Exh 8CAGENDA ITEM #3C JUNE 13, 2005 CITY OF ATLANTIC BEACH CITY COMMISSION MEETING STAFF REPORT AGENDA ITEM: Acceptance of Ownership and Maintenance Responsibility for Public Improvements within and by the Paradise Preserve Subdivision SUBMITTED BY: Rick Carper, P.E., Director of Public Works Donna Kaluzniak, C.E.P., Director of Public Utilities Sonya Doerr, AICP, Community Development Director DATE: June 3, 2005 BACKGROUND: As discussed by Land Development Regulations, Article 24-235, all requirements for a Certificate of Completion for improvements dedicated to the City have been accomplished. The improvements covered by this Certificate include water and sewer systems and the sanitary lift station within the Paradise Preserve development, as well as drainage, paving and sidewalk construction within the City's Dutton Island Road Right of Way. Construction of these improvements was monitored and inspected by City Forces, and all testing has been accomplished satisfactorily. In addition, although the streets and stormwater drainage system inside the development will be privately maintained, construction of these improvements was done to City standards. Based on completion and acceptance of these public improvements, restrictions on the approval of future building permit applications for the remaining parcels in Paradise Preserve may be lifted. While infrastructure improvements for the subdivision have been completed, the Community Development Directorwishes to inform the City Commission of an outstanding issue related to the Paradise Preserve PUD. The adopted PUD ordinance requires 0.86 acres of Parks and Open Space. The approved Site Plan (attached) provided for a landscaped park area within the interior of the loop road. Revisions to the project's drainage engineering and SJRWMD stormwater permits required a portion of this park area to be used for additional retention. Staff has advised the Applicant that an alternative location, or development of Parcel D in a manner that will serve as a landscaped neighborhood park with adequate space for the amenities called for in the PUD must be provided or approval of a modification to the PUD ordinance, by the City Commission, would be required. Staff is working with the Applicant to resolve this issue in a manner that is consistent with the terms of the approved PUD. RECOMMENDATION: That the City accept ownership and maintenance responsibility for the water and sewer systems and the sanitary lift station within the Paradise Preserve development and for the drainage, paving and sidewalk construction within the City's Dutton Island Road Right-of--Way.
