The meeting was called to order by Mayor Commissioner, Mr.
Howell . The invocation was given by Commissioner Cook
followed by the pledge to the flag.

Recognition of Visitors
Mayor Howell recognized Mrs . Chris Capps, Assistant Coordi-
nator for the Atlantic Beach Community School, who introduced
Mr. William Trotter, a CETA employee Mrs Capps presented
a painting of the City Hall, which was a work by Mr. Trotter,
to the City Commission in behalf of the Atlantic Beach
Community School Mayor Howell expressed thanks for the
painting in behalf of the Commission.
The chair recognized Mr. George Bull , Sr. , who presented a
revised plat and covenants and restrictions of Selva Marina
Unit 11 (with the commercial tract excluded) for the
Commission' s approval . Mayor Howell stated a public hearing
would be conducted on Selva Marina Unit 11 on July 11, 1977
at 8: 00 P.M.
The chair recognized Mr. Harry Williams, 332 6th Street, who
voiced his objections to the new shuttle bus driving down
6th Street, due to the width of the street, the street con-
dition, and many small children who live on that street. Mr.
Williams said that according to the schedule, the bus is
supposed to travel down 7th Street. Mr. Vogel stated he
had contacted a JTA representative who felt that the bus
driver had missed 7th by mistake. Mayor Howell informed
Mr. Williams he would be in touch with JTA authorities the
next day to insure use of the proper route .

A. Petition re 329 11th Street
•
The chair recognized Mr. William G. Noe, Jr. , to speak
in behalf of the approximately 20 petitioners who are
concerned about the construction of a secondary dwelling
at 329 Eleventh Street. Mr. Noe stated there were several
matters he wished to make known: (1 . there is a violation
of the set back requirements on the east side of the •
property line; (2 . a possible use of the construction as
a dwelling in violation of the zoning laws; (3 . the issuance
of a $900 permit for a $14,000 construction job. Mr. Noe
asked the commission exactly what they intended to do
,about these violations, and why construction was allowed •
to proceed when it was obvious to the building inspector
- that the construction would be well in excess of $900.
Mr. Noe also asked for a clarification of the construction.
Mayor Howell stated that the set back line was approved by •
City officials for reasons unknown to him and that he did
• not know what could be done about the matter at this time.
Mr. Noe asked if the building inspector had the authority
to waive a violation. Mr. Steckla btated that the set-back
and the permit were approved on April 26, 1977, based on
data contained in the building permit application. He adc-
ed that on May 5, 1977, when it was apparent there was a
violation, a stop work order was placed on the structure.
After a short discussion between Mr. Noe and others, con-
cerning the building, Mayor Howell stated the matter under
discussion had not been brought to a halt. He read a letter
from Mr. Rawls which was stated that "the premises in-
volved
were inspected. at 5:30 p.m. on Wednesday, June 15,
1977 , by the City Building Inspector, the City Manager,
and the City Attorney and at that time Mrs. Newfang was
living only in that portion of the structure which has
been used as a living area since long before the City es-
tablished its present codes. There has been no change in
that situation since that inspection. " Mayor Howell stat
ed he certainly intended to take Mr. Rawls word on this
matter, until the entire matter can be resolved. Mayor
Howell also stated he felt the building applications
should be tighten up considerably.
B . Letter; William G. Noe, Jr. 6/13/77
Mr. Noe informed the Commission he was representing Mr.
George Bull regarding the increases of water tap-in fees
and sewer charges which Mr. Bull felt to be unfair. Mr.
Noe further stated that his client feels these charges ar:
an attempt to improve the capital structure of the water
and sewer systems at the expense of developers, and at a
cost far in excess of any reasonable amount that should
be charged. Mr. Noe requested the Commission to re-open

the matter and re-consider the charges for the tap-in
fees as Mr. Bull did not feel he was advised of these
proposed charges when additional construction was planned
for Selva Marina . Mayor Howell stated these charges have
been placed to create money to construct new plants and
facilities to take care of the growth of the City and not
to re-vitalize the old sewer and water system. Mr. Vogel
stated the City of Atlantic Beach charges were not in
excess of the other neighboring cities .
Report of City Manager
Mr. Vogel requested Commission approval to update the
Police and Fire Department ' s airconditioning and heating
system with a water to air system thereby saving the City
money in the long run. He requested permission to call
for bids at the next meeting. Commission agreed.
Unfinished Business
A. Walter J . Parks, Jr. , re Sewer Line and Manhole S/M
Mr. Parks informed the Commission that he had inspected
the sewer lines at Selva Marina Unit #9 and recommended
that the City accept the lines for maintenance . He point-
ed out that the sewer lines at Saturiba Drive are accept-
able, but that the paving is not yet completed.

-7, a Memorial and Resolution dedicated to the memory of
Judge Archibald H. Dunlop for his service to the City of
Atlantic Beach.

RESOLUTION # 77-7
MEMORIAL AND RESOLUTION
,
WHEREAS, on the 20th day of June, 1977, death brought to a close the active
life of Judge Archibald H. Dunlop; and
WHEREAS, Judge Archibald H. Dunlrp, through his keen foresight and unremitting
zeal in furthering the interests of this community, earned the
affection and respect of the people of the City of Atlantic Beach,
Florida; and •
WHEREAS, the stature he attained in this community by his dedicated service
as Municipal Judge for 20 years, and his unselfish support of
numerous charitable, patriotic, and civic organizations, including
Selva Marina Country Club, was fully recognized during his lifetime.
Judge Dunlop always gave must generously of his time and energy for
the benefit of his friends, neighbors, and citizens of Atlantic
Beach. The Mayor-Commissioner, Commissioners, and Officials of the
City of Atlantic Beach acknowledge that they have lost one of their
most valued and respected citizens.
In consideration of the foregoing,
BE IT RESOLVED by the Mayor-Commissioner, the Commissioners, and
Officials of the City of Atlantic Beach, Florida, that we hereby ' -
express our profound and sincere appreciation for Mr. Dunlop's
communal contributions and services, and that we hereby express to
his family our most heartfelt sympathy.
BE IT FURTHER RESOLVED that a true copy of this Resolution be made
part of the permanent records of the City of Atlantic Beach, Florida,
and that the original, duly inscribed by the Mayor-Commissioner, the
Commissioners, and Officials of the City of Atlant' Beach, Florida,
be forwarded to his widow.
