Dear Mr. Kritsky:
Please be advised, Atlantic Beach Code Enforcement has found the property referenced above to
be in violation of International Property Maintenance Code as adopted by the City of Atlantic
Beach Code of Ordinances to wit:
VIOLATION
Chapter 3, Swimming Pools,Spas and Hot Tubs, Section 303.2 Enclosures—"Private
swimming pools, hot tubs and spas containing water more than 23 inches in depth shall be
completely surrounded by a fence or barrier at least 48 inches in height above the finished
ground level measured on the side of the barrier away from the pool. Gates and doors in such
barriers shall be self-closing and self latching. Where the self-latching device is less than 54
inches above the bottom of the gate,the release mechanism shall be located on the pool side of
the gate. Self-closing and self-latching gates shall be maintained such that the gate will
positively close and latch when released from an open position of 6 inches from the gatepost. No
existing pool enclosure shall be removed, replaced or changed that reduces it's effectiveness as a
safety barrier".
This letter requests that the noted violation be corrected by compliance with safety barrier
(fencing) requirements and call to schedule and receive an approved inspection with these
requirements within five(5) days of the receipt of this notice.

A re-inspection will be done on or after March 31,2011. To avoid having this case be referred
to the Code Enforcement Board,all listed violation(s)on this notice must be in compliance on or
before the date established by Atlantic Beach Code Enforcement. The Board may impose fines
up to two hundred fifty($250.00)per day for continuing violations. Upon completing the
corrective action(s)required,it is your responsibility to contact Atlantic Beach Code
Enforcement and arrange for an inspection to verify compliance.
