MINUTES OF THE REGULAR MEETING OF THE ATLANTIC BEACH
CITY COMMISSION HELD AT THE CITY HALL ON SEPTEMBER 2.7,
1976 AT 8:00 P.M.
PRESENT: William S. Howell , Mayor-Commissioner
Alan C. Jensen

The meeting was called to order by Mayor-Commissioner, Mr. Howell .
The invocation was given by Commissioner Minton followed by the
pledge to the flag.
The minutes of the meeting of September 13, 1976, were approved as
written upon a motion by Commissioner Mhoon, seconded by Commissioner
Jensen and carried.
Recognition of Visitors ,
Mayor Howell recognized visitors and called for any business from the
floor not on the agenda. Mrs. Eleanor Harvey, 385 1st Street spoke
in support of a letter from Dr. Lynne S. Schwab to Mayor Howell (also
signed by 13 neighbors), which in essence stated that action should
not be taken by the City to remove a row of concrete blocks from the
front of the lawn of Miss Sue Verner, 368 1st Street. After a lengthy
discussion by all interested parties, the Commissioners agreed that the
supporters of Miss Verner should have their Attorney, Mr. Joel Kauffman,
contact Mr. Ball , the City Attorney, to confer on the subject and
attempt to resolve the issue. The Mayor requested Mr. Ball to notify
the City Manager on the following Thursday and advise if there is any
reason why the order of the City Commission to remove the blocks
should not be executed. Commissioner Minton requested the City Manager
to report on the matter at the next meeting.
The Mayor called for any other business not on the agenda. A lady
questioned the legality of having 3' metal posts driven in the ground
on City property, to prevent cars from driving over a corner curb
to enable Spanish bayonets to grow, thus creating a blind corner. The
Mayor stated that action will be taken by the City authorities to
investigate the matter.
A complaint was made that the public owned stairways to the Beach on
4th Street were in very bad shape. The City Manager stated he would
have the steps repaired as soon as possible.

Correspondence
A. Mayor Howell recognized Mr. Walter Williams and Mr. Clyde Montgomery,
from Jacksonville Electric Authority. They presented a brief summary
of the upgraded service JEA hopes to provide within 60 days to new
customers and good paying customers giving them a high priority. The
Mayor expressed thanks for the briefing.
5_ Unfinished Business of Preceding Meeting
A. The Mayor stated that Mr. Pharr had requested the proposed Cemetery
discussion be postponed until the next regular meeting.
B. Zoning North of Atlantic Beach - Commissioner Jensen
A large group of Citizens from North Atlantic and Atlantic Beaches
made a strong representation to the Commission to formulate an official
position opposing the development of a high-rise project in North Atlantic
Beach. Commissioner Jensen explained to the audience that Mr. Preben
Johansen had requested the Mayor notify the latter what available
municipal services were available for North Atlantic Beach from the
City of Atlantic Beach, especially in regards to the proposed condominimums.
The Mayor, in a letter to Mr. Johansen, stated that the City has a
moratorium on provision of sewer and water outside the city limits, and
therefore could not provide any services other than limited police and
fire protection. Commissioner Jensen stated Mr. Johansen welcomed all
interested citizens to attend meetings on the attendant zoning in
Jacksonville and express their opposition. Mayor Howell stated it was
not within the purview of one municipality to attempt to regulate
another municipality's actions.
C. Chapman Construction Company; Storm Drainage
The City Manager informed the City Commission that Chapman Construction Co.
is still seeking information on the status of their bid. Mayor Howell
suggested that Mr. Parks apprise the firm of possible changes in the
project and determine areas that should be resolved prior to awarding
the bid.
D. Mayor Howell suggested to Mr. Parks the report for the cost estimate
for water plant plans and specifications be held over until a special
called meeting could be held.

7. A. Resolution 76-10 Levying and Imposing Special Conditions to
Clean-Up 151 Seminole Road
Resolution #76-10 was presented and read in full by Mayor Howell and
upon a motion by Commissioner Mhoon, seconded by Commissioner Minton
said Resolution was adopted by unanimous vote. Said Resolution is
attached hereto and made a part hereof.
7. B. Resolution 76-11 - Maintaining Ocean-Front Street Ends
Resolution #76-II was presented and read in full by Mayor Howell and
upon a motion by Commissioner Mhoon, seconded by Commissioner Jensen
said Resolution was adopted by unanimous vote. Said Resolution is
attached hereto and made a part hereof.
8. Action on Ordinances
A. Ordinance #20-76-11 ; Budget 1976-77 - Third Reading- Public Hearing
Ordinance #20-76-11 adopting the Budget for the City of Atlantic Beach,
Florida, for the fiscal year 1976-77 and appropriating money to provide
for the debts and expenses of the City of Atlantic Beach as therein
shown, was presented in full , in writing and read on third and final
reading by Mayor Howell . Said Ordinance was posted in line with charter
requirements. Mayor Howell then declared the meeting in session for
a public hearing. As no one spoke for or against, Mayor Howell then
declared the public hearing closed. Commissioner Mhoon moved for
passage of Ordinance #20-76-11 , seconded by Commissioner Minton. Vote
was unanimous for passage of Ordinance #20-76-I1 , Budget for 1976-77.
B. Ordinance #90-76-66; Second Reading- Zoning
Said Ordinance was presented in full , in writing and read by title
only on second reading by Mayor Howell . Upon a motion by Commissioner
Mhoon, seconded by Commissioner Minton, said Ordinance was passed on
second reading - title only and carried.
9. Miscellaneous Business
A. Frank Jaquett; Lil ' Champ Food Store
The City Manager informed the Commission Lil ' Champ had requested per-
mission to construct a convenience store at Mayport Road and Cornell
Lane. After reviewing the plans, motion was made by Commissioner Minton
for approval . It was seconded by Commissioner Mhoon and carried.

9. B. Don Johnson Construction Co. ; Three Residences Selva Marina Unit #9
Three plans were presented to the Commission for approval - Lots 6, 8,
and 10, Blk I . After reviewing the plans, Commissioner Minton moved that
Lots 8 and 10, Selva Marina Unit #9 be approved. Motion was seconded
by Commissioner Mhoon and carried. Motion was made by Commissioner Mhoon,
seconded by Commissioner Minton, and carried that Lot 8 be disapproved
because a proposed setback did not meet requirements.
C. Ad for Fletcher Jr. High Band Program
Mr. Vogel stated Fletcher Jr. High School Band had requested a donation
in the amount of $50.00 to support their programs. Motion was made by
Commissioner Mhoon, seconded by Commissioner Minton, and carried
unanimously to donate $50.00.
D. Mr. Vogel advised the Commission of an emergency request from the
Fire Station for overhead garage doors. Since a fireman had suffered
a rupture closing the present doors, the City Manager requested approval
to purchase new lightweight doors for a total of $826.00 which would be
expended from the current budget. Upon a motion by Commissioner Mhoon,
seconded by Commissioner Minton, vote was unanimously carried to approve
the purchase.
E. The Mayor recognized Mr. Goll of R. A. Goll & Associates for the
purpose of discussing the status of a new Federal Public Works Program.
After Mr. Goll 's presentation it was determined that in order to expedite
the necessary pre-application activity, it would be in the best interest
of the City to be prepared for a special called committee meeting of the
City Commission as soon as final actions of Congress and the President
become known.
F. Mayor Howell told the Commissioners of a serious sewer breakdown last
week on Cavalla Rd. and that Jacksonville Utilities were called on an
emergency basis. The cost of repairs approximate $6,400.00. Motion was
made by Commissioner Minton, seconded by Commissioner Mhoon and carried
to approve payment of the estimated cost.
G. Mr. Vogel requested approval from the Commission to purchase a copystat
machine. Motion was made by Commissioner Mhoon, seconded by Commissioner
Minton and carried to authorize the purchase.
There being no further business, Mayor Howell •eclare• , at the meeting

RESOLUTION NO. 76- 10
A RESOLUTION LEVYING AND IMPOSING SPECIAL CONDITIONS
FOR THE REMOVAL OF SHRUBS , WEEDS , TRASH AND OTHER
MATERIALS AND ABATEMENT OF UNSANITARY CONDITIONS ,
PERSUANT TO THE PROVISIONS OF ORDINANCE NO. 55-59-4
OF THE CITY OF ATLANTIC BEACH, FLORIDA , AGAINST THAT
CERTAIN PROPERTY THAT IS HEREBY DECLARED TO BE A
PUBLIC NUISANCE .
BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF ATLANTIC BEACH ,
FLORIDA,
SECTION 1 . It is hereby ascertained , determined and declared that
the certain structure , occurrence or condition upon that certain
property descrived as :
Lot S 33 ft , Lot 631 , N 33 ft , Lot 632 , Saltair Section 1.
Known as 151 Seminole Road , Atlantic Beach , Florida
Owner Eugene Jawleski
to be an unsanitary premises , occurrence or condition as described and
specified to the owners and interested parties by written notice hereto-
fore served, pursuant to the provisions of Ordinance No . 55-59-4 .
SECTION 2 . That the aforesaid conditions constitute a public nuisance .
SECTION 3 . The City Manager , or his duly authorized agent , is hereby
ordered to :
Inform the above mentioned owner to clean-up and remove trash , debris
and other materials which are scattered profusely over the owner ' s
premises , by October 16 , 1976 , and if the owner shall fail to comply ,
the City Commission shall have the premises cleaned-up and assess the
cost of such removal against the property, which assessments shall be
a lien against the property and shall be collected as other taxes or
assessments .
SECTION 4. The City Manager , or his duly authorized agent , shall cause
a true copy of this Resolution to be posted upon the premises and a true
copy delivered or mailci to the owner and interested parties .
SECTION 5. This Resolution shall take effect immediately upon its
passage .
