(a) Purpose and intent. The City of Atlantic Beach is composed predominantly of older residential subdivisions and neighborhood scale commercial businesses serving these neighborhoods. It is in the public interest of the city to foster diverse and stable neighborhoods and to implement strategies in support of related objectives and policies as expressed within the city's adopted comprehensive plan. The purpose and intent of these regulations is to provide minimum standards for the acceptable conditions of properties and structures within the city and to assist in the implementation of the International Property Maintenance Code,which is adopted as article VIII within chapter 6 of this Municipal Code of Ordinances. (b) Appropriate maintenance and upkeep. All areas of a lot and structures that are visible from a street or a neighboring property shall be maintained in an acceptable manner,which shall be defined by the following characteristics: (1) Lots are maintained free of litter,trash, debris,discarded belongings,automotive parts and old tires, construction materials, and broken and abandoned items. (2) Dead shrubbery or landscaping is removed from lots,and where a resident is unable to maintain a lawn or landscaping, dirt or sand areas are contained in some manner so as to prevent dirt or sand from blowing or washing on to adjacent properties,the street or the city's stormwater system. (3) Broken or missing glass in windows or doors is replaced with glass,and where windows or doors are visible from the street,these are not covered with wood,fiberglass, metal, cardboard, newspaper or other similar materials, except for a temporary time period as needed to make proper repairs or to protect windows from wind-borne debris during a storm. (4) Trim work, eaves, soffits, gutters, shutters, and decorative features are not broken and are securely attached as intended. Smith Violation: Chapter 24, Section 173 (b) 1 & 5 Neighborhood preservation & property maintenance standards Ownership of the property as determined by: Duval County Property Appraisers website 1. This inspection was prompted by: Complaint Routine Survey X Other 2. Proper Notice was achieved in accordance with F.S. 162 by: Certified Mail X Hand Delivery Posting of Property 3. I have X have not spoken with someone in control of the property 4. Description of violation: (Photos) These photos show from beginning up to yesterday. As you can see, Mr. Smith has made a lot of progress but still has some items to remove. In order to correct the violation the milk crates, propane tanks, storage bins, luggage carrier for car, lumber must all be removed from back yard or placed in a proper storage building. Staff recommends the Board find the property owner in violation and order that compliance be obtained on or before October 14, 2011 or a fine of$100.00 be imposed for the first day and $100.00 for every day thereafter the violation continues to exist. In addition, any fine shall also include the administrative costs to the City incurred in prosecuting this case The property owner is responsible for contacting the City Code Enforcement Officer and obtaining an inspection of compliance. Case # 74810 705 Sailfish Drive October 11, 2010 I gave a notice to Mr. Matthew Smith @ 705 Sailfish Drive for storage of discarded belongings in the back yard. I spoke with Mr. Smith who is suffering with lung cancer. He stated that this would be difficult for him to do & it would take him longer than the time given. I gave him 30 days&said we would look at the progress On November 11th I looked at the property and saw very little had been done. Realizing he was so sick I gave him more time. However, it seemed that little to nothing was being done. February 11, 2011 I mailed a certified letter, listing the violations. City Ord. Sec. 24-173—Neighborhood preservation & property maintenance standards. Discarded belongings stored all over back yard, including: propane tanks (several), milk crates (too numerous to count),coolers, construction materials&a pile of lumber. Also a violation listed under the International Property Maintenance Code—302.8—Inoperable, unlicensed vehicle—Old Mustang under an old rotted car cover. He was given until March 16, 2011. On 3/17/11 I took some more pictures. Some things had been removed including the Mustang. Again, I wasn't ignoring this situation; I just know how sick this man is. June 14th, I sent Mr. Smith another letter. This time to cut grass, clean up trash bags in front yard & all open storage in rear yard. The deadline was June 27. On July 151,the grass in the front yard was cut & trash was gone. However,the storage in the back yard remained. At this time I realized that bringing this case before the CEB was my only choice. August 29, a notice of hearing for the Code Enforcement Board was sent certified mail to Mr. Smith. Again citing City Ord. Sec. 24-173. The letter asked him to remove all discarded belongings from the back yard including: All debris stored between fence &storage building,five gallon buckets, blue fuel containers,two brush piles, plastic crates, propane tanks,chicken wire, Christmas decorations &gas cans. These pictures were taken yesterday afternoon. As you can see he has removed the majority of the items I requested. I spoke with Mr. Smith this morning & we discussed the items that sill remain an issue: The milk crates,the propane tanks,the storage bins, &some other miscellaneous items. Also he needs to keep the grass cut in the back yard as well as the front yard. When we spoke he asked if it was imperative that he attend the meeting tonight. (His speech was very labored and long pauses in between sentences). I told him he did not have to attend the meeting. I assured him, it is not my intention to railroad him. I realize how sick he is but the property does need to be brought into compliance. I told him if he didn't attend the meeting that I would call him tomorrow and let him know the findings and he would also receive a letter in a few days. I told him that we do have a volunteer program that could possibly help him; he doesn't want that at this time. I believe his son has been doing the work for him. He said if we could give him another 30 days he thinks he can bring it into compliance. It is my recommendation that we give Mr. Smith 30 days from tomorrow, which will be October 14, 2011 to bring his property into compliance. If at this time he has not met compliance a fine of$100.00 a day will begin until compliance is met.
