MINUTES OF THE REGULAR MEETING OF THE ATLANTIC BEACH CITY COMMISSION
HELD AT THE CITY HALL ON MONDAY, OCTOBER 27, 1975 at 8:00 P . M.

The meeting was called to order by Mayor-Commissioner, Mr. Howell.
The invocation was given by Commissioner Fogg, followed by the
pledge to the flag.
The minutes of the meeting of October 7 , 1975 were approved as
written upon a motion by Commissioner Fogg, seconded by Commissioner
Cook and carried.
The minutes of the meeting of October 13, 1975 were approved as
written upon a motion by Commissioner Fogg, seconded by Commissioner
Rosborough and carried.
The minutes of the meeting of October 21, 1975 were approved as
written upon a motion by Commissioner Rosborough, seconded by Com-
missioner Fogg and carried.
Mayor Howell stated that the City Commission is very pleased to
have with us tonight Commissioner-elect Jensen and Commissioner-
elect Mhoon. They will be sworn into office on November 4, 1975
at 8:00 P . M.
Correspondence
Mr. Vogel stated that Mr. Joe Bell, a representative of Milo-Smith,
has made an appointment to meet with the Advisory Planning Board
Tuesday at 8: 00 at the City Hall for the purpose of discussing the
plan that Milo-Smith is doing for the City of Atlantic Beach.
Everyone is invited. The City Commission needs to appoint a
commissioner as a lia.aion to the Advisory Planning Board. Mayor
Howell appointed Commissioner-elect Jensen.

Higley Publishing Corporation - Saltair Subdivision
Mr. Pete Johnson, Higley Publishing Corporation, stated that several
weeks ago they requested closing Circle Street and Palm Avenue be-
tween Plaza and Seminole Road, and the southerly 150 feet of Cypress
Street. They have since gone back to the drawing board, as was
suggested by the commission, and what the Higley Publishing Corpora-
is now proposing to do is deed to the city a portion of the pro-
perty that they now own which totals 18,878 square feet in ex-
change for acquiring, after closing is complete, land totaling 18, 137
square feet. Mr. Johnson stated that he feels the road serves no
useful purpose.
Mayor Howell stated that in order to keep the record straight, that
basically what the Higley Publishing Corporation is asking is that
the city start proceedings to close the street by ordinance and
that the instant this is accomplished, if the ordinance goes to
the final phase and is passed, then the Higley Publishing Corporation
would deed back to the city 18,878 square feet of property. Mayor
Howell stated that this action taken tonight does not approve the
layout as to a plat; does not guarantee sufficient capacity at
the sewer plant for these number of lots and/or sufficient capacity
for water. Mr. Johnsen stated that this ordinance only speaks to
the closing of the streets. Until this action is disposed of, one
way or another, the Higley Publishing Corporation cannot proceed
with further plans .
Commissioner-elect Mhoon asked if in the master plan of the city,
does this road have any value as far as future development is
concerned? Mayor Howell stated "no" , inasmuch as Higley Publishing
Corporation owns all of the surrounding property they would be
forced to design their subdivision to take everything else into
consideration.
Mr. Hilliard asked if the football field is in the area that will
be deeded to the city? Mr. Lamp, architect for the subdivision,
stated that none of the park facilities encroach on what they propose
to lay out .
Ordinance No. 65-75-6 - Closing Circle Street and Palm Avenue
Mayor Howell read Ordinance Nc. 65-75-6 closing, vacating, and
abandoning those certain streets known as Circle Street and Palm
Avenue between Plaza and Seminole Road on first reading by title
only. Said ordinance was presented in full, in writing .

Commissioner Rosborough moved that Ordinance No. 65-75-6 be approved
on first reading by title only, seconded by Commission Cook and
carried.
Selection of Member for Advisory Planning Board
Mayor Howell stated that the name of Mr. John Andresen, 1668 Park
Terrace, East, has been submitted as a replacement on the Advisory
Planning Board by Bob Wardrep, Chairman. It was moved by Commis-
sioner Fogg, seconded by Commissioner Rosborough and carried that
Mr. John Andresen be appointed to the Advisory Planning Board.
Commissioner Fogg
Commissioner Fogg stated that he would like to express his appre-
ciation for the cooperation cf this commission. It has been a
pleasure to be part of it.
City Attorney
Mr. Ball stated that the City of Atlantic Beach is being sued.
As you will recall, the city has been negotiating with the owner
of Lct 147 Saltair for several years. They are contending that the
city has condemned their land without adequate compensation. It is
known as a reverse condemnation. Passed negotiations have failed
and now the owner is taking it to court.
rr. Ball further stated that during Commissioner Rosborough' s
first term he was instrumental in getting the Mayor elected to the
Board of Directors of the Florida League of Cities. Mayor Howell
has just been re-appointed for a fourth term. Commissioner Ros-
borough should be congratulated for getting this going . The Mayor
is a long term member of the board and has been appointed to some
serious state and nationwide committee chairman concerning munici-
palities.
