Please be advised,Atlantic Beach Code Enforcement has found your property referenced above
to be in violation of the City of Atlantic Beach,Code of Ordinances,to wit:
VIOLATION
Section 109.2 Temporary Safeguards. Notwithstanding other provisions of this code,whenever,
in the opinion of the code official,there is imminent danger due to an unsafe condition, including
the boarding up of openings,to render such structure temporarily safe whether of not the legal
procedures herein described has been instituted;and shall cause such other action to be taken as
the code official deems necessary to meet such emergency.(House at open to vagrant
occupancy)
IPMC(A) 108.2 Closing of vacant structures. If the structure is vacant and unfit for human
habitation and occupancy,and is not in danger of structural collapse,the code official is
authorized to post a placard of condemnation on the premises and order the structure closed up
so as not to be an attractive nuisance. Upon failure of the owner or owner's authorized agent to
close up the premises within the time specified in the order,the code official shall cause the
premises to be closed and secured through any available public agency or by contract or
arrangement by private persons and the cost thereof shall be charged against the real estate upon
which the structure is located and shall be a lien upon such real estate and shall be collected by
any other legal resource. (Secure all structures and maintain secured)
Sec. 24-157(e) Maintenance of fences. Fences that have been allowed to deteriorate to an
excessive degree have a negative impact on property values and the quality of neighborhoods.
Fences that are in a state of neglect,damage or disrepair,shall be repaired,replaced or removed.
Unacceptable fences are identified as those containing any of the following characteristics that
can be easily observed from the street or by a neighboring property. i. Components of the Fence
are broken,bent,visibly rusted or corroded. ii. Portions of the fence are no longer connected to
the support posts and rails.iii. Any components are rotten,broken or missing. iv. Weeds are
overtaking the fence.(ddapidated,collapsed,collapsing fencing)
Sec. 12-1 Nuisances(b) It is hereby declared to be a nuisance,the enumerations of which are
merely indications of the nature of the type of acts,occurrences and conditions,and shall not be
deemed to be exclusive: (I1) For any person or business to allow vegetation other than
cultivated plants, shrubs or trees to exceed a height of more than twelve(12)inches on any
developed lot,or within twenty (20)feet of any occupied residential property,business property
or city right of way.(property is overgrown(
See. 24-173. Neighborhood preservation and property maintenance standards. (b) Appropriate
maintenance and upkeep. All areas of a lot and structures that are visible from the street or a
neighboring property shall be maintained in an acceptable manner,which shall be defined by the
following characteristics: 1. Lots are maintained free from litter,trash,debris,discarded
belongings, automotive parts,old tires, construction materials,and broken and abandoned
items.(buckets, misc.trash junk and debris scatter throughout both properties)
This letter requests that the noted violations be corrected by securing and maintaining all
structures secure at all times,remove old dilapidated collapsed/collapsing fencing and clean
and remove all items including trash, bucket,etc. stored in yard within five(5)days of the
receipt of this notice.
To avoid having this case be referred to the Code Enforcement Board,all listed violations on this
notice must be in compliance on or before the date established by Atlantic Beach Code
Enforcement. The Board may impose fines up to two hundred fifty($250.00)per day for
continuing violations. Upon completing the corrective action required,it is your responsibility to
contact Atlantic Beach Code Enforcement and arrange for an inspection to verify compliance.
