M. PRESENT: William S. Howell, Mayor-Commissioner L. W. Minton, Jr. Robert Rosborough, II F. W. Fogg Robert B . Cook, Sr. , Commissioners AND R. C. Vogel, City Manager Oliver C. Ball, City Attorney Gloria June Knight, City Clerk ABSENT: None The meeting was called to order by Mayor-Commissioner, Mr. Howell. The invocation was given by Commissioner Minton, followed by the pledge to the flag. Approval of the Minutes of April 28, 1975 Commissioner Rosborough stated that the following corrections should be made on the minutes of April 28, 1975. Under "Health and Acci- dent Insurance" , Page 4, the specifications should show a semi- private room rather than prevailing rates. The prevailing rates change and it should read "daily rate will be a semi-private room. " Also, the specifications should show a maximum on basic and then 80/20 with $100.00 deductible and unlimited Major Medical. The basic should be $2000.00. Commissioner Rosborough moved for approval of the minutes subject to the corrections. The motion was seconded by Commissioner Fogg and carried. Recognition of Visitors Mr. James DiPietro, 785 Plaza, requested permission to erect a five foot fence in front of his property. He stated that he was trying to keep people from trespassing. Mayor Howell stated that according to the city laws, the area between the front property line and the front building set back line, no fence or wall shall exceed four feet in height. Mr. DiPietro stated that there has been two serious accidents in front on his house and requested a traffic light be placed at Royal Palms and Plaza. Mayor Howell instructed the Director of Public Works to install some type of barricade, i.e. , telephone poles with reflectors, on city property in front of Mr. DiPietro ' s house. MINUTES MAY 12, 1975 PAGE TWO Reubin Bennett Re: Mobile Home in Section H Mayor Howell stated that in going back through the minutes, the Bennett ' s appeared before the City Commission; then they went before the Planning Board; the Planning Board recommended approval for a mobile home in Section H; there was a public hearing; there were no objections at the public hearing but no action was taken. He stated that the City Commission should either accept this request or deny it. Mayor Howell stated that the City Commission has since changed the procedure and are not allowing mobile homes anywhere in the city except in mobile home parks. Mrs. Bennett stated that she would very much like to have the approval of the City Commission on this request. Commissioner Fogg stated that he thought the consensus of the City Commission was that no mobile homes be allowed in Atlantic Beach except in mobile home parks . A trailer cannot be built to conform to the Southern Standard Building Code . Mrs . Bennett stated that at the time she made application, this was not the rule. Commissioner Fogg stated that each time a mobile home permit was granted it was an exception to the Code of the City of Atlantic Beach. Commissioner Rcsborough stated that a previous meeting he had made a motion, which was seconded and carried, that no mobile homes be allowed in Atlantic Beach except in mobile home parks. (This action was taken at a meeting of the Advisory Planning Board and the City Commission. Commissioner Minton moved for approval of this request. The motion died for a lack of a second. Commissioner Fogg moved that this re- quest for a mobile home in Section H be denied, seconded by Com- missioner Rosborough. The vote was: Aye - Commissioners Fogg, Rosborough, Cook and Mayor Howell. No - Commissioner Minton. Bid Opening Tractor for Public Works The following bid was opened: Jacksonville Ford Tractor Company, Inc . $2,725.00 No other bids were received. Commissioner Rosborough moved, seconded by Commissioner Fogg and carried that the bid be awarded to Jacksonville Tractor Company after the specifications have been reviewed by the City Manager and Mr. Hilliard. MINUTES MAY 12, 1975 PAGE THREE Health & Accident Insurance Re: Memorandum Mr. Vogel stated that he had sent the City Commission a memo re- commending that the city accept the bid of Metropolitan Life Insurance Company, the lowest and best bid to both the city and to the employee. Commissioner Rosborough contacted the Peninsular Insurance Company regarding a letter received from them advising the city of a price increase. Commissioner Rosborough reported that Peninsular Insurance Company could not justify their rate increase. Mr. Vogel stated that he had contacted the Metropolitan Life Insurance Company and they will still perform under the existing bid. Commissioner Rosborough stated that he was on the committee for awarding the bid and he vividly remembers that Pilot Life and Metropolitan were the two lowest bidders. Metropolitan was the closest to the specifications. Mayor Howell stated that the City Commission could not award the bid to- night because it will require a budget change at the next meeting. Commissioner Rosborough moved that the City Commission accept the recommendation of the City Manager and award the Health, Accident and Life insurance to the Metropolitan Life Insurance Company subject to transferring funds from one account to the group insurance account in order to pay the premiums. The motion was seconded by Commissioner Fogg and carried. Ordinance No. 95-75-13 Mayor Howell read Ordinance No. 95-75-13 amending by adding thereto Section 4-4 of the Atlantic Beach City Code entitled "Animals and Fowl" on first reading by title only. Commissioner Minton moved that Ordinance No. 95-75-13 be approved on first reading by title only, seconded by Commissioner Rosborough and carried. Committee Report Re: Tennis Courts and Restrooms Commissioner Fogg reported that in reply to the petition received by Commissioner Minton requesting that a sign be placed at the tennis courts to read "these courts available to Atlantic Beach residents and their invited guest only", a sign has been placed that reads "Atlantic Beach residents have priority" . A fair amount of studying has been done regarding building new courts and up-grading the lighting. A new court just north of the existing courts will re- quire fill dirt and grading. Commissioner Fogg stated that a recom- mendation will be made for the next budget to build a new tennis court. MINUTES MAY 12, 1975 PAGE FOUR A. L. Outlaw & Associates; Proposed Subdivision Fred Ahern, 14500 Beach Boulevard, Jacksonville Beach, stated that he represented owners George Pharr, Justin Montgomery, A. L. Outlaw and himself. He stated that they owned approximately 46 acres of land located at the end of Levy Road. He appeared before the City Commission approximately 1-1/2 years ago and requested that this piece of property be zoned under the P .U.D. for a mobile home park. This request was granted. Mr. Ahern stated that he was here tonight in order to request the re-zoning of this property to single family. He has researched the economy of the development of mobile homes and finds that under the present day situation it is not economically feasible. The owners uo uld like to develop the area with approxi- mately 115 single family residence under the P.U.D. The houses are to sell for $30,000 to $35,000. Mr. Ahern also requested that the City Commission consider the possibility of making an exception on the present zoning ordinance which requires 1200 square feet to be reduced to 1050 square feet. Secondly, Mr. Ahern stated that re- cognizing that the water and sewage situation in Atlantic Beach is approaching a maximum usage, he requested that water and sewer be reserved for the first 30 units of the development. Mayor Howell stated that several years ago this was zoned for a mobile home park and about one year ago Mr. Outlaw came before the City Commission with a plan for putting in apartments. At that time, the City Commission informed him that the possibility of getting connected to the city sewer system was practically impossible. Mr. Outlaw stated at that time, if the city did not have adequate sewer and if he could obtain sewage facilities in another form, that the City Commission would consider approval of that. Mayor Howell stated that our sewer situation is not any better and he certainly would not consider reserving "X" numbers of units to hook on a sewer system at some time in the future. On the reduction of square footage, if the city is going to reduce the square footage in one area, the city will have to reduce the square footage in another area. Mayor Howell stated that the only action that could be taken tonight is to refer this request to the Advisory Planning Board. So far as hooking onto our sewer system is concerned, even if the Advisory Planning Board recommends approval of your plans, the city is at capacity. MINUTES MAY 12, 1975 PAGE FIVE Mr. Ahern requested that the City Commission grant them the previous option, to install a package plant. Mayor Howell stated that if the developers get approval for a package plant, the city will not take over the operation. It was moved by Commissioner Fogg, seconded by Commissioner Rosborough and carried that this request be turned over to the Advisory Planning Board. Lee Ross & George Bull, Jr. : Application for P .U.D. Ahern & Sherry Mr. George Bull, Jr. , Atlantic Beach, stated that he would like to make application for P .U.D. for five townhouses located on Ahern Street and Sherry Dive. Commissioner Minton moved for approval of this request, seconded by Commissioner Fogg and carried. W. R. Lovett, 287 Atlantic Boulevard Mr. Vogel stated that the City Commission had already approved this request for an addition to the building located at 287 Atlantic Boulevard. The plans were submitted to the City Commission. It was moved by Commissioner Fogg, seconded by Commission Minton and carried that the plans submitted be approved. Mr. Buffkin Re: Main Street Mr. Buffkin stated that he has a problem at his trailer park located on Mayport Road and Main Street. On the portion of Main Street going through his trailer park, this section has become a thorough- fare and needs to be paved or closed off. Mr. Hilliard stated that this particular section of Main Street serves no useful purpose. There are no utilities on this street. The base traffic use the trailer park for a shortcut to Atlantic Boulevard. Commissioner Minton moved that the City Attorney prepare the necessary ordinance for abandoning a portion of Main Street running through Mr. Buffkin' s trailer park for presentation at the next meeting. The motion was seconded by Commissioner Fogg and carried. Mr. Hilliard reported that the Public Works Department has made a good start on the addition to the parking lot behind City Hall. Mr. Vogel stated that he had contacted a firm in Detroit, Michigan to do an actuarial study for establishing a pension for all city employees. This firm can be hired for approximately $400.00. Mr. Vogel stated that this was information only to advise the City Commission of his plans. MINUTES rt.. MAY X 1975 PAGE SIX Oliver C. Ball, City Attorney, reported that he had been directed by the City Commission to make an offer for Lot 147 Saltair Section I . He made the offer. There has been no written reply but the attorney for the owner informs me that he is preparing suit to collect more than the $3100.00 the city offered. Mr. Ball recommended that at this time the City Commission should not take any action regarding this property.
