Dear Mr. Hionidies:
Please be advised, Atlantic Beach Code Enforcement has found the property referenced above to
be in violation of the International Property Maintenance Code as adopted by the City of Atlantic
Beach, Code of Ordinances to wit:
VIOLATIONS
Section 302.4 Weeds . "All premises and exterior property shall be maintained free from or
plant growth in excess of twelve (12) inches in height. All noxious weeds shall be prohibited.
Weeds shall be defined as all grasses, annual plants and vegetation, other than trees or shrubs
provided ; however, this term shall not include cultivated flowers and gardens." (Property
overgrown including growth on fences and wall/accessory structures)
Section 302.7 Accessory Structures. "All accessory structures, including detached garages,
fences and walls, shall be maintained structurally sound and in good repair." (Concrete block
fence/wall/accessory structure is damaged, collapsing)
Section 307.1 Accumulation of rubbish and garbage. "All exterior property and premises, and
the interior of every structure, shall be free from any accumulation of rubbish and garbage."
(Garbage and trash on property)
This letter requests you comply by removal of all trash, rubbish and mow and clean
premises including removal of all weeds, grasses, vines from fences and walls and repair or
remove the dilapidated/damaged collapsing concrete block wall/accessory structure and all
completed within twenty (20) days of receipt of this notice.

A re-inspection will be done on or after January 24,2011. If the violation is corrected and then
recurs or if the violation is not corrected by the time specified in this notice this case may be
presented to the Atlantic Beach Code Enforcement Board even if the violation has been corrected
prior to the board meeting. The Code Enforcement Board may impose fines up to two hundred
fifty($250.00)dollars per day for each day the violation is not corrected. Upon completing the
corrective action required, it is your responsibility to contact Atlantic Beach Code Enforcement
and arrange for an inspection to verify compliance.
It is our goal to enforce the codes and ordinances of the City of Atlantic Beach and protect the
health, safety and welfare of the City, and accordingly, your cooperation in this matter is greatly

MORTGAGE AND NOTE MODIFICATION AND EXTENSION AGREEMENT
THIS AGREEMENT is made this 31 day of Ak'KcN 2008 by and between First
Guaranty Bank and Trust Company of Jacksonville,a Florida Banking Corporation which is organized
and existing under the laws of the United States of America and whose address is 1234 King Street,
Jacksonville,Florida 32204('lender"),and 3952 Mayport Road,LLC,a Florida Limited Liability
Company,whose address is 1235 Windsor Harbor Jacksonville,Florida 32225("borrower").
RECITALS
Lender is the owner and holder of that certain Promissory Note(the"Note")executed by
borrower dated August 10,2006 in the original principal amount of$5,000,000.00. In order to
secure the payment of the"Note"and any renewals and extensions thereof,Grantor executed and
delivered to Lender a mortgage dated August 10,2006 therewith encumbering certain real
property in Duval County,Florida("Property"),which is recorded in Official Record Volume,
13474 Page 981 and another Mortgage was recorded in Official Record Volume,13474 Page 998
of the current public records of Duval County,Florida("Mortgage").Correction to Mortgage and
Security Agreement was recorded on February 8,2008 in Official Record Volume,14377 Page
1973 of the current public records of Duval County.Florida.
Borrower has requested and Lender has agreed to modify the Note and Mortgage as herein set
forth.
NOW,THEREFORE,in consideration of the promises and performances set forth herein,as well
as the sum of$10,00 and other good and valuable consideration,the receipt and sufficiency of
which are hereby acknowledged,the parties agree as follows:
1. Balance of Note. The outstanding principal balance of the Note and Mortgage
remaining unpaia is$4,999,987.82(the"Unpaid Principal")and the interest as provided in
the Note has been paid to January 10,2008.An interest payment is now due in the
amount of$77,430.36
2. Modification. The terms of the Note and Mortgage are hereby modified,
amended,and supplemented as follows:
1. The interest rate on this loan shall be 6.25%per annum effective this 31 day
of /12i rc/i(2008.The interest rate is subject to change from time to time based
on changes in an independent index which is the Prime Rate as published in the
"Money Rates"section of the Wall Street Journal.The interest rate change will
not occur more often than each date of such change in the index.The current
index is 5.25%per annum.The interest rate to be applied to the unpaid principal
balance during the Note will be at a rate of 1.00%percentage points over the
index,resulting in an initial rate of 6.25%per annum.
2. Monthly payments of interest accrued shall be due beginning April 10,2008 and
on the 10th day of every month thereafter. All principal sums and all accrued interest
shall be due at the maturity date specified herein.
3. The maturity date shall remain as June 10,2008.
3. Valid Existing Obligation. This agreement modifies certain terms and
conditions of a valid,existing obligation evidenced by the Note and Mortgage,and the parties
hereto agree that this Agreement is not intended to substitute or extinguish such valid,exsting
obligation,nor is this Agreement intended to effect a novation of such valid existing obligation and
in the event of any default in payment of principal or interest under the Note as modified cr in the
event of any other default as set forth in the Note or the Mortgage,Lender shall have the same
rights proceed against the Property as if the Mortgage had initially secured the Note as modified.
4. Other Provisions. To the extent that this Agreement conflicts with any of the
terms of the Note or Mortgage,the Note and Mortgage are modified as provided herein Except
as herein specifically and expressly modified,it is conventional and agreed between Borrower and

remain in full force and effect.

Dear Mr. Hionidies:
Please be advised, Atlantic Beach Code Enforcement has found the property referenced above to
be in violation of the International Property Maintenance Code as adopted by the City of Atlantic
Beach, Code of Ordinances to wit:
VIOLATIONS
Section 302.4 Weeds . "All premises and exterior property shall be maintained free from or
plant growth in excess of twelve(12) inches in height. All noxious weeds shall be prohibited.
Weeds shall be defined as all grasses,annual plants and vegetation, other than trees or shrubs
provided; however,this term shall not include cultivated flowers and gardens."(Property
overgrown including growth on fences and wall/accessory structures)
Section 302.7 Accessory Structures. "All accessory structures, including detached garages,
fences and walls, shall be maintained structurally sound and in good repair." (Concrete block
fence/waWaccessory structure is damaged, collapsing)
Section 307.1 Accumulation of rubbish and garbage. "All exterior property and premises, and
the interior of every structure, shall be free from any accumulation of rubbish and garbage."
(Garbage and trash on property)
This letter requests you comply by removal of all trash, rubbish and mow and clean
premises including removal of all weeds, grasses,vines from fences and walls and repair or
remove the dilapidated/damaged collapsing concrete block waWaccessory structure and all
completed within twenty(20) days of receipt of this notice.

A re-inspection will be done on or after January 24,2011. If the violation is corrected and then
recurs or if the violation is not corrected by the time specified in this notice this case may be
presented to the Atlantic Beach Code Enforcement Board even if the violation has been corrected
prior to the board meeting. The Code Enforcement Board may impose fines up to two hundred
fifty($250.00)dollars per day for each day the violation is not corrected. Upon completing the
corrective action required, it is your responsibility to contact Atlantic Beach Code Enforcement
and arrange for an inspection to verify compliance.
It is our goal to enforce the codes and ordinances of the City of Atlantic Beach and protect the
health, safety and welfare of the City, and accordingly,your cooperation in this matter is greatly
