Exh 8AAGENDA ITEM #8A MARCH 28, 2005 CITY OF ATLANTIC BEACH • CITY COMMISSION MEETING STAFF REPORT AGENDA ITEM: Comparison of Local Requirements for Working in the Public Right of Way and Local Driveway Limitations SUBMITTED BY: Rick Carper, P.E., Public Works Director DATE: March 11, 2005 • BACKGROUND: At the February 14~' Commission Meeting, the City Commission inquired about limitations on work being done by residents in the • City's Right of Way. The specific sites questioned included the 1400 block of Ocean Blvd where pavers had replaced concrete . sidewalk and an entire lot's frontage on Ocean was covered with • pavers. Staff was asked to investigate and compare requirements of the various beach communities. • A review of the City's Code, including the Land Development Regulations, revealed that the requirement for a Building Permit is • only specifically addressed for public utility work in the Right of .. Way (City Code Section 19-2, attached). Work by individual homeowners is not addressed by the Code, although this section contains a prohibition of work that would seem to include the • , examples above. A review of Permit Applications in the Public • Works Department files shows less than half of the parking aprons installed east of Seminole Road ROW were permitted. Additionally, there is no Code requirement for a Building Permit for installation of decks or other structures less than 30" above grade, unless a building inspection is required (e.g., form inspection for poured concrete). BUDGET: No budget impact for Commission information only. RECOMMENDATION: Commission direct Staff to develop recommended changes to City Code to address the lack of control of work in the City Right of Way. ATTACHMENTS: A. Parking for residential uses shall be located within paved or stabilized driveways, private garages or carports or such areas intended for the day-to-day parking of vehicles. Vehicles shall not be routinely parked within grassed or landscaped areas of a residential lot. Mechanical or other automotive repair work on any motor vehicle shall not be performed out-of-doors within any residential zoning district, except for minor maintenance or emergency repair lasting less than eight (8) hours and performed on a vehicle owned by the occupant of the residential property. *Revocable encroachment permit =required for parking aprons within the Right of Way or for any non-standard driveway installation (e.g., pavers) in the Right of Way. Repairs required because of City or public utility work in the Right of Way are at the homeowner's expense.
