Miscellaneous Business 10 . Adjourn r MINUTES OF THE R?"CUt,AR MEETT?TG OF THE ATLANTIC BEACH CITY COMMISSION HELD AT THE CITY HALL ON MONDAY, MARCH 22 , 1976 AT 8 : 00 P.M. PRESENT: William S. Howell , Mayor-Commissioner Robert B. Cook , Sr. Alan C . Jensen James E . Mhoon L. W. Minton, Jr. , Commissioners AND : R. C . Vogel , City Manager Oliver C . Ball , City Attorney Adelaide R. Tucker , Acting City Clerk The meeting was called to order by Mayor-Commissioner , Mr. Howell . The invocation was given by Commissioner Minton followed by the pledge to the flag. The minutes of the meeting of March 8 , 1976 were approved as written upon a motion by Comrissioner Jensen, seconded by Commissioner Minton and carried. Pic-N-Save The manager , Mr. McFadden, and the attorney, Mr . Frederick Lenczyk , for Pic-N-Save appeared before the Commission concerning the condemnation preceedings initiated by the Director of Public Works and the Resolution invoking a $10. 00 per cart redemption fee pas- sed by the City Commission at the previous meeting . Mr . Lenczyk stated that the purpose of his visit was to assure the Commission that the Pic-N-Save Corporation was desirous in maintaining good business relations with the City of Atlantic Beach, as well as maintaining good public relations with the customers of Pic-N-Save . The Mayor stated that the main complaint the City had was the maintenance of cleanliness in the parking lot and the surrounding area, also the failure to pick up shopping carts that the customer removes from the parking lot and they wind up in drainage ditches or in the street right of way , thus creating a traffic hazard. After much discussion by several commissioners and the attorney and store manager, it was determined that they would do a better job of cleaning up the premises around Pic-N-Save as well as retreaving the shopping carts . Report of City Manager A written report was submitted to the Commissioner ' s with the agenda and said report is attached hereto and made a part hereof. Bid Opening - Specification #76-3 - Garbage Truck The following bids were received and opened : Holiday Ford , Inc . - Daytona Beach , FL $29 , 220 . 00 Lee Chevrolet , Inc . - Jacksonville , FL $26 , 774 . 00 Alternate bid from Lee Chevrolet $26, 768 . 00 r PAGE TWO MINUTES MARCH 22 , 1976 Mayor Howell suggested that the bids go to committee for review. The motion was made by Commissioner Minton , seconded by Commissioner Mhoon that the bids be sent to committee . Commissioner ' s Jensen and Minton were appointed to the committee . R. A. Goll - Parks Project Mr . Robert Goll presented a more detailed plan of the Atlantic Beach Park based on the concept plan submitted at the previous meeting and the Commission ' s comments and changes in the plan . While reviewing the plan , the question was raised as to whether or not there was enough access for vehicles to come into the park area for maintenance purposes . Mr . Goll stated that he made pro- visions in the plans for accesses wide enough for vehicles to enter the park for maintenance purposes . After review and dis- cussion , Mr . Goll asked for the Commission ' s approval of the plan in order to commence with construction drawings . The Commission granted Mr . Goll permission to begin with the construction draw- ings . Water Plant Site Development Mayor Howell stated that Mr . Parks had written a letter to Mr . Robert V. Meyers of the Department of Health, Welfare and Bio- Environmental Services requesting permission to drill a well at the proposed water plant site and after receiving a response , the Commission would be notified . Mayor Howell stated that a tentative commitment with the property owners of the proposed site had been given for a piece of land approximately three acres and a vehicular passage approximately 50 ' in width would also be deeded to the City. Mayor Howell told the Commission that the property would cost $30 , 000 . 00 and stated that he had talked to several appraisers who felt that this price was fair . A motion was made by Commis- sioner Mhoon that $30 , 000 . 00 be paid for the acreage subject to approval to drill a well on the proposed site . The motion was seconded by Commissioner Minton and carried unanimously. Mayor Howell then stated that a tentative agreement had been made with the Selva Marina Board of Directors to run a 24" main along the northern boundary of their property . Ordinance #90-76-65 Mayor Howell read Ordinance #90-76-65 by title only on second reading. Commissioner Minton made a motion to pass the ordinance on second reading by title only. The motion was seconded by Commissioner Jensen and carried . Ordinance #5-76-5 Ordinance #5-76-5 was read in full by Mayor Howell on third and final reading and the meeting opened for a public hearing . There being no discussion for or against said ordinance , the public hearing was closed . Commissioner Cook made the motion to pass PAGE THREE MINUTES MARCH 22 , 1976 Ordinance #5-76-5 on third and final reading with a public hearing . The motion was seconded by Commissioner Minton and carried . Ordinance #80-76-13 Ordinance #80-76-13 was presented in full , in writing and read by Mayor Howell on first reading by title only . Mayor Howell asked that the rules be waived for introduction of the ordinance due to the fact that it was not received in time to be placed on the agenda . Commissioner Mhoon made a motion to waive the rules and pass said ordinance on first reading by title only . The motion was seconded by Commissioner Minton and passed . Commissioner Cook stated that a hearing in the sub-committee of Congress in Washington, D.C . on the Beach Renourishment Program would be held on Mardh 31 , 1976 . He then stated that the Chamber of Commerce suggested that Mayor Howell ) Mayor Craig and Mayor Tanzler be sent to testify.
