Mr. Joe Napier re Occupational License MINUTES OF THE REGULAR MEETING OF THE ATLANTIC BEACH CITY COMMISSION HELD AT THE CITY HALL ON DECEMBER 28, 1976 AT 8:00 P.M. PRESENT: William S. Howell , Mayor-Commissioner Robert B. Cook, Sr. Alan C. Jensen James E. Mhoon L. W. Minton, Jr. , Commissioners AND: R. C. Vogel , City Manager Oliver C. Ball , City Attorney Adelaide R. Tucker, City Clerk The meeting was called to order by Mayor Commissioner, Mr. Howell . The invocation was given by Commissioner Minton followed by the pledge to the flag. The minutes of the meeting of December 13, 1976, were approved as written upon a motion by Commissioner Mhoon, seconded by Commissioner Minton and carried. Recognition of Visitors Resolution # 17 commending Judge Charles M. Anderson for 18 years of out- standing service aa City of Atlantic Beach municipal judge was presented and read in full by Mayor Howell . Motion was made simultaneously by Commissioners Cook and Mhoon, seconded by Commissioner Minton and carried unanimously to adopt said resolution. Copy of Resolution N 17 is attached hereto and made a part hereby. Mayor Howell also presented a plaque to Judge Anderson's dedication to a better community. Correspondence Mayor Howell announced receipt of a telegram from U. S. Representative Charles Bennett stating that an Enviromental Development Administration grant in excess of $1 ,000,000 had been approved subject to final compliance with regulations. The Mayor pointed out that the City was facing a bond issue for water system improvements before next summer had this grant not been approved and that he felt the citizens and city commission should be very grateful . Unfinished Business A. Mr. Vogel presented the Advisory Planning Board's recommendation the firm, Kellum, Patterson & Bell , be utilized to complete the Atlantic Beach Compre- hensive Plan in accord with attendant guidelines. After a short discussion with Mr. John Andresen, Chairman of the Advisory Planning Board, Commissioner Cook moved to continue required planning with Mr. Bell 's firm, seconded by Commissioner Jensen and carried. B. Pre-application for Block Grant - Mr. Vogel pointed out to the Commission that Mr. Robert Goll , of Goll and Associates, had expressed a desire to serve as consultant for the Block Grant and inasmuch as Mr. Goll had been highly MINUTES DECEMBER 28, 1975 PAGE NO B. Continued instrumental in the City's obtention of the Enviromental Development Administration Grant, he and the Planning Board recommended employment of Mr. Goll . Motion was made, seconded by Commissioners Mhoon and Minton and carried that Mr. Goll be engaged to pursue the City's effort to obtain the subject Block Grant. Action on Resolutions # 76-18 - Emma M. Stephens Mayor Howell presented and read in full Resolution # 18 commending Emma M. Stephens for 12 years of faithful service to the City. Upon a motion by Commissioner Cook, seconded by Commissioner Jensen, the resolution was adopted unanimously. Copy of said resolution is attached hereto and made a part hereof. Resolution # 76-19 - Bank Signatures effective January I , 1977 Resolution # 76-19 was presented and read in full by Mayor Howell . Upon a motion by Commissioner Mhoon, seconded by Commissioner Minton the resolution was adopted unanimously. Copy of said resolution is attached hereto and made a part hereof. Action on Ordinances # 95-76-15 - Annual Monetary Contribution To The Jacksonville Beaches Chamber of Commerce Ordinance 95-76-15 providing for a monetary contribution, not to exceed Two Thousand Five Hundred Dollars annually, to the Jacksonville Beaches Chamber of Commerce, providing an effective date was presented by Commissioner Cook and read by title only. Commissioner Cook requested that the rules be waived, and moved for passage of the Ordinance on first reading by title only. Motion was seconded by Commissioner Jensen and carried. Miscellaneous Business - Mr. Joe Natier - Occupational License Mayor Howell recognized the Chief of Police, Carl Stucki , in response to the decision of the Commission at the meeting of December 13, 1976 to have Mr. Natier appear before the Commission on this date to show just cause why his license should not be revoked. Chief Stucki reiterated that the Police Depailment felt that the Beaches Sipping & Singing Society, which is ostensibly operating as a private club, should fall in a category requiring compliance with beverage law regulations, particularly with respect to closing hours and other operations. Pictures of vending machines located in the club were presented to the Commission for their information. Mayor Howell recognized Mr. Joe Natier, President of the Society, who stated that to the best of his knowledge, the club was still operating under the original concept of a private club, and offered to make any changes the Commission felt necessary. MINUTES DECEMBER 28, 1976 PAGE THREE Miscellaneous Business Continued Mr. Joseph E. Johnson, Jr. , 724 2nd St. South, Jacksonville Beach, was also recognized by the Mayor. Mr. Johnson stated he had been working the door for two months, that a guest signature list had been enforced, and that the activity was strictly operated as a private club. After a lengthy discussion, the Commission agreed to instruct Mr. Napier to confer with the City Attorney, Mr. Oliver C. Ball , and Chief Stucki to attempt to resolve the issues involved. Mr. Ball was asked to render a report at the next meeting at which time the hearing would be continued. There being no further business, Mayor Howell declared that the meeting be adjourned. Anderson has served the people of Atlantic Beach, Florida, as Municipal Judge from 1958 until the present time, and WHEREAS, Judge Anderson has diligently, conscientiously and faithfully performed the duties and obligations of the office of Municipal Judge, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF ATLANTIC BEACH, FLORIDA: THAT, Judge Anderson be commended for the outstanding services rendered to the City of Atlantic Beach, Florida; and THAT recognition of such service be spread upon the minutes of this body and that a copy of this resolution be presented to Judge Anderson as a token of appreciation from the people of the City of Atlantic Beach, Florida. • * * * * * * * * * * * Adopted by the City Commission of the City of Atlantic Beach, Florida, on December 28, 1976'. Stephens has served the City of Atlantic Beach, Florida, as Cashier and as Treasurer-Comptroller for 12 years, and WHEREAS, Mrs. Stephens has conscientiously and faithfully performed the duties and obligations of these offices, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF ATLANTIC BEACH, FLORIDA: THAT Mrs. Stephens be commended for faithful services rendered to the City of Atlantic Beach, Florida; and THAT recognition of such service be spread upon the minutes of this body and that a copy of this resolution be presented to Mrs. Stephens as a token of appreciation from the people of the City of Atlantic Beach, Florida.
