I/we do not have the authority to certify that the potable water well and sewer septic system are properly installed and appropriate to serve the home. The Building Department should have a permit for the well (Sec.22-40)and the COJ Health Department(EQD)should have permitted and inspected the septic system. It looks like the Building Department should also have received a bacteriological test report(Bacti)for the potable well per Sec.22-41, If you have a copy of the Bacti report,we can look at it and confirm that is meets safe drinking water requirements. Yamnon ("Owner')for a waiver from the Land Development Regulations to allow a finished floor elevation of six feet,nine inches,in lieu of the minimum seven feet,six inches as required by City Code Section 24-251(c), at 1201 Gladiola Street, with the legal description of Lot 6, Block 211, Section "H", Atlantic Beach, according to plat thereof recorded in Plat Book 18,page 34,of the current public records of Duval County, Florida(the"Property"). Having duly considered the application for waiver, supporting documents and comments at the public hearing on November 14,2016,the City Commission of the City of Atlantic Beach hereby, FINDS AND DETERMINES: 1. The single family residential structure("Structure")constructed on the Property has a finished floor elevation of six feet, nine inches (6'9'), North American Vertical Datum of 1988 ("NAVD, 1988");and 2. RECITALS WHEREAS, Yaranon is the fee simple owner of that certain parcel of land located at 1201 Gladiola Street,within the City of Atlantic Beach,Florida,more particularly described as: Lot 6, Block 211, Section "H", Atlantic Beach, according to plat thereof recorded in Plat Book 18,page 34,of the current public records of Duval County,Florida(the"Propert/, ');and WHEREAS, the single family residential structure (`Structure") constructed on the Property has a finished floor elevation of six feet, nine inches (6'9"), North American Vertical Datum of 1988("NAVD, 1988"); and WHEREAS, Section 24-251 of the Code of Ordinances of the City of Atlantic Beach, Florida, requires the finished floor elevation of the Structure to be seven feet, six inches (7'6") NAVD, 1988; and WHEREAS, the current minimum finished floor elevation under Federal Emergency Management Act("FEMA")requirements for the Property is five feet(5')NAVD, 1988;and WHEREAS, the existing finished floor elevation of the Structure is above the minimum NAVD, 1988 finished floor elevation mandated by FEMA requirements; and WHEREAS, Yaranon has provided evidence to the City that he has obtained flood insurance coverage for Structure;and WHEREAS,in response to Yaranon's application to waive the requirements of Section 24- 251 of its Code and to allow a finished floor elevation of six feet,nine inches(6'9')NAVD, 1988, the City has requested that Yaranon provide this Agreement to induce the City to approve the waiver;and WHEREAS, Yaranon has voluntarily agreed to provide this Agreement;and W WHEREAS, on the 14 day of November, 2016, the City did conditionally approve Yaranon's waiver request,provided Yaranon executes this Agreement,joined in and consented to by Yaranon's lender,and records it in the current public records of Duval County,Florida. NOW, THEREFORE, in consideration of the foregoing recitals, ten dollars ($10.00) and other good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged, Yaranon agrees as follows: I_ The recitals set forth above are true and correct,form an integral part of this Release Agreement, and are incorporated herein by reference. 2. Yaranon does hereby release and forever discharge, and covenants not to sue, the City of Atlantic Beach, Florida, from any and all claims, injuries, demands, costs, penalties, attorneys' fees, costs of litigation and causes of action of any kind whatsoever, now or hereafter in existence,known or unknown,which Yaranon may have against the City and which are related to events, omissions or circumstances arising from or related to the waiver approved by the City for the property, the finished floor elevation of the Structure or such other matters addressed in this Agreement. ro,x u: 2 3. This Agreement shall be governed and construed in accordance with the laws of the State of Florida. 4. Yaranon hereby submits to thejurisdiction of Duval County,Florida to enforce the terms of this Agreement. 5. Yaranon affirmatively represents that he has had the opportunity to be represented by independent counsel of his own choosing throughout all negotiations which have preceded the execution of this Agreement and Yaranon acknowledges that he is satisfied with the representation he has received. 6. Yaranon represents and warrants (a) that he has have availed himself of the opportunity to secure independent legal advice concerning this Agreement and the terms contained herein; (b) that his counsel has advised him of the legal consequences of the terms contained herein,and of the alternatives and options hereto, the existence of which is hereby acknowledged; and(c) that this Agreement is given voluntarily and without duress or coercion. 7. In any suit or action to enforce or arising out of this Agreement or any of the terms and provisions herein contained,the prevailing party shall be entitled to recover as part of its costs, its reasonable attorneys' fees, including fees for paralegals, all collection costs and any costs, expenses and fees for any administrative proceeding or appeal. 8. This Agreement is the result of the joint efforts and negotiations of the City and Yamnon, with each being represented by legal counsel of its own choice,and neither Yaranon nor the City are the author or drafter of the provisions hereof. Yaranon agrees that the rule of judicial interpretation to the effect that any ambiguity or uncertainty contained in an agreement is to be construed against the party who drafted the agreement shall not be applied in the event of any disagreement or dispute arising out of this Agreement. ouux 3 9. This Agreement is binding upon Yaranon,his heirs,agents,successors,assigns and all other legal representatives of Yaranon. 10. The invalidity of one of the covenants,agreements,conditions,or provisions of this Agreement or any portion thereof, shall not affect the remaining portions hereof and this Agreement shall be construed as if such covenant,agreement,condition,or provision had not been included herein.
