THIS CAUSE came for public hearing before the Code Enforcement Board on August It,2009
and the Board having heard testimony under oath,received evidence,and heard arguments respective to all
appropriate matters,and thereupon issues the Findings of Fact,Conclusions of Law and Order as follows:
FINDINGS OF FACT
1. That Keith E.Maddox is the owner of the property located at 348 T"St.,Atlantic Beach,
Florida.
2. That Keith E.Maddox was notified and that Respondent was not present at the hearing.
3. That notification of the violations of Chapter 24,See 24-163(b)were made and served on
the resident as evidenced in this hearing.
CONCLUSIONS OF LAW
THAT Keith E.Maddox is now in compliance of violations as of this hearing.
ORDER
Based upon the foregoing Findings of Fact and Conclusions of Law and pursuant to the
authority granted in Chapter 162,Florida Statutes,and the Code of Ordinances of the City of
Atlantic Beach,Florida it is Ordered:
THAT the Respondent be found guilty as a first time offender,and must remain in
compliance upon receipt of this notice. Respondent will not be fined per violation or
assessed Administrative fees of violation of Chapter 24,Sec 24-163(b)unless violation is
repeated.
Any future violations could result in liens or fines being placed against the property
located at 348 T"Street for the total assessment of$500 per violation plus administrative fees
and cost Incurred for filing the lien.
This Order becomes self-executing upon an Affidavit of Non-Compliance being filed
with the City Clerk's Office and a hearing shall not be necessary.

7. Brief description:
Mr. Maddox and 1 spoke on July 18"' after he received notification, said he would try to work out
something regarding his recreational boat. Mr. Maddox's property does not have sufficient room to
properly store his boat.
8. The latest inspection was made August 11,2009 as a result of following up on the original complaint(s).

10. In order to achieve compliance, it is necessary to correct all of the violations and maintain the
property:
By finding another location to store his boat.
11. 1 do X do not have photographs of the property and violations as they existed on the
property. They represent a fair and accurate representation of the property at the time they were taken.
12. 1 would estimate that 30 day(s)would be sufficient time to correct the violation.
13. Further Comments and Recommendations:
That as a first time offender, Mr. Maddox be found guilty and be given 30 days to bring his
property into compliance and that per Florida Statute 162.09 (2) (a) be assessed $308.52 in
Administrative Fees. That the Administrative fees be deferred pending satisfactory
compliance by the imposed date and that he be fined $50.00 a day for every day beyond the
imposed date.
That failing to pay any fines or assessments within 30 days,that any fees or fines be
placed as a lien against his property at 348 7'"St for all assessments plus the costs
incurred in filing the lien. All lien amounts are to be made payable with an interest at a rate
of ten (10) percent per annum.

Sec 24-63(b)(2). That while conducting a routine drive though of your neighborhood,the Code
Enforcement Officer observed that you were in violation of the following City Coles:
Chapter 24,Sec 24-163(b)(2):Recreational boat parked/stored within the required 15-foot
setback.
You are hereby granted 30 days from receipt of this notification to bring your property into compliance.
Yom recreational boat is in the set back and there is not sufficient room to store the boat properly and
must be removed from the property.
Furthermore I would like to remind you of your responsibilities as a homeowner and that continued
