Adjourn MINUTES OF THE REGULAR MEETING OF THE ATLANTIC BEACH CITY COMMISSION HELD AT THE CITY HALL ON MAY 24, 1976 PRESENT: William S. Howell , Mayor-Commissioner Robert B. Cook, Sr. James E. Mhoon L. W. Minton, Jr. , Commissioners AND: R. C. Vogel , City Manager Oliver C. Ball , City Attorney Adelaide R. Tucker, City Clerk ABSENT: Alan C. Jensen, Commissioner The meeting was called to order by Mayor-Commissioner, Mr. Howell . The Invocation was given by Commissioner Minton, followed by the pledge to the flag. The minutos of the regular meeting of May 10, 1976 were approved as written upon a motion by Commissioner Minton, seconded by Commissioner Cook and carried. Mrs. Clare McCreary thanked the City Commission for the lights and baseball field provided for the baseball team. She was very proud to announce the team is now in second place. Mr. Bobby Smith expressed thanks to the Commission for plans to improve Donner Park and offered his help on the construction. Mrs. Louise Runyon read in full a petition signed by 65 citizens requesting steps to the ocean be built on the 10' easement donated to the City by Gerry Adams. After much discussion, motion was made by Commissioner Minton for the petition for steps be sent to committee for review and report at next meeting. It was seconded by Commissioner Cook and carried. Members of the committee are Commissioner Minton, Mr. Walter Parks, City Engineer, and Mr. R. C. Vogel , City Manager. Mrs. Rose H. Blanchard presented a proposal for a Jr./Sr. League baseball field at Jack Russell Park. Mayor Howell stated that this would be turned over to Commissioner Jensen, Chairman of the Recre- ational Committee for review. Mr. Wayne Benhart, Atlantic Beach Convenience Store stated that he had been denied permission by the City Manager and the Chief of Police to sell smoke bombs and he requested permission from the Commission. The City Attorney was instructed to give an opinion on the legality of the items in question. Report of City Manager Mayor Howell stated that we have all received a copy of the City Manager's report and that it would be proper at this time to take action on the City Manager's request to make application for a Federal Grant to financially assist the City in construction of the proposed new water facilities. Page Two Minutes May 24, 1976 Commissioner Mhoon made the motion authorizing the City Manager to ask for Federal Funding for the new water facilities. It was seconded by Commissioner Minton and carried unanimously. Bid Opening: Diesel Engine Tractor With Mower The following bid was received and opened: Jax Tractor - Jacksonville, Fla. $3,643.00 Net with trade-In Roll-over protector with seat belt additional 180.00 $3,823.00 With no objections, motion was made by Commissioner Minton to purchase tractor from Jax Tractor with roll-over protector and seat belt, seconded by Commissioner Cook and carried. Bid Opening: Magnetic Record Mini-Computer The following bids were received and opened: NCR - 499 - $23,636.25 8200 - 49,920.00 IBM 34,410.00 Burroughs 24,300.00 Motion was made by Commissioner Minton that bids be referred to committee, seconded by Commissioner Mhoon and carried. Committee comprising of Commissioners Mhoon and Jensen, the City Manager and the City Treasurer. Bid Openi nq: Parks Pro iect The following bids were received and opened: R. W. King Construction Co. , Inc. Alt. I $3,070. Melbourne, Fla. Alt. 2 7,360. Alt. 3 13,540. $23,970. Conrad Weihnacht Construction, Inc. Alt. 1 4,850. Jacksonville, Fla. Alt. 2 6,675. Alt. 3 11 ,700. $23,225. Motion was made by Commissioner Cook that bids be referred to committee, seconded by Commissioner Minton and carried. Committee members to be Commissioner Mhoon, Mr. R. A. Goll and the City Manager. Pogo Three Minutes May 24, 1976 Report of Committees Commissioner Cook reported that in his opinion it would be a waste of time to pave Sturdivant or Main Streets at this time due to the fact that all utilities are not in place on these streets. He also stated that this would set a precedent for other property owners to make similar requests. He suggested that a policy be established of property owners sharing the expense of improvements in front of their property. It was moved and seconded by Commissioners Mhoon and Minton that the Commission accept the report. It was carried unanimously. Mr. Parks gave his committee report for the new water well and stated that it was the committee' s recommendation to award the low bidder, Southern Drillers, Inc. , Jacksonville, Fla. who bid $27,800.00 with two provisos: I . Receives a permit from the State Motion was made by Commissioner Cook, seconded by Commissioner Mhoon that award be made as recommended by committee, and was passed unanimously. ORDINANCE #80-76-I4 - Second Reading - Water Rates Ordinance #80-76-I4 covering change in water rates was present3d in full in writing and read by title only on second reading by Mayor Howell . Upon a motion by Commissioner Mhoon, seconded by Commissioner Minton, said Ordinance was passed on second reading. Third and final reading and public hearing to be held on June 14, 1976. ORDINANCE #65-76-I - Street Closing - First Reading Ordinance #65-76-I covering closing of David St. West of Belvedere was presented in full in writing and read by title only on first reading by Mayor Howell . Upon a motion by Commissioner Cook, seconded by Commissioner Minton, said ordinance was passed on first reading - title only. Miscellaneous Business A request was made by Norma and Verns Trading Post, 1453 Mayport Road for an auction permit. After discussion, it was moved and seconded by Commissioners Mhoon and Minton that permit be granted. Mr. Sam Inman, President of Tri-State Development Corporation re- quested permission to develop an apartment complex of 52 units West of Mayport on 10th Street. Mr. Inman was advised by the Mayor our City ordinance requires that multi-family units in excess of three be placed under Planned Unit Development and referred him to the Planning Board for its review and recommendation. Mr. Wardrep, Chairman of the Planning Board, advised the Commission that the planning Board had reviewed Mr. George Bull 's proposed planned unit development of Selva Marina Unit # 9 and recommended approval . The subject of covenants and architectural control was Page Four Minutes May 24, 1976 brought up and after much discussion it was recommended that an ordinance be developed to institute a concept of architectural control without delegating the Commission's responsibility. Mr. Howell asked Commission forgiveness of $57. 14 on ad Valorem taxes that were inadvertently left off the tax sale in 1975 and sold by the Tax Collector for only County taxes. Mr. Vogel requested emergency expenses of $750.00 for an air conditioning unit at the Police Station. Permission was granted. There being no further business, Mayor Howell declared the meeting adjourned. After the meeting adjourned, Milo Smith & Associates gave a report on the City's 25 year comprehensive master plan.
