MINUTES OF THE REGULAR MEETING OF THE ATLANTIC
BEACH CITY COMMISSION HELD AT THE CITY HALL ON
MONDAY, MARCH 8 , 1976 AT 8 : 00 P.M.

The meeting was called to order by Mayor-Commissioner, Mr. Howell .
The invocation was given by Commissioner Minton , followed by the
pledge to the flag.
The minutes of the meeting of February 23 , 1976 were approved as
written upon a motion by Commissioner Minton , seconded by Com-
missioner Jensen and carried .
Mayor Howell recognized his niece and several other young ladies
in the audience visiting Atlantic Beach from Duke University.
Mr . Roland Blalock - Judge ' s Chambers Restaurant
Mr. Roland Blalock presented plans to remodel his restaurant at
375 Atlantic Boulevard, Atlantic Beach. Mr. Blalock stated that he
wanted to enlarge the restrooms and make several other changes in
the existing building. After discussion and review of the plans ,
Commissioner Cook made a motion that the plans be accepted. The
motion was seconded by Commissioner Mhoon and carried.
Ms. Dorothy Allen - Sidewalk Art Show - Street Closing
Ms . Dorothy Allen requested that Ocean Boulevard from Atlantic
Boulevard to First Street be closed leaving Ahern Street open for
traffic for the Sidewalk Art Show to be held on May 22 and 23 , 1976 .
Ms . Allen stated that containers would be provided for trash col-
lection and arrangements for an off-duty policeman would be made .
Ms . Allen pointed out that she would he responsible for cleaning up
after the show. Commissioner Mhoon made a motion that the street
be closed for the Sidewalk Art Show. The motion was seconded by
Commissioner Cook and passed unanimously.
City of Atlantic Beach Float - Annual Beach Festival Parade
The City Commission received a request from the Chamber of Commerce
to enter a float in the Annual Beaches Festival Parade in April ,
1976. A motion was made by Commissioner Mhoon and seconded by
Commissioner Minton to enter the float at a cost of $325 . 00. The
motion was passed unanimously.

Condemnations - Dudley Street and 725 Atlantic Boulevard
Resolution #76-3 - Condemnation of 62 Dudley Street - was presented
and read in full by Mayor Howell . Commissioner Minton moved for
acceptance of the Resolution. The motion was seconded by Com-
missioner Mhoon and carried. Said Resolution is attached hereto
and made a part hereof.
Resolution #76-4 - Condemnation of 725 Atlantic Boulevard - was
presented and read in full by Mayor Howell . Commissioner Mhoon
moved for acceptance of the Resolution . The motion was seconded
by Commissioner Minton and carried . Said Resolution is attached
hereto and made a part hereof.
Ordinance #5-76-5 - Advisory Planning Board - Second Reading
Mayor Howell read Ordinance #5-76-5 on second reading by title
only. Commissioner Cook moved that said Ordinance be approved
on second reading, title only. The motion was seconded by Commis-
sioner Mhoon and carried .
Ordinance #90-76-65 - Construction of duplicate one-family
dwellings - First Reading
Ordinance #90-76-65 was presented in full , in writing and read
by title only on first reading by Mayor Howell . Commissioner Cook
moved that said Ordinance be approved on first reading, title only,
seconded by Commissioner Mhoon and carried.
Mr. Walter J . Parks - New Water Plant Site
Mr . Parks presented three preliminary prints showing a proposed
water plant site located at the north edge of the Selva Marina
Country Club Golf Course . He stated that this site would comprise
approximately three acres of land with an access off of Mayport
Road. Mr. Parks pointed out that the proposed site was predicated
upon securing an easement from Selva Marina Country Club to bring
a water main across the golf course over to Selva Marina Drive
and from there to Saturiba Drive over to Seminole Road. Mayor
Howell stated that he approached the Selva Marina Board of Directors
concerning the easement and they have tentatively agreed to give
the City a 10 ' to 12 ' easement along the northern border of the
golf course subject to approval of the final plans . Mayor Howell
also stated that he talked to the landowners of the proposed site
and negotiations should be started for a price settlement of the
property. After much discussion , Commissioner Mhoon made a motion
to authorize negotiations for the purchase of the proposed site
property. The motion was seconded by Commissioner Jensen and
carried unanimously .
Mr . Robert A. Goll - Parks Project
Mr . Goll presented a conceptual plan for the Atlantic Beach Park

for the Commission ' s edification and comments . Mayor Howell
pointed out that he was not in favor of the proposed picnic area
because the picnic area at Russell Park would suffice and another
one was not needed. Mayor Howell also stated that he was not in
favor of the parking area at the north end of the park , due to the
fact that there is ample parking at Russell Park . Mr . Hilliard
stated that there is a storm sewer drainage problem and suggested
that the water table not be raised until elevations were confirmed .
After much discussion, Mr . Gall asked the Commission ' s approval
of the conceptual plan of the park with the suggested changes
and permission was granted to proceed with a more detailed plan
to be presented at the next regular meeting.
Mr . Hilliard
Mr. Hilliard asked permission to exceed his purchase limit by
$50 . 00 to purchase a public works radio . He stated that the pur-
chase price is $550 . 00 . A motion was made by Commissioner Cook
to allow Mr . Hilliard to purchase a radio on the public works
frequency for $550 . 00 . The motion was seconded by Commissioner
Mhoon and carried.
Commissioner Mhoon
Commissioner Mhoon stated that he attended the meeting at the
Jacksonville Beach City Hall on the proposed Dog Ordinance for all
three beaches . Commissioner Mhoon reported that a dog warden for
the three beaches was under consideration and a public hearing
would be held in approximately six to eight weeks to discuss the
proposed Dog Ordinance .
Mayor Howell
Mayor Howell stated that he attended the Florida League of Cities
meeting in Tampa, Florida on March 1 and 2 , 1976 . He stated that
a few changes needed to be made in the Atlantic Beach ordinance
on Downstream Pollution charges as per a recent court decision
concerning the Builders and Contractors Association in Pinellas
County vs . Dunedin, Florida . Mayor Howell suggested that the City
Attorney be authorized to change the existing ordinance to limit
the funds strictly for the use of the sewer treatment plant
facilities . The Commission authorized Mr. Ball to make the sug-
gested changes .
There being no further business , Mayor Howell declared the •eetina
be adjourned .

A RESOLUTION LEVYING AND IMPOSING SPECIAL CONDITIONS
FOR THE REMOVAL, SUPPRESSION OR ABATEMENT OF A DANGEROUS
UNSAFE, DILAPIDATED OR UNSANITARY STRUCTURE, PURSUANT TO
THE PROVISIONS OF ORDINANCE NO. 25-67-6 OF THE CITY OF
ATLANTIC BEACH, FLORIDA, AGAINST THAT CERTAIN PROPERTY
THAT IS HEREBY DECLARED TO BE A PUBLIC NUISANCE.
BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF ATLANTIC
BEACH, FLORIDA,
SECTION 1. It is hereby ascertained, determined and declared that
the certain structure, occurrence or condition upon that certain
property described as :

Known as 62 Dudley Steet , Atlantic Beach , Florida

to be a dangerous, unsafe, dilapidated and/or an unsanitary
structure, occurrence or condition as described and specified to

SECTION 2. That the aforesaid conditions constitute a public
nuisance.
SECTION 3. The City Manager, or his duly authorized agent, is
hereby ordered to:
Clean up garbage and debris that is scattered in the yard and
remove the used equipment (i . e . , stoves , refrigerators , etc. ) .
SECTION 4. The City Manager, or his duly authorized agent, shall
cause a true copy of this Resolution to be posted upon the premises
and a true copy delivered or mailed to the owner and interested
parties.
SECTION 5. This Resolution shall take effect immediately upon its
passage.

containers which are scattered profusely around the owners
parking lot and service area at the rear of the building - and
to establish a fee of $10 . 00 _per unit for recovery and return
to owner of shopping carts .
SECTION 4. The City Manager, or his duly authorized agent, shall
cause a true copy of this Resolution to be posted upon the premises
and a true copy delivered or mailed to the owner and interested
parties.
