The invocation, offered by Commissioner Van Ness, was followed by the pledge to the flag. MacLean - Request for rezoning - Lots 675 and 676, Saltair Subdivision The chair recognized Mr. Don MacLean who stated his brother, Sidney had submitted a request to rezone lots 675 and 676, Saltair Subdivision, from single family to duplex. He explained that the lots South and East of 675 and 676 were already zoned for duplex. Mayor Howell suggested this item be moved down to follow the City Manager ' s report and the Commission agreed. B. Letter from Captain M.D.Reynolds to Mayor Hans . G. Tanzler, Jr. -request to reopen Seminole Rd. Mayor Howell acknowledged receipt of a copy of a letter from Captain Reynolds to Mayor Tanzler requesting Seminole Road be reopened from Atlantic Boulevard to Mayport Naval Station. The Mayor expressed the opinion that the letter should be held for information purposes until the next meeting to give time for the Commission to confer with the City of Jacksonville. Commission agreed. City Manager ' s Report Mr. Davis presented and read in full his report to the Com- mission. MS Y N - -nom-- � City Manager ' s Report - continued from Coffman & Coleman, Attorneys at Law, both for legal services rendered the Murphy vs. City of Atlantic Beach case, totaling $2, 348 .84 . Mr. Ball, the city attorney, commented that Coffman & Coleman were experts in this particular field, and felt the fee was very reasonable, as four law suits were involved. Jensen x x Motion: approve payment of invoices, in the amount Mhoon x x of $2, 348.84, to Coffman & Coleman re the Van Ness x Murphy vs . City of Atlantic Beach case . Howell x * * * * * * * * * * * * * * * * * * * * * * * * * * Mr. Davis requested authority to execute an informal agreement with Marvin Hill & Associates to upgrade the Zoning Code for the City of Atlantic Beach, and assist in planning services prior to submission of the Comprehensive Plan. Mr. Hill ' s services would not exceed $8, 000 for the first year. Commissioner Van Ness moved to grant the City Manager authority to sign the agreement with Marvin Hill & Associates, and the motion was seconded by Commissioner Jensen. Discussion of the function of Mr. Hill gave rise to an amendment to the motion to delay until the next meeting the approval of the amended motion; moved by Commissioner Mhoon and seconded by Commissioner Jensen. At this time, Mr. Sidney MacLean ' s request for rezoning was again brought up for discussion and Commissioner Mhoon moved for postponement. FLORIDA 32233 October 23, 1978 CITY MANAGER'S REPORT I am in receipt of two invoices from Coffman 6 Coleman, Attorneys at Law, both for legal services rendered the Murphy vs. City of Atlantic Beach case, one dated September 5, 1978, in the amount of $2,248.34, the other dated October 16, 1978, in the amount of $100.50. I respectfully request authority to pay these two invoices. The City has received an invoice from R. A. Goll and Associates, Inc. , in the amount of $1,800.00, representing amount due to date on contract for professional services in the total amount of $3,800.00 for the Master Plan for the development of Russell and Howell Parks. I request authority to execute an informal agredment with Marvin Hill 6 Associates to be of assistance in the subsequent fiscal year for planning services and upgrading of the Zoning Code for the City of Atlantic Beach. Incumbent in this endeavor is the requirement that our Zoning Code and the Comprehensive Land Use Plan for Atlantic Beach be compatible each to the other. I feel this must be done prior to submission of the Comprehensive Plan as it is presently developed. In its meeting of October 11, 1978, the Board of Adjustment requested the City Manager to make a recommendation for the Board of Adjustment (see excerpt of minutes attached) that a reappraisal of the section of the Ordinance Code relating to attached, unattached and accessory building requirements be reviewed and revised. I would recommend that this be one of the first areas assigned to Marvin Hill 6 Associates if you approve my signing an agreement with them.
