Mayor 13, Adjourn MINUTES OF THE REGULAR MEETING OF THE ATLANTIC BEACH CITY COMMISSION HELD AT THE CITY HALL ON MONDAY, DECEMBER 8, 1975, AT 8:00 P. M. PRESENT: William S . Howell, Mayor-Commissioner James E. Mhoon Alan C. Jensen Robert B. Cook, Sr. L. W. Minton, Jr. , Commissioners AND: R. C. Vogel, City Manager Oliver C. Ball, City Attorney Adelaide R. Tucker, Acting City Clerk The meeting was called to order by Mayor Commissioner, Mr. Howell . The invocation was given by Commissioner Minton, followed by the pledge to the flag. The minutes of the meeting of November 24, 1975 were approved as written upon a motion by Commissioner Minton, seconded by Commissioner Jensen and carried. The minutes of the special called meeting of December 3, 1975 were approved as written upon a motion by Commissioner Minton, seconded by Commissioner Jensen and carried. Bid Opening - Workmen' s Compensation, etc , The first bid opened from Kramer, Wurn, Gay & Petway Insurance Company was in the amount of $276.00 and covered item No. 9 only of the specifications (specified hazard insurance for police and firemen - $20, 000.00 on the job accident insurance) . The second bid opened from Hartford Accident & Indemnity Company was in the amount of $27, 895.00 and included all 9 items of the specifications. There were no other bids submitted. It was moved by Commissioner Mhoon and seconded by Commissioner Cook that the bids be received and reviewed by a committee. The Mayor appointed a committee of himself and Commissioners Cook and Minton whose recommendations will be presented at the next regular meeting of the City Commission on December 22, 1975 . PUD Ahern Street and Sherry Drive - Public Hearing A plot plan was presented by George Bull, Jr , , Architect, for D. Lee Ross, owner of the property located at Ahern Street and Sherry Drive - N. E. corner. The Mayor explained this is an application for PUD and it was pointed out that this planned unit development has the approval of the Atlantic Beach Planning Board. The unit contains five town-house type apartments with 8 (eight) off street parking spaces, the plat of ground is 125 ' by 70 ' . Mayor Howell then declared the meeting in session for a public hearing. The question was asked from the audience if the people in the neighborhood had been notified. They were Minutes December 8, 1975 Page #2 PUD Ahern Street and Sherry Drive - Public Hearing Continued informed that all property surrounding the proposed project were multi-family or motels. There being no further comments the Mayor declared the public hearing closed. It was moved by Commissioner Mhoon, seconded by Commissioner Minton that the plat be approved. Mr. Bull was advised the detailed plans and specifications would have to be approved by the Commission at a later date. BEACHES Study Commission - Proposal from Mr. John Morris Mr. John Morris stated that he was appearing as a citizen of Atlantic Beach interested in the operation of the City, and not as a member of the Beaches Study Commission. A copy of the statement made by Mr. Morris is attached hereto and made a part hereof. ORDINANCE #5-75-3 - Salary - Commissioners Commissioner Cook read Ordinance No. 5-75-3 on salary for Commissioners on first reading by title only. Said Ordinance was presented in full, in writing. Commissioner Cook moved that Ordinance No. 5-75-3 be approved on first reading by title only, seconded by Commissioner Minton and carried unanimously. Commissioner Cook asked for and was granted recognition to present the Ordinance for the second reading. There being no objection Commissioner Cook read the Ordinance by title only for the second time. It was moved by Commissioner Cook, seconded by Commissioner Minton and carried unanimously. Mayor Howell called for a public hearing December 22, 1975 . LAND Acquisition for Sewer Plant and Public Works The agreement entered into this 8th day of December, 1975 is attached hereto and made a part hereof and was passed by the City Commission unanimously. The City Attorney was instructed to consummate the transaction by the first of the year. RESOLUTION #75-25 - Beaches Aquatic Club - Ad Valorem Taxes Assessment. Upon the advice of the City Attorney, the City Commission passed Resolution #75-25 upon the motion of Commissioner Cook, seconded by Commissioner Mhoon. Said Resolution is attached hereto and made a part hereof. RESOLUTION #75-26 - 20 year ad Valorem Taxes Mayor Howell read resolution #75-26 concerning out-dated ad valorem taxes. Commissioner Mhoon moved and Commissioner Minton seconded passage of this resolution. Said resolution was adopted without objection and is attached hereto and made a part hereof. Minutes December 8, 1975 Page #3 RESOLUTION #75-27 - Saltair S/D Water & Sewer Mayor Howell read Resolution 75-27 concerning double assessment on lots 581, 593 and 594, Section 1 Saltair Subdivision. Commissioner Minton moved and Commissioner Mhoon seconded passage of this resolution. Said resolution was adopted with- out objection and is attached hereto and made a part hereof. ORDINANCE #58-75-4 - City Employees ' Pension Plan Mayor Howell read the title of Ordinance #58-75-4 City Employees ' Pension Plan on first reading. It was moved by Commissioner Minton, seconded by Commissioner Cook and carried, Mayor Howell read the title of Ordinance #58-75-4 City Employees ' Pension Plan on second reading. It was moved by Commissioner Cook, seconded by Commissioner Jensen and carried. Public hearing was set for December 22, 1975. SIGN POLICY Mr. Vogel read a brief statement concerning the installation of signs and traffic control devices and recommended the Commission approve the new installation of all traffic control devices . The Mayor pointed out to the City Manager that he was the Director of Public Safety and as such had charge of the enforcement of the model traffic ordinances which come within purview of the Director of Public Safety. MEMBERSHIP in the Florida Shore and Beach Preservation The City Manager requested concurrence of the City Commission to join the Florida Shore and Beach Preservation organization. Mayor Howell pointed out that we formerly belonged to the organization and the Commission agreed to this membership. DIRECTOR of Public Works Mr. Hilliard asked the Commission to sanction development of street ends on the south end of 6th Street down to 1st Street. Mayor Howell suggested he bring the special call meeting on December 15, 1975 a proposal so that it may be discussed at that time. Minutes December 8, 1975 Page #4 _ Corrected COMMISSIONER Jensen Commissioner Jensen made a suggestion the City Manager look into the feasibility of hiring someone to manage the Tennis Courts so that a plan could be developed that would permit the local citizens more access to the courts. He stated he had approxi- mately five calls concerning this complaint. Mayor Howell suggested that the City Manager and Commissioner Jensen look into this and come up with a plan. Mr. Parks submitted a report on review of proposed plans for the development in Saltair S/D. There was a brief discussion con- cerning the report and the Mayor recommended each Commissioner be given a chance to review the report so that they may be better informed on the details. A special meeting was called December 15, 1975 at 8:00 P. M. to consider Mr. Parks ' recommendations . Howell , Mayor Subject : Compensation for Elected Officials In a recent study comparing the compensation of elected officials , we find Atlantic Beach somewhat dated in its methods of compen- sation . Atlantic Beach ranks in the top 26% of incorporated municipalities in the state ; therefore , we can no longer consider ourselves a small city . Our size , the increase in demand for the time required to govern and manage our city , the many new Federal and State regulations that must be dealt with in intricate detail and the other growing list of new problems that face our elected officials , indicate the necessity for an immediate change in our compensation practices . • We all enjoy living in a city that is efficiently run . We enjoy the reasonable rates for services and the effective response of our elected officials . It is time we started paying a reasonable salary to the people that make it possible . Attached is a list of 29 cities in the state , ranging from some of the smallest population to many close to the same size as Atlantic Beach . Based on these figures , and the demand for more attention from our officials to efficiently operate our city , we propose an increase in compensation that would bring Atlantic Beach more closely in line with these other cities . We feel the Mayor should receive $200 to $300 per month , and each commissioner $100 to $200 per month . PASSED BY THE CITY COMlISSION ON: btk. j_j17,5 �_ ATiEST: (SEAL) '��City Clerk RESOLUTION NO. 75-26 WHEREAS, the most recent audit report, dated September 30, 1975 of the financial position of the City of Atlantic Beach, Florida, on Page 4 thereof, reflects the amount of $535.00 of ad valorem taxes due the City of Atlantic Beach; the assessments being over twenty years past due, and WHEREAS, Chapter 197.236 (Chapter 73-332) Florida Statutes imposes a twenty year limitation on collection efforts for delinquent taxes outstanding prior to July 1, 1973 and further imposes a seven (7) year limitation on collection efforts for delinquent taxes outstanding subsequent to July 1, 1973, and WHEREAS, the necessity of keeping records on the delinquent taxes over the seven year limitation is an unnecessary burden and bother; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF ATLANTIC BEACH, FLORIDA, AS FOLLOWS: 1. City Cle 111, RESOLUTION #75-27 WATER AND SEWER ASSESSMENTS BELVEDERE STREET SALTAIR SUBDIVISION WHEREAS, a Special Sewer Assessment No. 60-6 has provided for a Special Sewer Assessment on Lots 581, 593, 594 among others in Section 1, Saltair Subdivision, and WHEREAS , Resolution #73-10 Special Sewer Assessment has provided for a Special Sewer Assessment encumbering Lots 581, 593, 594, Section 1, Saltair Subdivision, and WHEREAS, this double assessment has recently been discovered in the Official Assessment Records of the City of Atlantic Beach; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF ATLANTIC BEACH, FLORIDA, AS FOLLOWS : 1. That the City Clerk is hereby directed to expunge all Allrecords in order to remove the double assessment. The City Clerk is also directed to refund to the owner of Lot 581, Section 1, Saltair Subdivision the over-payment in the amount of $572 . 24 plus 6% per annum interest since time of payment. 2. That the City Clerk is also directed to remove from the roll an assessment against Lot 593 in the amount of $705. 79 and an assessment against Lot 594 in the amount of $832 . 59.
