PERM1T7EE: Howard J.and Vicki T.Loff PERMIT NUMBER: DU498 PAGE PROPRIETARY AUTHORIZATION Construction of an access corridor and dune plantings seaward of the Erosion Control Line(ECL)also requires a proprietary authorization,as the activity is located,in part,on sovereignty, submerged lands,held in trust by the Board of Trustees of the Internal Improvement Trust Fund(BOT),pursuant to Article Y, Section 11 of the Florida Constitution,and Sections 253.002 and 253.77,Florida Statutes(F.S). The activity is not exempt from the need to obtain a proprietary authorization. The BOT delegated, to the Department, the responsibility to review and take final action on this request for proprietary authorization in accordance with Section 18-21.0051, Florida Administrative Code (FA.C.). This proprietary authorization has been reviewed in accordance with Chapter 253,F.S.,Chapter 18 21,F.AC.,and the policies of the BOT. As staff to the BOT,the Department has reviewed the project described in this permit, and has determined that the construction as described above seaward of the ECL qualifies for a Letter of Consent to use sovereignty, submerged lands, as long as the work performed is located within the boundaries as described herein and is consistent with the terms and conditions herein. Therefore, consent is hereby granted, pursuant to Chapter 253.77,F.S.,to perform the activity on the specified sovereignty,submerged lands. This authorization to use sovereignty, submerged lands is subject to the attached General Consent Conditions, which are a binding part of this authorization. SPECIAL PERMIT CONDITIONS: 1. Prior to commencement of construction activity authorized by this permit,a preconstruction conference shall be held at the site among the contractor,the owner or authorized agent, and a staff representative of the Department to establish an understanding among the patties as to the items specified in the special and general conditions of the permit.The proposed locations of the structures shall be staked out for the conference. No construction, operation, transportation or storage of equipment or materials, and no temporary lighting of the construction area is authorized in sea turtle nesting habitat, on or seaward of the frontal dune crest or rigid coastal protection structure in marine turtle nesting habitat at any time during the sea turtle nesting season (May 1 through October 31, or for Brevard through Broward Counties, March 1 through October 31). 4. All rubble and debris resulting from this construction shall be removed to a location landward of the coastal construction control line. 5. All material to be excavated seaward of the coastal construction control line as part of construction authorized under this permit shall remain in and be placed in areas seaward of the coastal construction control line. Prior to completion ofconstmction,the permit holder shall plant all dune areas disturbed by construction, including the 10-foot wide construction access corridor, with a mix of a minimum of three different species of native beach dune vegetation,including a 70 percent cover of grasses such as sea oats(Uniola paniculata),and bitter panicum(Panicum amarum). Dune restoration plants are to be a minimum of 2- inch containers or plugs spaced in staggered rows a maximum distance of 18 inches apart. Grass planting units shall be installed a minimum of 6 inches deep. The permit holder is to fertilize, and water-in the planting units at the time of installation. Within 180 days of planting, a minimum 80 percent overall survival rate of the planting units will be established and 80 percent of the planted area covered with the selected species. The permit holder is to replant all deficient areas and maintain the plantings until the above success criterion are met. 7. All lighting shall be installed and maintained as depicted in the approved lighting schematic.Underwater pool lighting shall be permanently fixed to amber or red LED or equivalent and provide no more than% foot candle per square foot ofpool surface area.There may be a decrease in the wattage of each approved Imp and a decrease in the total number of each approved fixture without submitting a modified lighting plan for review and approval.However,if a fixture or lamp is changed to a different type,manufacturer or catalog number for any reason, or if the location of any fixture is changed it shall be submitted for review and approval by the Department prior to installation. No additional permanent exterior lighting is authorized. GENERAL LETTER OF CONSENT CONDITIONS Any use of sovereignty submerged lands is subject to the following general conditions,which are binding upon the applicant/permittee and are enforceable under Chapter 253,F.S. I. Sovereignty submerged lands may be used only for the specified activity or use. Any unauthorized deviation from the specified activity or use and the conditions for undertaking that activity or use will constitute a violation. Violation of the authorization will result in suspension or revocation of the applicant's use of the sovereignty submerged lands unless cured to the satisfaction of the Board of Trustees. 2. Authorization conveys no title to sovereignty submerged lands or water column, nor does it constitute recognition or acknowledgment of any other person's title to such land or water. 3. Authorizations may be modified, suspended or revoked in accordance with its terms or the remedies provided in Sections 253.04,and 258.46,F.S.,and Chapter 18-14, F.A.C. 4. Structures or activities will be constructed and used to avoid or minimize adverse impacts to sovereignty, submerged lands and resources. 5. Construction,use,or operation of the structure or activity will not adversely affect any species which is endangered, threatened or of special concern, as listed in Rules 68A-27.003, 68A-27.004, and 68A- 27.005, F.A.C. Structures shall be maintained in a functional condition and shall be repaired or removed if they become dilapidated to such an extent that they are no longer functional. This shall not be construed to prohibit the repair or replacement subject to the provisions of Rule 18-21.005, F.A.C., within one year, of a structure damaged in a discrete event such as a storm,flood,accident,or fire. 9. Structures or activities will be constructed,operated,and maintained solely for water dependent purposes or for non-water dependent activities authorized under paragraph 18-21.004(1x4),F.A.C., or any other applicable law. 10. The applicant/permittee agrees to indemnify, defend and hold harmless the Board of Trustees and the State of Florida from all claims, actions, lawsuits and demands in any form arising out of the authorization to use sovereignty submerged lands or the applicant's use and construction of structures on sovereignty submerged lands. This duty to indemnify and hold harmless will include any and all liabilities that are associated with the structure or activity including special assessments or taxes that are now or in the future assessed against the structure or activity during the period of the authorization. 11. Failure by the Board of Trustees to enforce any violation of a provision of the authorization or waiver by the Board of Trustees of any provision of the authorization will not invalidate the provision not enforced or waived, nor will the failure to enforce or a waiver prevent the Board of Trustees from enforcing the unenforced or waived provision in the event of a violation of that provision. 12. The Applicant/Permittee binds itself and its successors and assigns to abide by the provisions and conditions set forth in the authorization. If the applicant/permittee or its successors or assigns fails or refuses to comply with the provisions and conditions of the authorization, the authorization may be terminated by the Board of Trustees after written notice to the applicant or its successors or assigns. Upon receipt of such notice, the applicant/permittee or its successors or assigns will have thirty (30) days in which to correct the violations. Failure to comet the violations within this period will result in the automatic revocation of this authorization. 13. All costs incurred by the Board of Trustees in enforcing the terms and conditions of the authorization will be paid by the applicant. The following general permit conditions shall apply,unless waived by the Department or modified by the permit (a)The permittee shall tarty out the construction or activity for which the permit was granted in accordance with the plans and specifications that were approved by the Department as part of the parent. Deviations therefrom, without written approval from the Department, shall be grounds for suspension of the work end revocation of the permit pursuant W Section 120.60(7),F.S.,and shall result in assessment of civil fines or issuance of an order to alter or remove the unauthorized work,or both.No other construction or activities shall be conducted, No modifications to project size, location, or structural design are authorized without prior written approval from the Department. A copy of the notice to proceed shall be conspicuously displayed at the project site. Approved plans shall be made available for inspection by a Department representative. (b)The permittee shall conduct the construction or activity authorized under the permit using extreme care to prevent any adverse impacts to the beach and done system,marine turtles,their nests and habitat,or adjacent property and structures. (c)The permittee shall allow any duly identified and authorized member of the Department to enter upon the premises associated with the project authorized by the permit for the purpose of ascertaining compliance with the terms of the permit and with the rules of the Department until all construction or activities authorized or required in the permit have been completed and all project performance reports, certifications, or other documents are received by the Department and determined to be consistent with the permit and approved plans. (d) The permittee shall hold and save the State of Florida, the Department, end its officers and employees harmless from any damage, no matter how occasioned end no matter what the amort, to persons or property that might result from the construction or activity authorized under the permit and from any and all claims and judgments resulting from such damage. (e) The permittee shall allow the Department to use all records, notes, monitoring data, and other information relating to construction or any activity under the permit, which are submitted, for any purpose necessary except where such use is otherwise specifically forbidden by law. (t) Construction traffic shall not occur and building materials shall not be stored on vegetated areas seaward of the control line unless specifically authorized by the permit. (i)If surplus sand fill results from any approved excavation seaward of the control line,such material shall be distributed seaward of the control line on the site,as directed by the Department,unless otherwise specifically authorized by the permit. 0) Any native salt-tolerant vegetation destroyed during construction shall be replaced with plants of the same species or, by authorization of the Department,with other native salt-tolerant vegetation suitable for beach and dune stabilization.Unless otherwise specifically authorized by the Department all plants installed in beach and coastal areas—whether to replace vegetation displaced, damaged, or destroyed during construction or otherwise—shall be of species indigenous to Florida beaches and domes, such as sea oats, sea grape, saw palmetto, panic gross, saltmeadow hay cordgrass, seashore saltgrass. and railroad vine, and grown from snick indigenous in the region in which the project is located. (k)All topographic restoration end revegeration work is subject to approval by the Department,and the status of restoration shall be reported as part of the final certification of the actual work performed. (1) If not specifically authorized elsewhere in the permit, no operation, transportation, or storage of equipment or materials is authorized seaward of the dune crest or rigid coastal structure during the marine mule nesting season.The marine turtle nesting season is May I through October 31 in all counties except Brevard,Indian River,St Lucie,Martin,Palm Beach,and Broward counties where leatherdi ck turtle nesting occurs during the period of March 1 through October 31. (q) For permits involving major structures or activities, the permittee shall submit to the Bureau periodic progress reports on a monthly basis beginning at the start of construction and continuing until all work has been completed.If a permit involves either new armoring or major reconstruction of existing armoring,the reports shall be certified by an engineer licensed in the State of Florida.The permittee or engineer,as appropriate,shall certify that as of the date of each repon all construction has been performed in compliance with the plans and project description approved as a pan of the permit and with all conditions of the permit, or shall specify any deviation from the plans,project description,or conditions of the permit The report shall also state die percent of completion of the project and each major individual component The reports shall be provided to the Bureau using the form entitled"Periodic Progress Report"—DEP Form 73-111 (Revised 6/04),which is hereby adopted and incorporated by refinance.Permits for minor structures or activities do not require submittal of Periodic reports unless required by special permit condition. (r) For permits involving habitable major structures, all construction on the permitted structure shall stop when the foundation pilings have been installed. At that time the foundation location form shall be submitted m and accepted by the Bureau prior to proceeding with further vertical construction above the foundation. The form shall be signed by a professional surveyor, licensed pursuant to Chapter 472,F.S.,and shall be based upon such surveys performed in accordance with Chapter 472,F.S.,as are necessary to determine the actual configuration and dimensioned relationship of the installed pilings to the control line.The information shall be provided to the Bureau using the form entitled"Foundation Location Certification" —DEP Form 73-114B (Revised 9/05), which is hereby adopted and incorporated by reference. Phasing of foundation certifications is acceptable. The Department shall notify the permittee of approval or rejection of the farm within seven(7) working days atter staff receipt of die farm. All survey information upon which the form is based shall be made available to the Bureau upon request.Pemtits for repairs or additions to existing structures with nonconforming foundations are exempt from this condition. (s)For permits involving major structures,the permittee shall provide the Bureau with a report by an engineer or architect licensed in the State of Florida within darty(30)days following completion of the work.The report shall state that all locations specified by the permit have been verified and that other construction and activities authorized by the permit have bean performed in compliance with the plans and project description approved as a part of the permit and all conditions of the permit;or shall describe any deviations from the approved Plans,project description,or permit conditions,and any work not performed.Such report shall not relieve the permittee of the provisions of paragraph 62B-33.0155(1)(a),F.A.C. If time of the permitted work is performed,the permittee shall inform the Bureau in writing no later than 30 days following expiration of the permit. The report shall be provided on the form entitled"Final Certification"DEP Form 73-1158(Revised 9/05),which is hereby adopted and incorporated by reference. (t)Authorization for construction of armoring or other rigid coastal structures is based on an engineering review and assessment of the design and anticipated performance and impact of the structure as a complete unit Construction of any less than the complete structure as approved by the Department is not authorized and shall result in the assessment of an administrative fore and the issuance of an order to remove the partially constructed structure- Modifications to the project sem, location, or structural design shall be authorized by the Department in accordance with Rule 6211-33.013,F.A.C. 2. The permittee shall not commence any excavation, construction, or other physical activity on or encroaching on the sovereignty land of Florida seaward of the mean high water line or,if established,the erosion control line until the permittee has received from the Board of Trustees of the Internal Improvement Trost Fund the required lease, license, easement, or other form of consent authorizing the proposed use. 3.
