Adjourn MINUTES OF THE REGULAR MEETING OF THE ATLANTIC BEACH CITY COMMISSION HELD AT THE CITY HALL ON MONDAY, APRIL 12 , 1976 AT 8 : 00 P. M. PRESENT : William S . Howell , Mayor Robert B . Cook , Sr . Alan C. Jensen James E . Mhoon L. W. Minton, Jr . , Commissioners AND : R. C . Vogel, City Manager Oliver C . Ball , City Attorney Adelaide R. Tucker , Acting City Clerk The meeting was called to order by Mayor-Commissioner , Mr. Howell . The invocation was given by Commissioner Minton, followed by the pledge to the flag. The minutes of the meeting of March 22 , 1976 were approved as written upon a motion by Commissioner Mhoon , seconded by Com- missioner Minton and carried. Mrs . Kinman of 351 Main Street stated that there was a terrible dust problem due to the traffic on Main Street and asked the Commission if something could be done to correct the situation. Mayor Howell requested the City Manager to look into the problem and report back at the next Commission meeting. Mayor Howell stated that from West 1st Street to West 6th Street should be looked at in particular and also Sturdivant Street. Mr . Norman Chatman of 888 Jasmine Street stated that Mr . Vogel had written him a letter concerning the purchase of his lots in Saltair for the Parks Project . Mr . Chatman stated that he responded to Mr. Vogel ' s letter, but never received a response from Mr . Vogel . Mr . Chatman pointed out that in 1972 he was offered $50 . 00 for each of his lots and Mayor Howell stated that a number of the lots were purchased for $50. 00 . Mayor Howell stated that a licensed appraiser had appraised the lots in 1972 for $50. 00 . Mayor Howell pointed out that the Commission was not interested in purchasing Mr . Chatman ' s lots at his latest offer of $5, 000. 00 per lot and the park lines were drawn to exclude his lots . Mr . David Lambert representing the Beach Leader requested the Commission ' s approval to put an ad in the Leader for the Opening Day Parade edition. Commissioner Mhoon made a motion to have the advertisement at a cost of $150 . 00. The motion was seconded by Commissioner Cook and carried. Mr . Bill Frye complained to the Commission about the parking problem on a lot owned by Mr . Reuben Bennett on Seminole Road where the Tappin Book Mine is located. Mr. Frye stated that he was under the impression that this particular lot was zoned residential . Mr . Vogel was directed to check into the problem and report back at the next meeting . PAGE TWO MINUTES APRIL 12 , 1976 Mr. Vogel stated that Mr. George Cellar would sell Lot 311, Saltair Section 3 to the City of Atlantic Beach for $1, 000. 00 . Mr. Vogel recommended that the city purchase the lot. Com- missioner Mhoon made the motion to purchase Lot 311 for $1 , 000. 00 to come out of the Professional Services Account. The motion was seconded by Commissioner Minton and carried. Mr. Ball was authorized to execute the proper documents . Water Plant Site Development Mr. Parks stated that the surveyor has not yet completed his work and until such time, nothing else could be done. Mayor Howell pointed out the approval for the well drilling had been received. Mr . Parks stated that he was working on the plans and specifications for the well so that bids could be received for the work. 58 Dudley - Condemnation - Septic Tank Mr. Vogel stated that this could be withdrawn due to the fact that the owner has taken care of the problem. Seaspray Subdivision - Final approval Subdivision Plat Mr . Richard Lampp presented the Seaspray Plat for final approval by the City Commission. Commissioner Mhoon made a motion to approve the plat and authorize the Mayor and City Clerk to execute said plat. The motion was seconded by Commissioner Jensen and carried. Report of Committees Specification #76-3 - Garbage Truck - Commissioner Minton stated that he and Commissioner Jensen needed more time to go over more figures and would report at the next meeting. Resolution #76-5 - 62 Dudley Street - Condemnation Resolution #76-5 was presented in full , in writing and read: by Mayor Howell . The motion was made by Commissioner Cook to pass said Resolution. The motion was seconded by Commissioner Minton and passed. Said Resolution is attached hereto and made a part hereof. Ordinance #90-76-65 - Construction of Duplicate Homes - Third and Final Reading; Public Hearing Ordinance #90-76-65 was read in full by Mayor Howell on third and final reading and the meeting opened for a public hearing. There being no discussion for or against said Ordinance, the public hearing was closed. Commissioner Minton made a motion to pass the Ordinance on third and final reading. The motion was seconded by Commissioner Jensen and carried unanimously. PAGE THREE • MINUTES APRIL 12 , 1976 Eugene Barnette - Office Building on Atlantic Boulevard Mr. Broward, representing Broward Builders , presented plans for an office building on Atlantic Boulevard directly west of McDonald' s restaurant. Commissioner Mhoon made the motion for approval of the plans . The motion was seconded by Commissioner Minton and carried. J. C . Boatwright - Royal Palms Subdivision - Skate Road Mr. Boatwright representing Duval Homes , Inc . requested a variance on the square footage of four houses to be built on Skate Road in Royal Palms. It was pointed out that the four houses sur- rounding the proposed new houses did not contain 1200 square feet of heated living area. After much discussion, Mayor Howell recommended that the builders provide off-street parking to bring the total square footage to 1400 square feet. A motion was made by Commissioner Mhoon to approve the variance subject to the off- street parking being provided initially to provide for 1400 square feet . The motion was seconded by Commissioner Minton and passed. John M. Hanna - Plat Eddie ' s Place - Donner Subdivision Mr. Hanna presented a plat for a subdivision bounded by Church Road, Jordan Road and the city playground in the Donner Subdivision . Mr. Hanna stated that the subdivision would be developed for single family dwellings . Mr. Hanna asked for the Commission ' s approval of the submitted plat. After much discussion, a motion was made by Commissioner Minton to approve the plat and authorize the Mayor and City Clerk to sign the plat subject to Mr. Hanna delivering to Mr. Ball the necessary documents to be placed on the public records limiting single family dwellings on each lot. Photomat Corporation - M & L Center - 1479 Mayport Road Plans were submitted for the Commission ' s approval for a photocopy building at 1479 Mayport Road. After discussion, a motion was made by Commissioner Cook to approve the plans . The motion was seconded by Commissioner Minton and carried. Patrick L. McGuire - Request for Auctioneer' s License - 535 Atlantic Boulevard Mr. McGuire requested permission to open an auction house at 535 Atlantic Boulevard. Mr . McGuire stated that public auctions would be held once a week. Commissioner Cook made the motion to grant Mr. McGuire permission to open an auction house at 535 Atlantic Boulevard. The motion was seconded by Commissioner Minton and carried. • PAGE FOUR MINUTES APRIL 12, 1976 Mayor Howell stated that in Tallahassee there are strong dis- cussions in several committees regarding the "911" Emergency Dialing System. There is a motion afoot that either the State come up with the proper funding or repeal the mandate that cities and counties go into the "911" System. Mayor Howell suggested that the City Commission pass a resolution urging the Duval Delegation to : A. Either vote for a bill that will require the State to fund the costs of the "911" Emergency Dialing System, or; B. Repeal the mandate that the cities go into the "911" System. After much discussion, a motion was made by Commissioner Mhoon to pass a resolution urging the Duval Delegation to require the State' to fund the "911"_System, or repeal the mandate . The motion was seconded by Commissioner Minton and passed. Commissioner Jensen asked that a committee look into the pos- sibility of more recreational facilities , such as new tennis courts , etc. Commissioners Jensen and Minton were appointed to the committee and will report back at the next meeting.
