Eddie ,
Attached are photos of 795 Plaza Dr. along with a copy of the foreclosure document naming Enrico
Gonzalez, Esq. as the attorney filing the foreclosure. I contacted Enrico Gonzalez's office this morning and
requested the building be secured as soon as possible. A column supporting the lintel beam was demolished
and must be replaced to keep the front roof from collapsing. The building is also open to trespass by small
children and vagrants. If not secured by this weekend the City should start procedures to have the building
secured and cost will be assessed against the property. I suggest you start code enforcement action against
the junk and trash that has accumulated on the property, it appears the property has been in this condition
for some time.
Chief Classy,
The building has been posted with "danger unlawful to occupy" signs. Please ask you staff to monitor the
site from time to time to make sure kids and vagrants stay away.
Karen M.
As we discussed, please let me know if you have questions. You or Mr. Gonzalez can contact me at 904-247-

Thanks.

10-06445-Sig 4/Sig 76 with Neptune Beach-795 Plaza-ABPD officers were dispatched to Royal Palm in reference to
assisting Neptune Beach Police Department in reference to one of their attempting to stop a vehicle. Officer Ashemore
was first on scene and advised via radio that the subject vehicle crashed into the residence at 795 Plaza. Neptune Beach
and Atlantic Beach Officers arrived on scene, secured the scene,and conducted a search of the property for injured
persons. A check concluded that this residence appears to be under renovation and unoccupied. Officer Jamison/Ayers
were assigned to work the crash investigation and Neptune Beach Officers handled the criminal investigation (CCR
#80310179). No Atlantic Beach Officers were involved in the original stop and arrived on scene only after being
requested by Neptune Beach Police Department. The residence sustained a large amount of damage to what appears to
be the living room. A sign on the door stated that this property has a management company (Safeguard Properties 216-
739-2900). assigned to it(Safeguard Properties 216-739-2900). Officer Ayers attempted to contact the number but it is
out of service from 12 midnight-8 a.m. Officer Ayers was unable to complete the crash report prior to the end of her
shift. Crash paperwork will be completed at the beginning of her shift on 3/24/10. The driver of the vehicle was
arrested by Neptune Beach Police Department. The vehicle was towed from the scene by Murr's Auto Body by Atlantic
Beach Police.

EXPLANATION OF BANKRUPTCY DISCHARGE
IN A JOINT CHAPTER 7 CASE
This court order grants a discharge to the persons named as the debtors.It is not a dismissal of the case
and it does not determine how much money.if any,the trustee will pay to creditors.
Collection of Discharged Debts Prohibited
The discharge prohibits any attempt to collect from the debtors a debt that has been discharged.For
example,a creditor is not permitted to contact a debtor by mail,phone.or otherwise,to file or continue a lawsuit,to
attach wages or other property,or to take any other action to collect a discharged debt from the debtors.A creditor
who violates this order can be required to pay damages and attorney's fees to the debtor.
However,a creditor may have the right to enforce a valid lien,such as a mortgage or security interest,
against the debtors'property after the bankruptcy,if that lien was not avoided or eliminated in the bankruptcy case.
Also,a debtor may voluntarily pay any debt that has been discharged.
Debts That are Dischareeti
the chapter 7 discharge order eliminates a debtor's legal obligation to pay a debt that is discharged.
Most,but not all,types of debts are discharged if the debt existed on the date the bankruptcy case was filed.(If this
case was begun under a different chapter of the Bankruptcy Code and converted to chapter 7,the discharge applies to
debts owed when the bankruptcy case was converted.)
Debts that are Not Disehareed.
Some of the common types of debts which arc au discharged in a chapter 7 bankruptcy case are:
a.Debts for most taxes;
b.Debts incurred to pay nondischargeable taxes(in a case filed on or after October 17,2005):
c.Debts that are domestic support obligations;
d.Debts for most student loans;
e.Debts for most lines,penalties,forfeitures,or criminal restitution obligations;
f.Debts for personal injuries or death caused by the debtor's operation of a motor vehicle,vessel,or aircraft
while intoxicated;
g.Some debts which were not properly listed by the debtor,
h.Debts that the bankruptcy court specifically has decided or will decide in this bankruptcy case arc not
discharged:
i.Debts for which the debtor has given up the discharge protections by signing a reaffirmation agreement in
compliance with the Bankruptcy Code requirements for reaffirmation of debts:and
j.Debts owed to certain pension.profit sharing stock bonus,other retirement plans,or to the Thrift Savings
Plan for federal employees for certain types of loans from these plans(in a case filed on or after October 17.
2005).
This information is only a general summary of the bankruptcy discharge.There are exceptions to
these general rules.Because the law is complicated,you may want to consult an attorney to determine the
exact effect of the discharge in this case.
