Adjourn MINUTES OF THE REGULAR MEETING OF THE ATLANTIC BEACH CITY COMMISSION HELD AT THE CITY HALL ON MONDAY, FEBRUARY 10, 1975, AT 8:00 P . M. PRESENT: William S. Howell, Mayor-Commissioner Robert R. Rosborough, Mayor Pro Tem F. W. Fogg Robert B. Cook, Sr. , Commissioners AND R. C. Vogel, City Manager Oliver C. Ball, City Attorney Gloria June Knight, City Clerk ABSENT: L. W. Minton, Jr. , Commissioner The meeting was called to order by Mayor Pro Tem, Mr. Rosborough. The invocation was given by Commissioner Cook, followed by the pledge to the flag. The minutes of the meeting of January 27 , 1975 were approved as written upon a motion by Commissioner Cook, seconded by Commissioner Fogg and carried. Recognition of Visitors Mrs. William Koening, 780 Redfin, asked about the possibility of placing "No Passing" signs on Plaza and Royal Palms Drive. Mayor Pro Tem Rosborough stated that signs might help the situation in the Royal Palms area but that possibly the citizens might take down the tag numbers of the people speeding and turn them over to the Chief of Police or City Manager. They will then be placed on record of having violated the law as reported by a citizen. Mr. Vogel reported that the city hopes to put a sidewalk down Plaza in the near future. Mrs. Ruth Gregg, 905 Sailfish Drive, wanted to know why the blind corners in Royal Palms Subdivision have not been cleared? She stated that the scrubbery was particularly high at Sailfish and Plaza; Redfin and Royal Palms. Mr. Vogel stated that he would check these two corners and see what could be done. Correspondence Mayor Pro Tem Rosborough read a letter from Mrs . Sandra Bragan, 14443 Stacey Road, Jacksonville Beach, requesting that something be done about the dogs running loose on the beach. He stated that the City of Atlantic Beach does not have a lease law, but the dogs should be under voice command. The city uses the service of Animal Control from Jacksonville. Anyone wishing to report stray dogs should call the Chief of Police and they will relay the complaint to Animal Control. The City Commission received a request for an extension of seven days on the bid by Garrison-Younger-Sheftall & Ryan. It was moved by Commissioner Fogg, seconded by Commissioner Cook and carried that the extension for Garrison-Younger-Sheftall & Ryan be denied. It was moved by Commissioner Fogg, seconded by Commissioner Cook and carried that the bids be referred to committee for study and re- commendations. Mayor Pro Tem Rosborough appointed Mayor Howell, R. Co Vogel and himself to serve on this committee. Rueben Bennett - New Additcn of Building, Seminole Road & Atlantic Boulevard Mr. Vogel presented plans for a proposed addition to a building located at Atlantic Boulevard and Seminole Road. After discussion, it was moved by Commissioner Cook, seconded by Commissioner Fcgg and carried that approval of Mr. Bennett ' s plans be deferred until such time as Mr. Bennett is present in order to explain the use of the building. MINUTES FEBRUARY 10, 1975 PAGE FOUR Mrs. Knight requested permission to attend the City Clerk' s Seminar April 6-9th in St. Petersburg, Florida. It was moved by Commissioner Cook, seconded by Commissioner Fogg and carried that Mrs. Knight be given permission to attend. The vote was Ayes - Commissioners Cook,Fogg and Mayor Pro Tem Rosbcrough Pass - Mayor Howell Mr. Vogel stated that in our existing zoning ordinance everything, other than Residence AA, refers back to Residence A in regard to set back lines. Residence A requires not less than 20 feet. A problem will arise if a subdivider exceeds the set back line by 5 or 10 feet. If someone wants to invade that line based cn our ordi- nance with a 20 foot set back, this will create an outset in the block. Mr. Vogel stated that the ordinance should be amended to eliminate future problems. Mayor Howell stated that if a deed restriction states that you cannot build closer than 25 feet to the line, and the city regulation is 20 feet, theoretically, the city could issue a building permit. At some point in time, if this piece of property is sold, the owner will have difficulty with title in- surance because he has violated the deed restrictions that he agreed to when he bought the property. Mayor Howell stated that if the City Commission has approved the plat showing a building restriction line that is 25 feet, even though our ordinance states 20 feet, this would indicate that the approval of the plat would take precedence over a city ordinance because the commission approved a different set back line. The city should amend the set back restrictions to provide that they will be not less than 20 or 25 feet unless the building restriction line as shown on the plat of a subdivision or deed restriction indicate that they shall be greater. The deed restriction should be respected as long as they are greater than what the city requires. Mayor Howell stated that the city has received a letter from Mr. Sayes, Local Government Assistant Specialist, Department of Com- munity Affairs recommending that the city officially apply for the HUD 701 Planning Assistance Fund. Mr. Sayes recommended that the city initiate a comprehensive planning program. Also included in this recommendation was a synopsis of assessments listing the sug- gested work elements. Mayor Howell stated that the next step will be for the city to contact a planning consultant to aid in developing the proposed work program. This proposed work program and estimated cost should be submitted by February 21, 1975. He stated that the city is going to have to contact three or four consultants in order MINUTES FEBRUARY 10, 1975 PAGE FIVE for them to prepare a proposal to submit before the deadline.
