THIS CAUSE came for public hearing before the Code Enforcement Board on November 13,
2013 and the Board having heard testimony under oath, received evidence, and heard arguments
respective to all appropriate matters, and thereupon issues the Findings of Fact, Conclusions of Law and
Order as follows:
FINDINGS OF FACT
1. That the Respondent Brenda Howard owns the property located at 1044 Hibiscus St,Atlantic
Beach,Florida.
2. That notice was posted and sent by certified mail and that Respondent was not present at the
hearing.
3. That notification of the violations of the City of Atlantic Beach,were made and served on the
Respondent as evidenced in this hearing.
IPMC Sec.302.8 -Motor Vehicles
"No inoperative or unlicensed motor vehicle shall be parked
or kept or stored on any premises, and no vehicle shall at
any time be in a state of disrepair,major disassembly or
in the process or being stripped or dismantled".
4. The aforementioned property shall be corrected by removal of all inoperable, unlicensed
vehicles from the-premises.
CONCLUSIONS OF LAW
THAT Brenda Howard is not in compliance and has failed to correct such violation as of this hearing
date.
ORDER
Based upon the foregoing Findings of Fact and Conclusions of Law and pursuant to the authority granted
in Chapter 162,Florida Statutes, and the Code of Ordinances of the City of Atlantic Beach, Florida it is
Ordered:
THAT the Respondent is found in violation for non-compliance and must obtain compliance on
or before December 16, 2013. Failure to comply will result in fines of$100.00 for the first-day and
$100.00 for every day thereafter while the violation continues to exist. In addition, any fine shall also
include the administrative costs to the City incurred in prosecuting this case.

Just wanted to let you know that we will not be represented at the next meeting.
There is a question over ownership. While the Duval County Tax Records (website) show my wife as the owner
of,1044 Hibiscus,the Deed we have shows her as the owner of 1046 Hibiscus. I think_ it is a subdivided Single
Lot. I will be contacting a Real Estate Attorney on Tuesday to ask him to resolve the ownership and will then
come back to you.

Dear Ms White,
Thank you for your correspondence over the last week, your assistance was
appreciated.
I would ask that in the circumstances you reduce or waive the'existing fine and
upon resolution remove the Lien
•
We were unaware of any problem at 1044 Hibiscus st until we were informed by
Homefinder Realty on 7th Feb: We.took immediate action to correct and;to
ensure that there is no repeat'of this type of problem by,appointing Homefinder
to manage the property. Through them we agreed to have the Resident issued
with a. Non Compliance Notice and to have the vehicle towed :However'when
Homefinder began those steps they were informedthatthe car had been
removed approx 16th December.
We understand that the noticem frothe city was sent to 411,Ascroft,Landin9
Drive, Jacksonville. And that this notice was sent'as Certified Mail with-�a Return
Receipt Requested. That address is the former home of my wife's deceased sister
We have no idea.who signed for that mail but we received no correspondence.of
any form until contacted by Homefinder:
We'now have the correct form to update our mailing address to that of
Homefinder in Atlantic Beach and will be doing so with immediate effect.'
