I'm sorry to say that there isn't anything that we can do. I was not aware of the codes for the coastal property, I had never dealt with this situation before. The City Code (Section 12-1 (b) (11))does not apply to undeveloped/unimproved oceanfront lots. The reason being is that the majority of oceanfront lots lies seaward of the Coastal Construction Control Line(CCCL), and any improvements, including disturbances to the natural vegetative systems is under the jurisdiction of the Florida Department of Environmental Protection. Thus, the City has no authority to compel a property owner to alter the vegetation. In fact, any such disturbances require a review and issuance of a field permit. Ms. Hall referred Ms. Aldridge to our local field agent, Trey Hatch,to ascertain FDEP's opinion. Mr. Hatch explained to Ms. Aldridge,his division is primarily concerned with coastal construction and its impact on the beach systems,particularly prevention of erosion of the dunes and the removal of vegetation that serves to anchor the dunes and protect inland properties from the impact of wave action and storm systems. For this reason,natural undeveloped/unimproved lots are highly valued, and FDEP encourages natural lots, and recommends the least disturbance possible on any oceanfront lot. Mr. Hatch also said that the rodents and snakes are a natural part of the coastal ecosystem and nothing short of developing the property will drive them from it, and even then,there would be occasions when one or the other would be sighted on the property. Thus, Mr. Hatch told Ms. Aldridge that he did not recommend any changes to the vegetation on her lot. However, Mr. Hatch did tell Ms. Aldridge,that if the adjacent property owners found the vegetation on Ms. Aldridge's vacant lot objectionable,he recommended that they might wish to consult with Kevin Partel of Coastal Consulting& Restoration, who could devise a plan to remove any non-native species and replace them with more desirable native vegetation. Mr. Hatch said that if the neighbors wished to go this route,he would be happy to issue a field permit for an acceptable plan from Mr. Partel. When Ms. Hall spoke with Ms. Aldridge Wednesday afternoon, she said she is amendable to this solution, however,the neighbors will need to coordinate with her because Mr. Hatch can only issue the field permit to the property owner, so she would be the one to apply to FDEP. And,the neighbors will need to pre-pay Mr. Partel for his consultation/services and replacement plant materials, to ensure that all work is done professionally, completely and in a manner consistent with FDEP standards and regulations. Otherwise, Ms. Aldridge said she does not intend to alter the lot. I realize that this is a lot of information but I wanted to give you everything that was given to me.
