AGENDA ITEM: Recommended Code Changes for Working in the Public Right of Way
.. and Impervious Material Limitations

.. BACKGROUND: At the March 14th Commission Meeting, the City Commission
directed staff to research and recommend limitations on work being
done by residents in the City's Right of Way (ROW). Specifically, the
• ~ Commission requested the requirement for a Permit for any work in
. the ROW be codified, that a limit on the impervious surfaces that may
be added to the ROW be established, a limit to driveway widths be
included and that concrete be specified as the only acceptable
material for sidewalks within the ROW.
Staff recommends the Commission consider the following changes to current regulations:
Right of Way Permitting:
1. Any proposed work in the City Right of Way, whether for building or modifying an
existing driveway or constructing a new driveway or parking area, shall require an
approved CONSTRUCTION PERMIT WITHIN CITY RIGHTS OF WAY AND
EASEMENTS.
2. That this permit be considered a revocable encroachment permit for any non-
standard driveway installation (e.g., pavers) in the Right of Way. Repairs required
. • because of City or public utility work in the Right of Way will be at the homeowner's
expense.
3. No additional parking aprons will be allowed in the public Right of Way along
arterial (through) streets such as Seminole Road, East Coast Drive and Ocean
Boulevard.
Impervious Limitations:
4. Limit homeowner improvements within the front (and side for corner lots) building
setback to a maximum of 50% impervious area. This would ensure some grass or
vegetative area for lot runoff to traverse before reaching the street and the City's
collection system.

5. Maximum driveway width at the property line shall be twenty-two (22) feet, with an
.., allowed flare up to twenty-eight (28) feet at the edge of pavement. Circular
driveways shall not be permitted for lot frontage less than one hundred (100) feet.
' ~ Maximum width for each end of circular driveway to be 12 feet at the property line,
.. with flare to 18' at the edge of pavement. For 100-foot lots with City standard four-
foot sidewalk, Right of Way impervious coverage may be increased to 60% for
' ~ circular drives, with a comparable reduction in impervious area on the associated
-. property.
6. Any improvements in the Right of Way that are not a part of a residential driveway
' or sidewalk shall be constructed of turfblock or other pervious paving material (does
not include concrete or stone pavers, regardless of method of construction).
7. Add to Land Development Regulation Section 24- 67 Development Review and ~.
Issuance of Development Permits a requirement that all permit applications adding
5% or more impervious area to a lot will require Public Works approval. This
includes remodeling and decking or driveway additions. On-site storage and
treatment in accordance with LDR 24-66(b) to be required for any added
impervious area.
8. Change the impervious surface calculation for pavers used for driveway or walkway
construction on private property from 50% to 75%.
Sidewalk:
9. Replacement of the City sidewalk with any surface other than smooth concrete
shall not be permitted.
Miscellaneous:
10. Clarify LDR 24-66(b) On-Site Storage such that only areas which have an in-
compliance rip vate retention or detention system (e.g., Oceanwalk or Paradise
Preserve) to collect and control run-off, are exempt from on-site storage
requirements.
BUDGET: No budget impact, for Commission information and Staff direction only.
RECOMMENDATIONS: Commission direct Staff to develop recommended changes to
. City Code to address the lack of control of work and construction of impervious areas in
the City Right of Way.

for residential uses shall be located within paved or stabilized driveways, private garages
or carports or such areas intended for the day-to-day parking of vehicles. Vehicles shall
not be routinely parked within grassed or landscaped areas of a residential lot. Mechanical
or other automotive repair work on any motor vehicle shall not be performed out-of--doors
within any residential zoning district, except for minor maintenance or emergency repair
lasting less than eight (8) hours and performed on a vehicle owned by the occupant of the
