Dear Sir,
Please consider this as a courtesy notice relative to the Commercial Corridor Development Standards
Code that was adopted by the City of Atlantic Beach on January 17, 2003.
The standards were adopted to enhance the aesthetic and physical appearance of Atlantic Blvd and
Mayport Rd. These are the gateways to our community and are the first and last images that are seen
and often remembered. By enacting and enforcing these standards, the City of Atlantic Beach seeks to
enhance and retain property values, to promote development of degraded areas, and to create a safe and
appealing environment for all.
Several requirements of the Commercial Corridor Development Standards Code affected pre-existing
accessory structures such as fencing and signage. These requirements were placed in moratorium for
several years to give business owners time to come into compliance. Since that time, the moratoriums
have expired, and the City started to notify all affected parties.
It was recently brought to the City Commission's attention that several residential properties were within
the Commercial Corridor and had been inadvertently excluded. On January 12, 2009 the City
Commission determined that the Commercial Corridor Development Standards were meant to be all
inclusive and should include those residential properties. Based on that decision, all chain link fencing
within 20 feet of the Mayport Rd Right of Way located at 90 Forrestal Circle South will have to be
removed, and any chain link fencing within 100 ft of the Mayport Rd Right of Way must be substantially
hidden from view.
The City's Code Enforcement Officer will be contacting you in the near future to ascertain what progress
you've made towards the removal of the aforementioned fencing. You are not required to obtain a permit
to remove any fencing; however you will be required to obtain a fence permit prior to erecting any new
fencing.
I've enclosed is a copy of the Commercial Corridor Development Standards Code for your review, as well
as an application to request a waiver from these regulations. For additional information or questions

Dear Sir,
Consider this an Official Notification of Violation, that on January 24, 2009 you received a
courtesy notice as a reminder that the Commercial Corridor Development Standards Code is
currently in effect. All chain link, barbed wire, razor or concertina wire fencing located within any
required front yard and adjoining street of a commercial property located along the Mayport Rd
corridor must be removed.
To date, we are unaware of any progress you may have made toward the elimination of the
non-conforming fencing on your property at 90 Forrestal Circle S, and while it remains in place
you are in violation of City Code, Chapter 24, Sec 24-171. In an effort to eliminate any undue
hardship I am granting you ninety (90) days from receipt of this notification to bring your
property into compliance. You can comply by removing all chain-link fencing within 20 feet of
the Mayport Rd Right of Way and substantially hide from view any chain link fencing within 100
feet of the corner of Mayport Rd and Forrestal Circle.
Knowing that the removal of the chain link fencing may create security concerns, you do have
the option of replacing it with another type of fencing. However, the replacement or installation
of any new fence will require a building permit from the Atlantic Beach Building Department.
Furthermore, you are reminded of your responsibilities as a property owner to maintain your
property in good order, and that violations of City Code can result in fines of up to $500.00 per
day, per violation from the Code Enforcement Board

Regulations at a public hearing by the City Commission of the City of Atlantic Beach.
• Specifically waived are the provisions of Section 24-171 (f), the Commercial Corridor
Standards, prohibiting the use of chain-link fences within the Commercial Corridor, upon
finding by the City Commission that it is not the intent of the Commercial Corridor
Development Standards to apply to properties in residential use, and the subject property is
within a residential subdivision and has been in residential use since development;
and subject to the following condition:
• This waiver shall not exempt the property or the property owner from any other provision of
the Land Development Regulations, as may be amended, regulating the condition of fences
which are in a state of disrepair, dilapidated, in poor condition, or a safety hazard to clear
vehicular sight distance.
