SUBMITTED BY: Sonya Doerr, AICP ,~,~ Community Development Director DATE: April 20, 2005 BACKGROUND: This Use-by-Exception is requested to allow for the future redevelopment of property to allow used automobiles sales and repair services. Repair services will be limited to repair of sales inventory vehicles only rather than general automotive repair. The property consists of approximately one-third acre and is currently occupied by residential uses with commercial uses adjacent to much of the site and residential uses located to the east. The Community Development Board considered this request at their March 15th and April 19th meetings, and recommended approval subject to the following condition: Not more than twenty-eight (28) vehicles shall be maintained and displayed for sale at any time. BUDGET: No budget issues. RECOMMENDATION: Approval of Use-by-Exception (File UBE-2005-04) as requested subject to above stated conditions. Present were Robert Frohwein, Sam Jacobson, Carolyn Woods, Craig Burkhart, and Steve Jenkins, Dave MacInnes, Community Development Director Sonya Doerr and Recording Secretary Amber Lehman. 1. Call to Order and Pledge of Allegiance to the Flag. The meeting was called to order at 7: 00 p.m. 2. Approval of 1Vlinutes of the Workshop Meeting and the Regular Meeting • - of March 15, 2005 A motion was made by Dave Maclnnes, seconded by Craig Burkhart, and unanimously carried to approve the Minutes of the Regular Meeting of March 15, 2005. 3. Recognition of Visitors. 4. Old Business. A. UBE-2005-04, Rick's Used Cars, Inc. Request for aUse-by-Exception to ' allow for redevelopment of a property within uses to permit the sale of used automobiles and automotive repair within the Commercial General (CG) Zoning District and located at 1919 Mayport Road. Brenda Frazier, 2602 Lois Lane, stated that she was requesting aUse-By- Exception to develop property on Mayport Road for a used car dealership. Mr. 3acobson asked the applicant what type of buffering they would have between the cars and Mayport Road. Ms. Frazier replied that she would have a 24 foot driveway for entering and exiting the property as well as landscaping in the front driveway. Mr. Jacobson asked the applicant how many cars would be on the lot. Ms. Frazier replied that between Thursday and Saturday there are approximately 25-40 cars on the lot. Ms. Woods asked the applicant if she will be able to house 25-40 cars on the property. Ms. Frazier replied that she would be able to hold that many cars on her lot. Mr. 3enkins asked Ms. Frazier how many parking spaces would be needed. Ms. Frazier stated that she felt that 5 parking spaces were plenty. AGENDA ITEM #8B MAY 9, 2005 Ms. Woods asked how would Ms. Frazier access the dumpster in the back of the building. • Ms. Frazier replied that there is a road to access the dumpster. Ms. Doerr stated that the access road is owned by the city and that it could be possibly be turned into a drainage ditch. Ms. Doerr also stated that the road would be addressed when the applicant submitted construction plans. Mr. 3acobson asked Ms. Doerr about the requirements for the parking spaces. Ms. Doerr stated that there will be a requirement of one parking space for every 300 square feet of building space plus one handicap parking space. Rick Frazier stated that there will only be 20-25 cars on the lot at one time. A motion was made by Mr. Burkhart, seconded by Ms. Woods to recommend approval to the City Commission of the Use-By-Exception with a restriction of 28 cars on the lot at one time. Discussion Ms. Woods stated that she did not think that the board should set a limit on how many cars there can be on the lot at one time. Mr. 3enkins stated that the Mayport Comdor was not addressed in the Comprehensive Plan. Ms. Doerr replied that it had been addressed in the Comprehensive Plan. The vote was called and Mr. Jacobson, Mr. Jenkins, Ms. Woods, Mr. MacInnes, • and Mr. Burkhart voted in favor of the motion, Mr. Frohwein, voted a;ainst the motion. The motion was approved 5 to T~. 5. New Business. • A. UBE-2005-06, Culhane's Irish Pub. Request for aUse-by-Exception to allow for on-premise, consumption of alcoholic beverages (4-COP DABT license) in association with a restaurant within the Commercial General (CG) Zoning District .and located at 967 Atlantic Boulevard within the Atlantic Village Shopping Center. Michelle Culhane, 967 Atlantic Blvd stated that she was requesting aUse-By- Exception to allow for alcohol consumption. Ms. Doerr stated that the City Commission amended the city code which regulates the consumption of alcoholic beverages which now requires the 4- COP DABT license. . ' The proposed site is occupied by single family dwellings that share a common one 10-ft. wide dirt ~ t drive that access Mlayport Road near the northwest comer of'the property. the existing dirt driveway also connects to Dora Street approximately 33-ft. east cf the southwest corner of the . property. The existing drive way is too narrow (the width should be at least 12-ft.) and its location .creates unsafe conditions. The southeriy access off Dora Street is too~close to the intersection of Dora Street and Mayport Road and does not provide sufficient stacking distance to allow a car to enter the drive~,vay while another vehicle is turning right onto Dora Street. The north access onto Mayport Road is too close to Simmons Road and creates the potential for conflict between a ~ ~ ' vehcile turning right off Mayport Road onto Simmons Road and a vehicle trying to turn right onto ~r]ayport Road from the property. • The existing 10-ft. wide dirt drive would make access, by emergency vehicles, to the site difficult. . The existing sidewalk on Mayport Road provides a safe means for pedestrians #o either enter or• ' pass by the site. r ~ Proposed Conditsans As shown on the site plan, the proposed improvements will do away with both~existing access . points. Anew 24-ft wide drive way with 10-ft flares will be constructed 35-ft south of the north . property corner. The proposed width and location correct the problems with the existing driveway ~. .and provide for safe right in -right out turning movements off of and onto Mayport Road. This proposed drive is wise enough to allow easy access by emergency vehicles.. ' The existing sidewalk along Mayport Road in conjunction~with a bew 5-ft. wide walkway from the Mayport Road sidewalk to the proposed building, provide a safe and convenient way for ' ~ pedestrains to access of walk by the site. ,Parking and Loading Spaces, where required,.with particular attention to the items in~(1}above. Response . The parking analysis shown on the site plan indicates a need for 6 parking spaces. These spaces are provided along the south side of the property. A proposed sidewalk between the .. parking spaces and the proposed landscaped buffer provide a safe and convenient. path from a ~ ~ . parked car to the proposed building. Odor Activities associated with the proposed use do not produce offensive or obnoxious odors. Solid waste will be placed in a closed dumpster located on the site and will be removed on a scheduled basis by the City of Atlantic Beach Solid Waste activity.
