AGENDA ITEM: Regulation of the location and use of private skateboard ramps on residential lots (for discussion only) SUBMITTED BY: Sonya Doerr, AICP ~,lQ Community Development Director DATE: February 18, 2005 BACKGROUND: As follow-up from the previous City Commission meeting, Staff has researched how other communities address structures such as home-built skateboard ramps. In reviewing regulations from 25-30 different communities, very few regulate such ramps and similar structures or private property in any distinct way. Most all communities have some type of restriction to skateboarding in public parks and on certain other public properties, but on private property, these generally seem to be treated as a typical activity subject to whatever regulations otherwise apply to accessory uses and structures. Again, the City's Land Development Regulations now consider these to be Accessory Structures if they are greater than 30 inches in height. Section 24-151 (2) provides that Accessory Structures shall not be located within the Required Front Yard (the 20-foot front yard setback); requires that they be at least 5-feet from rear and side lot lines, and requires that Accessory Structures not exceed 15-feet in height. If the City Commission wishes to more specifically address these structures, the following language is offered for discussion. This or similar provisions could be added to Section 24-151, ' which lists permitted accessory uses and structures and related limitations within residential zoning .. districts. Skateboard, skating, bicycle or similar ramps, for use on private property only, placed or constructed in fixed locations and made of wood, block concrete or similar materials provided that these are not located within Required Front Yards or the Street Side Yards on a Corner Lot Due to excessive noise, which may result from the use of such ramps, time of use shall be limited to the hours between 9:OOam and 10:00pm. Such ramps located on any area of a Lot shall be maintained in a safe and good condition, and shall be disassembled and removed from the property if allowed to deteriorate to an unsafe or unsightly appearance.
