Exh 8BAGENDA ITEM #8B APRIL 25, 200 CITY OF ATLANTIC BEACH CITY COMMISSION MEETING STAFF REPORT AGENDA ITEM: Proposal for City Acquisition of Seminole Road Ditch "Spite Strips" SUBMITTED BY: Rick Carper, P.E., Public Works Director DATE: April 11, 2005 BACKGROUND: Following receipt of a Notice of Violation letter from the Code Enforcement Officer for uncontrolled vegetation, some owners have indicated a preference to transfer the land to the city rather than be responsible for controlling growth on the strips. This property (approximately a 10 foot strip) lies between the Seminole Road ditch and existing backyards for homes fronting on Sea Oats Drive or 17~' Street. In the early 90's, the City began a cleanup of this area, but was stopped by a homeowner's threatened legal action. At that time it took aseven-man crew nearly a month to clean up about half the ditch line. Options: Commission may elect to not acquire the parcels under .discussion. If not acquired, the Commission must decide if the provisions of City Code Chapter 12, Section 12-1 (b) (11) with respect to vegetative growth are applicable (See Attachment A). {f the Code cited is not applicable, the owners require no action and parcels may be left in their natural state. If the Code is applicable, Commission may choose to enforce the actions recommended by the Code Enforcement Officer (clean up by owner or referral to the Code Enforcement Board) or may choose to waive the requirement by considering the parcels to not be a part of the developed land. Should the Commission wish to proceed with acquisition, there are again two options for parcel clean up: use of City Forces and use of Contract labor. Because of routine maintenance requirements for the Public Works Streets crew during the primary growing season, Staff proposes to allocate not more than 40 man-hours per week to clean up. Estimated cost would be approximately $3500 per month (90°!° manpower), with expected completion late in the year. Estimated time and costs for maintenance after cleanup AGENDA ITEM #3B APRIL Z5, 200 would be 24 man-hours per month at a cost of about $400. As an option to expedite cleanup and reduce impact on Streets Division routine work, the City could advertise for bids for cleanup using contractor forces. This is expected to cost $20,000 (minimum) and would require a budget modification. BUDGET: Total budget impact to be determined. If City Forces to be used for cleanup, manpower and equipment costs to be paid out of current Public Works Streets Division Maintenance accounts. Legal and transfer fees to be paid from City Legal account. RECOMMENDATION: Commission authorize negotiations for acquisition of the 8 parcels listed in Attachment A. Failure to acquire the intervening parcels will greatly complicate cleanup and maintenance because access will have to be across Seminole ditch rather than from the ends. Acquiring subject parcels may provide additional options for extending the Seminole Road Bike Path in future years. ATTACHMENTS: A. Property Owners along Seminole Ditch B. City Code Chapter 12 (Nuisances) Section 12-1 (b): It is hereby declared to be a nuisance, the enumerations of which are merely indications of the nature and type of acts, occurrences and conditions, and shall not be deemed to be exclusive: (11) For any person or business to allow vegetation other than cultivated plants, shrubs, or trees to exceed a height of more than twelve (12) inches on any developed lot, or within twenty (20) feet of any occupied residential property, business property, or city right-of--way.
