AGENDA ITEM: Request from George Bull, Jr., on behalf of Tom Petway, seeking a waiver from the 25-foot height limit within the Central Business District to allow exterior elements to extend to a height of 31-feet as • - part of renovations to an existing commercial building at 375 Atlantic Boulevard (former Famous Amos restaurant location.) • ~ SUBMITTED BY: Sonya Doen, AICP Community Development Director DATE: December 14, 2004 BACKGROUND: Section 24-156 provides that the City Commission may, upon specific ' ~ application, make limited exceptions to established height limits. Approval of any such request ., must first be consistent with .Policy A.1.5.5 of the Comprehensive Plan, which limits any increase in height only to non-residential development and only to certain exterior features (non- ` ' habitable space), and further, upon finding that the proposed height is compatible with existing surrounding development. The former Famous Amos restaurant site, located at the northeast corner of Sherry Drive and Atlantic Boulevard, is the westernmost parcel within the Central Business District fronting Atlantic Boulevard. Proposed redevelopment of the existing one-story structure (for professional • • office use, -- and yes, the two large oak trees on the site will be retained) is subject to the 25-foot height limit of the CBD and also the Commercial Corridor design standards, which prohibit flat roofs. The proposed two-story design (see attached) contains a roof design, which is intended to comply with the Corridor standards, and also, which will conceal roof-top mechanical . equipment. (Consistent with the Comprehensive Plan, no Habitable Space exceeds the 25-foot height limit.) Staff recommends approval finding the proposed design consistent with existing surrounding .development, the intent of the Commercial Corridor Design Standards and the Central Business • District. BUDGET: No budget issues. RECOMMENDATION: Motion to approve an exception to the Height of Building within the • ~ Central Business District Zoning District, not to exceed thirty-one (31) feet, in accordance with Section 24-156 of the Land Development Regulations and Policy A.1.5.5 of the Comprehensive Plan, finding the proposed height compatible with existing surrounding development. .. He has retained my Services as Architect to remodel the existing First Floor _ and add a Second Floor to the existing structure. The First Floor will accommodate Professional Rental Offices while Mr. Petway will be utilizing the Second Floor for his Corporate Executive Offices. Due to the following factors, including the existing masonry wall height, we are having great difficulty bringing our total height to within 25 feet as required by Section 24-114(f)(2) of the Zoning Regulations. Our sloping roof needs to extend above the roof structure to visually screen the rooftop mechanical equipment. We also need to provide floor and roof structural systems as well as interior heights to accommodate air conditioning ductwork and mechanical and electrical equipment. It is our intent to Architecturally complement the Shoppes of Northshore, and to achieve a Soft Residential character for our project. We will be providing more than the required parking, retaining the twa Iarge oak trees on the North side, eliminating paved surfaces and providing .mare landscaping as well as eliminating ingress from Atlantic Boulevard.
