The invocation was given by Commissioner Minton followed by the pledge to the flag. Approval of the minutes of September 12, 1977 Cook X Jensen X Motion: The minutes of the regular City Commission meeting of Minton X X September 12, 1977, be approved as submitted. Mhoon X X * * * * * * * * * * * * * * * * * * * •* * * * * * Howell X Recognition of Visitors Mayor Howell recognized Mrs. Gregg, who requested the Commission to investigate the possibilities of constructing a weather shelter for approximately 35 school children on Skate Road. The Mayor reminded Mrs. Gregg that shelters would have to be constructed throughout the City if one was built on Skate Road. He added that he would study the matter. Mrs. Koenig was recognized by the chair and inquired if any action could be taken to clean up the property located at the northeast corner of Mayport Road and Atlantic Boulevard. Mayor Howell stated the property was presently under foreclosure. Unfinished Business A. Bid opening - Validator-Register The following bids were received and opened: 1. NCR $3,534.00 $256.00 annual maintenance 2. Victor 3,361.50 360.00 three-year maintenance contract 3. Sweda, Intl. 1,990.00 126.00 per year maintenance for 2-3 year contract The Mayor suggested that the bids be turned over to committee with the view of submitting a report at the next meeting. Lots 2-4-6 Block 9, Report of Planning Board Mr. John Andresen, Chairman of the Advisory Planning Board, informed the Commission that the Board had approved the subject application Cook X for P.U.D. He explained that the architect and the owners agreed to Jensen X provide two additional off-street parking spaces to satisfy building Mhoon X X code requirements. Instrument Maintenance Contract; Mr. Parks Mr. Parks recommended to the Commission, inasmuch as Fischer Porter ' Company presently have no meters, chlorinators, or other instruments installed in the City's utility system, that the City not enter into Cook X X such a contract. Jensen X Mhoon X X Motion: The recommendation of Mr. Parks in regard Minton X to the Fischer Porter contract be accepted without Howell X further action. * * * * * * * * * * * * * * * * * * * * * * * * * * * D. Mr. Parks re missing 8" valve Selva Marina and Saturibe Drive Mayor Howell outlined (for the audience's benefit) data contained in correspondence with B. B. McCormick & Sons concerning an 8" utility valve which supposedly was installed by the latter at Selva Marina and Saturiba Drive. Mr. Parks remarked that he had not received a Cook X reply to his request that the firm locate the valve. He also noted Jensen X that if the valve is located, the City would pay the cost of excavation Mhoon X X and coverup, otherwise the firm should reimburse the City in the Minton X X amount of $1,195 for recent installation of the item. Howell X Motion: Turn the matter over to the City Attorney for further action. * * * * * * * * * * * * * * * * * * * * * * * * * * The chair recognized Mr. George Bull, Sr. , who expressed the opinion that B. B. McCormick was diligently pursuing the entire matter to letermine if, in fact, the valve had been emplaced. He added that since B. B. McCormick did not have the opportunity to investigate the circumstances prior to the paving of Saturiba Drive, the City perhaps would be hasty in taking legal action at this time. Continued Public Hearing P.U.D. 2nd Street and Beach Avenue Mr. John Andresen, representing Mr: & Mrs. Edward B. Then, owners of the property, reported the one violation of the application had been corrected (the stairs had been moved to the street side) and Cook X specified the only request for a variance embraced an 18" overhang 4 Jensen X on the south side for a balcony. Mayor Howell invited the audience Mhoon X X to examine the plans and comment from the floor. As no one spoke Minton X X for or agaHst, the Mayor declared the public hearing closed. Sewer Bonds Mayor Howell presented and read in full Resolution No. 77-10 redeeming 10 - 3.90% General Obligation Sewer Bonds in the amount of $10,000.00, Cook X -aid Bonds bearing maturity date of April 1, 1977. Ordinance No. 20-77-32 Budget 1977-78 Third Reading-Public Hearing AN ORDINANCE ADOPTING THE BUDGET FOR THE CITY OF ATLANTIC BEACH, FLORIDA, FOR THE FISCAL YEAR 1977-78 AND APPROPRIATING MONEY TO PROVIDE FOR THE DEBTS AND EXPENSES OF THE CITY OF ATLANTIC BEACH AS THEREIN SHOWN. Said Ordinance was presented in full, in writing, and read on third and final reading by Mayor Howell. Said Ordinance was posted in line with charter requirements. Mayor Howell then opened the floor for a public hearing. As no one spoke for or against, the Mayor declared the public hearing closed. Motion: Move that Ordinance No. 20-77-32 be passed Cook X on third and final reading. Mhoon X Mayor Howell moved for a substitute motion indicating that the budget not be passed, but be returned to the City Manager for the following necessary corrections: 1. Number budget pages. 2. Insert capital improvement page. 3. Include a salary list by position (Mayor Howell declared that it is mandatory for the Commission to establish the salaries of the City Manager, the City Clerk, and the Treasurer) . Motion: Move that the substitute motion by Mayor Howell Cook X be passed. Tucker, City Clerk RESOLUTION 77-10 WHEREAS , the City of Atlantic Beach has redeemed 10 - 3 . 90% Sewer Bonds in the amount of $10, 000. 00 said Bonds bearing maturity date of April 1, 1977, and, y WHEREAS, the City has redeemed Sewer Bond interest coupons, which have become due through September 30, 1977 . NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF ATLANTIC BEACH, DUVAL COUNTY, FLORIDA, that the follow- ing numbered bonds totaling $10, 000. 00 be burned when received: Numbers 111 through 120 and that, The following numbered interest coupons be burned: Coupon #37 from Bonds 121-200 Coupon #37 from Bonds 206-210 Coupon #37 from Bonds 216-300 The above and foregoing Resolution passed by the City Commission on September 26 , 1977. • ATTEST: (SEAL) Adelaide R.
