MINUTES OF THE REGULAR MEETING OF THE ATLANTIC BEACH CITY COMMISSION
HELD AT THE CITY HALL ON MONDAY, SEPTEMBER 8, 1975, AT 8: 00 P . M.

ABSENT: None
The meeting was called to order by Mayor-Commissioner, Mr. Howell .
The invocation was given by Commissioner Minton, followed by the
pledge to the flag.
The minutes of the meeting of August 25, 1975 were approved as
written upon a motion by Commissioner Fogg, seconded by Commissioner
Rosborough and carried.
Recognition of Visitors
Mrs. Ruth Gregg, 905 Sailfish, wanted to know why the JEA emergency
repair man had been taken away from the beaches? Mayor Howell stated
that he was unaware that the JEA had done this. Mrs. Gregg stated
that JEA gives an emergency number to call and the only response
she gets is a recording. She stated that the repair man' s number is
not listed in the telephone book and the residents of the beaches
have no way to contact him. Mayor Howell stated that his number
has not been in the telephone book for sometime but that the Police
Department is able to contact him. He stated that he would look in-
to this matter.
Ordinance No. 20-75-30 Budget 1975-76 Second Raadinq
Mayor Howell read Ordinance No. 20-75-30 adopting the budget for the
City of Atlantic Beach for the fiscal year 1975-76 on second reading
by title only. Said ordinance was presented in full, in writing.
Commissioner Cook moved that Ordinance No. 20-75-30 be approved on
second reading by title only, seconded by Commissioner Fogg and
carried. Public Hearing to be held September 22, 1975.

Ordinance Noe 10-75-12 C,O ,P , License for Letizia ' s Restaurant
Mayor Howell read Ordinance No. 10-75-12 regulating hours for th.
sale of alcoholic and intoxicating beverages in the City of Atlantic
Beach on second reading by title only . Said ordinance was presented
in full, in writing . Commissioner Cook moved that Ordinance No,
10-75-12 be approved on second reading by title only, seconded by
Commissioner Fogg and carried. Public Hearing to be held September
22, 1975.
Resolution No. 75-13 Technical Advisory Board
Mayor Howell presented Resolution No. 75-13 ratifying the action of
the Technical Advisory Board of the Duval Beaches 201 Planning Area .
It was moved by Commissioner Minton, seconded by Commissioner Cook
and carried that Resolution No. 75-13 be adopted. Copy of said
resolution is attached hereto and made a part hereof,
Ordinance Noe 95-75-14 Disposal of Unclaimed Property - First Reading_
Mayor Howell read Ordinance Noa 95-75-14 providing for the sale,
destruction or disposal of unclaimed or confiscated personal proper-
ty on first reading by title only. Said ordinance was presented in
full, in writing. Commissioner Minton moved that Ordinance Noo
95-75-14 be approved on first reading by title only, seconded by
Commissioner Rosborough and carried.
Bobby McGee - 1445 Mayport Road - Request for C.O.P . License
Item 6E on the agenda does not require any action by the City
Commission.
Pizza Hut - Request for Utility Shed
Mr. David Sapp, manager of the Pizza Hut, 815 Atlantic Boulevard,
requested a permit to locate a white aluminum portable building
next to the Pizza Hut. The shed to be used for storage of paper
products and non-perrishable food items. The building will be of
solid construction and have dimensions of 5 ' x 7 ' with a built in
floor. Mayor Howell asked if this particular shed meets the South-
ern Standard Building Code? Mr. Sapp stated that according to
the seller, it meets all the building requirements.

Mr. Vogel stated that in order to issue a permit he would need a
written statement signed by a responsible official of the Southern
Standard Building Code office that it meets the code. Commissioner
Fogg moved, seconded by Commissioner Rosborough and carried that if
the shed meets the Southern Standard Building Code and all the re-
quirements of the city that the plans be approved.
Fred Mills - Construction in Business B
Fred Mills presented plans and specifications for an addition to a
building presently located on the North 100 feet of Lot 4, Block 4,
Donners Replat; a new building located at 40 Roberts Street and one
located at 20 Roberts Street for a total of approximately 5,000 sq.
feet. He explained that the building located at 40 Roberts Street
would be a paint shop and that parking would be provided in the
interior of the building with an additional nine parking spaces out-
side the building. Mayor Howell stated that he did not think that
the parking within the building could be considered as parking
facilities . He stated that should the building be rented for any
other purpose, other than what the commission approves tonight, an
occupational license can not be obtained unless adequate parking
facilities are provided. Mr. Mills stated that if and when the
building is used for some other purpose, the required number of
parking spaces will be provided. It was moved by Commissioner
Rosborough, seconded by Commissioner Fogg and carried that the plans
and specifications be approved provided the plans and specifications
meet the zoning and all the requirements of the City of Atlantic
Beach.
Purchase of Twenty (20) Containers from Hydraulic Systems
Mr. Hilliard recommended to the city commission that the city pur-
chase an additional 20 rear load containers from Hydraulic Systems,
Ince Their bid, which was submitted August 6, 1975, is the lowest
price the city has had on containers for sometime. Mr. Hilliard
stated that he has been disposing of the containers that have rusted.
He stated that there is enough money in this years budget to pay
for the additional containers. It was moved by Commissioner
Minton, seconded by Commissioner Rosborough and carried that an
additional 20 containers be purchased from Hydraulic Equipment
Systems, Ince

for the Primary Election of October 7, 1975° The officials will be
paid the minimum wage per hours

Commissioner Minton moved for approval as requested, seconded by
Commissioner Cook and carried.
There being no further business, Mayor Howell declared the meeting
adjourned.

tions agreeing to cooperate with the other municipalities located within the Duval
Beaches 201 Planning Area in the participation, with the Federal Government,
or the appropriate agency thereof, in a 201 Facilities flan for the treatment
and disposal of sewage in the Duval Beaches 201 Planning Area for abatement
of pollution; and
WHEREAS, the City of Atlantic Bea( h, 1"loritia, the City of Jacksonville
Beach, Florida, and the City of Neptune Beach, Florida, have each agreed that
it is deemed necessary and advisable to seel:. Federal assistance for said 201
Facilities Plan for the Duval Beaches Planning, Area; and
WHEREAS, The City of Atlantic leach, Florida, the City of Jacksonville
Beach, Florida, and the City of Neptune reach, Florida, have each passed resolu-
tions appointing two representatives each to the Duval Beaches 201 Planning Area
Technical Advisory Board to represent and provide liaison between the partici-
pating communities and the Engineers in the preparation and submission of an
application for Federal assistance for planning grant funds under Public Iaw
92-500, and, further, to aid, guide and assist the Engineers in the development
and preparation of the 20l Facilities Plan fur the. Duval Beaches Planning Area;
and
