THIS CAUSE came for public hearing before the Code Enforcement Board on March 9,2010 and
the Board having heard testimony under oath,received evidence,and heard arguments respective to all
appropriate matters,and thereupon issues the Findings of Fact,Conclusions of Law and Order as follows:
FINDINGS OF FACT
1. That the Respondent Sally Lopez owns the property located at 741 Cavalla Road,Atlantic
Beach,Florida.
2. That notice was sent by certified mail and that Respondent was not present at the hearing,but
her relative(son)was at the hearing.
3. That notification of the violations of the International Property Maintenance Code,Chapter
3,(Sec 307.1)Rubbish,were made and served on the business as evidenced in this hearing.
4. Rubbish or Garbage.
CONCLUSIONS OF LAW
THAT Ms:Sally Lopez is not in compliance and has failed to correct such violation as of
this hearing.
ORDER
Based upon the foregoing Findings of Fact and Conclusions of Law and pursuant to the
authority granted in Chapter 162,Florida Statutes,and the Code of Ordinances of the City of
Atlantic Beach,Florida it is Ordered:
THAT the Respondent be found in violation for non-compliance,and must come into
compliance by 12:00 pm,March 24,2010. Failure to comply will result in Administrative
fees and fines of $250.00 per day for every day after until compliance is met.
THAT failure to pay all accumulated fines will result in a lien being placed against the
property at 741 Cavalla Road for the total assessment plus costs incurred for the filing of the
lien. All lien amounts are to be made payable at an interest rate of ten(10)percent per annum
from date of certification until paid.
This Order becomes self-executing upon an Affidavit of Non-Compliance being filed
with the City Clerk's Office and a hearing shall not be necessary.

The Code Enforcement Board of the City of Atlantic Beach was created pursuant to
Florida Statutes and exists for the purpose of facilitating the enforcement of the Code of
Ordinances. It is comprised of seven citizens, residents of Atlantic Beach, who meet regularly to
hear allegations of code violations.
You are hereby notified and ordered to appear at the next public hearing of the Code
Enforcement Board on Tuesday, the 9th day of March, 2010, AT 7:00 P. M. at Atlantic Beach
City Hall, 800 Seminole Road, to answer and be heard to the alleged violations of the following
Section(s) of the International Property Maintenance Code: Chapter 3, Section 307.1:
Accumulation of Rubbish or Garbage at property known as: 741 Cavalla Road, Atlantic
Beach, FL,31-001-38-2S-29E,RE# 171344-0000.
The Code Enforcement Board may levy fines up to $250.00 per day for the first offense
and $500.00 for the second offense against the property, if a violation is found to exist beyond
the date set by the Board for compliance. If the violation is corrected and then recurs or if the
violation is not corrected by the time specified for correction by the Code Inspector, the case
could be presented to the enforcement board even if the violation has been corrected prior to the
board hearing.
You have the right to obtain an attorney at your own expense and to present witnesses in
your behalf. If you desire to have witnesses subpoenaed or if you have questions regarding the

Dear Ms.Lopez;
Please be advised,Atlantic Beach Code Enforcement has found the property at the above referenced
address to be in violation of Chapter 3, Section 307.1 —Accumulation of Rubbish or Garbage per
International Property Code which states "All exterior property and premises,and the interior of every
structure,shall be free from any accumulation of rubbish or garbage."
This letter requests the noted violation be corrected by removing all the trash and garbage from the
property within ten days from receipt of this letter. If the violation is corrected and then recurs or if the
violation is not corrected by the time specified in this notice this case may be presented to the Atlantic Beach
Code Enforcement Board even if the violation has been corrected prior to the board meeting.The Code
Enforcement Board may impose fines up to$250 a day for each day the violation is not corrected.
A re-inspection will be done on/or before January 31,2010. To avoid having this Code Enforcement case
set for hearing,all listed violation(s)on this notice must be in compliance on or before the date established
by Atlantic Beach Code Enforcement.Upon completing the corrective action(s)required, it is your
responsibility to contact Atlantic Beach Code Enforcement and arrange for an inspection to verify
compliance.

7. Brief description:
The property was identified as being in violation for prohibited outside storage on May 15,2008.
An Official Notification of Violation was mailed Certified Return Receipt on May 15, 2008 and
signed for on May 28,2008.Compliance date was extended several times because of Mr.Cazares
medical problems. A final notice allowing an additional 30 days prior to the scheduling of a
hearing was mailed to and received by Mr. Cazares on April 11, 2009.
8. The latest inspection was made July 14, 2009 as a result of following up on the original complaint(s).
9. The violation(s) is still present X in compliance .

10. In order to achieve compliance, it is necessary to correct all of the violations and maintain the
property:
By removing all items from the exterior of the property that are not considered to be for
outside use.

property. They represent a fair and accurate representation of the property at the time they were taken.
12. I would estimate that 21 day(s)would be sufficient time to correct the violation.
13. Further Comments and Recommendations:
That Mr. Cazares be granted 21 days to bring his property into compliance, and that per
Florida Statute 162.09 (2) (a) he be assessed $264.30 in Administrative Fees. That the
Administrative fees be deferred pending satisfactory compliance by the imposed date and that
she be fined $50.00 a day per violation for every day beyond the imposed date.
That failing to pay any fines or assessments that any fees or fines assessed be placed as a
lien against the property at 741 Cavalla Rd for all assessments plus the costs incurred in
filing the lien. All lien amounts are to be made payable with an interest at a rate of ten (10)
percent per annum.

Consider this letter an Official Notification of Violation. That on April 28,2008,the City Commission
approved and updated the City Code regarding outside displays and storage, subsequently this has
adversely affected what can be legally stored out doors or in any location on a lot where such items can be
visible from adjacent properties.
As a result of these changes,your property and several others are now in violation of the following City
Code:
Chapter 24,Sec 14-154(g): Prohibited Outside Storage
To eliminate any hardship,I am granting you 30 days from receipt of this notification to relocate any
items that are stored outside or under the carport of the aforementioned property that are not normally
considered to be for outside use.
Furthermore you are reminded of your responsibilities as a property owner and that failure to comply can
result in fines of$500.00 per day,per violation from the Code Enforcement Board.

Subject: Notice of Violation
Dear Mr. Cazares,
This notification is being sent to you as a courtesy. On May 28, 2008 you received an Official
Notification of Violation regarding the condition of the carport at 741 Cavalla Rd. Based on your
medical condition at the time, you were given until August 12, 2008 to remove anything that was
not considered for outside use from the carport. To date, your efforts to remedy the storage
issues regarding your carport have been less than satisfactory.
In an effort to eliminate the necessity of requiring you to appear before the City's Code
Enforcement Board, I am granting you 30 days from your receipt of this notification to either
remove the remaining dilapidated/substandard fencing or install a proper fence on the
aforementioned properties. Should you elect to install new fencing you will be required to obtain
a fence permit from the Building Department.
Furthermore you are reminded of your responsibilities as a property owner in Atlantic Beach and
that violations of City Code can result in fines of up to $500.00 per day, per violation from the
Code Enforcement Board.
