliminate an immediate hazard to lite or property or when such
utility connection has been made without approval. The code official shall notify the servicing
utility and, whenever possible, the owner and occupant of the building, structure of the decision
to disconnect prior to taking such action. If not notified prior to disconnection the owner or
occupant of the building structure of service system shall be notified in writing as soon as
practical thereafter. (Meter removed due to use of extension cord attached to adjacent
residence)
Sec. 605.4 Wiring. Flexible cords shall not be used for permanent wiring, or for running through
doors,windows, or cabinets, or concealed within walls, floors, or ceiling.

deemed to be exclusive: (11) For any person or business to allow vegetation other than
cultivated plants, shrubs or trees to exceed a height of more than twelve(12) inches on any
developed lot, or within twenty (20) feet of any occupied residential property, business property
or city right of way. (property is overgrown, discarded furniture pieces stored in front yard,
discarded lumber, discarded windows, mise. building materials,junk, trash and debris)

IPMC Sec. 302.5 Rodent harborage. All structures and exterior property shall be kept free from
rodent harborage and infestation. Where rodents are found, they shall he promptly exterminated
by approved processes which will not be injurious to human health. After pest elimination,
proper precautions shall be taken to eliminate rodent harborage and prevent re-infestation.
IPMC Sec.304.10 Stairways, decks, porches and balconies. Every exterior stairway,deck,porch
and balcony,and all appurtenances attached thereto, shall he maintained structurally sound, in
good repair, with proper anchorage and capable of supporting the imposed loads. (illegal

IPMC Sec. 304.4 Structural members. All structural members shall be maintained free from
deterioration, and shall he capable of safely supporting the imposed dead and live loads. (illegal

FBC Section 105 Permit 105.1 Required. Any owner or authorized agent who intends to
construct,enlarge,alter, repair, remove, demolish,or change the occupancy of a building or
structure, or to erect, install,enlarge, alter, repair, remove,convert or replace any required
impact resistant coverings,electrical, gas, mechanical or plumbing system, the installation of
which is regulated by this code, or to cause any such work to be done, shall first make
